HomeMy WebLinkAbout09. 22-283JULY 12, 2022 22-283 RESOLUTION (CARRIED___6-0____LOST________LAID OVER_______WITHDRAWN_______) PURPOSE: ACCEPT SIDEWALK AND ELECTRIC EASEMENT AT THE SOUTHWESTERLY CORNER OF ALGOMA BOULEVARD AND WISCONSIN STREET (625 ALGOMA BOULEVARD) INITIATED BY: CITY OF OSHKOSH PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the City hereby accepts a sidewalk easement and electric easement at the southwesterly corner of Algoma Boulevard and Wisconsin Street, per the attached, and the proper City officials are authorized and directed to execute any and all documents necessary for purposes of same. Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Mark Lyons, Planning Services Manager DATE: July 7, 2022 RE: Accept Sidewalk and Electric Easement at the Southwesterly Corner of Algoma Boulevard and Wisconsin Street (625 Algoma Boulevard) BACKGROUND The City of Oshkosh is requesting acceptance of an easement for sidewalk and electrical equipment at the southwesterly corner of Algoma Boulevard and Wisconsin Street. The subject site is a 3.38-acre lot located at the southwesterly corner of Algoma Boulevard and Wisconsin Street developed with the University’s Scott Hall Residence Hall and parking lot. The easement will be a 12.5 square foot triangular area located at the northwesterly corner of the subject property, running five feet along both the Algoma Boulevard and Wisconsin Street rights-of- way. ANALYSIS The City is requesting the easement to allow for installation an ADA compliant public concrete sidewalk. In the future, the City may install facilities such as traffic signals, an electric pull box, and related equipment and facilities. These facility upgrades are part of the reconstruction of Algoma Boulevard and Vine Avenue. The easement will allow the City to construct the structures and provide continued access for future maintenance and replacements/upgrades as needed. The City Attorney’s office has drafted the necessary easement documents. The Department of Public Works does not have concerns with the proposal and will work with the property owners to have the appropriate easement documents signed and recorded at the Winnebago County Register of Deeds. RECOMMENDATION The Plan Commission recommended acceptance of the easement as requested on July 5, 2022. Please see the attached staff report and meeting minutes for more information. The following is their discussion on the item. Site Inspections Report: No Commissioners reported visiting the site. Staff report accepted as part of the record. The City of Oshkosh is requesting approval of three sidewalk easements, three electric easements, one pond maintenance easement, one drainage easement and one right-of-way dedication. Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. Staff recommends approval with the findings and conditions as listed in the staff report. Mr. Perry opened up technical questions to staff. Mr. Perry asked for any public comments and asked if the applicant wanted to make any statements. Mr. Perry closed public comments and asked if the applicant wanted to make any closing statements. There were no other public comments on this item. There were no closing statements from the applicant. Chairman Perry called for a voice vote. Motion carried 6-0.
