FOR DESIGN SERVICE OF PARKWAY AVENUE WATERSHED DETENTION BASIN ($20,400.00) INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the City and AECOM Technical Services, Inc. previously entered into an agreement in which AECOM Technical Services, Inc. would provide the City with professional services related to engineering design services of Parkway Avenue Watershed Detention Basin; and WHEREAS, staff has requested additional services related to this project. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed to enter into and take those steps necessary to implement an appropriate amended professional services agreement with AECOM Technical Services, Inc. for additional construction-related engineering services in the amount of twenty thousand four hundred dollars. ($20,400.00). Acct. (AECOM) for Design Services of the Parkway Avenue Watershed Detention Basin ($20,400) BACKGROUND A professional services agreement with AECOM for providing assistance with engineering design services for the Parkway Avenue Watershed Detention Basin was awarded by the Common Council (Council) on July 25, 2017. During the course of the Project, additional services were requested by City Staff. ANALYSIS Due to delays in the negotiation of the property acquisition with Canadian National Railroad (CN), the Project has extended beyond the original schedule for the Project. AECOM has worked to continue to support the City through the property acquisition process with CN. AECOM worked with the City to prepare and submit a Risk Analysis memorandum to assist the City in their negotiations, which was beyond the original scope of services for this Project. As the Project has evolved, the design for the emergency overflow for the pond has changed. It now includes a swale, which ties into Grant Street, which has resulted in the need to acquire a new parcel, instead of the easement which was originally planned. AECOM has assisted the City in the evaluation of the need for this property acquisition and has performed preliminary work to develop a Certified Survey Map (CSM) for this property acquisition. As a result of this additional acquisition, it is anticipated that two (2) CSM’s will now be required. Because of the extended schedule for the Project, additional effort is also required for the preparation of technical specifications and bidding documents for the Project. Updates to the specification to reflect the current City of Oshkosh Standard Specifications will be required. The amount of this amendment is time and materials not to exceed $20,400. This will raise the total agreement amount to $99,050. Funds for this Project are included in the Storm Water section of the 2017 Capital Improvement Program (Account #03210410-2184-04710/Contract Control- Contracts Payable-Storm Sewer-Storm Sewer/Four-Way Construct). RECOMMENDATIONS Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature, including engineering services, may be procured without the use of formal, sealed quotes. I have reviewed the amendment and in accordance with Section 12-16 of the Code, I am hereby recommending the Council approve this amendment. Approved: Mark A. Rohloff City Manager JLG/tlt
