PURPOSE: APPROVE STATE/MUNICIPAL AGREEMENT WITH THE
WISCONSIN DEPARTMENT OF TRANSPORTATION FOR THE
REHABILITATION OF SOUTH WASHBURN STREET FROM
WEST 20TH AVENUE TO DICKINSON AVENUE
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the Wisconsin Department of Transportation (WDOT) requested local
governments to review existing local program project opportunities, and submit
applications for projects to be funded under the federal Bipartisan Infrastructure Law
(BIL) program which is administered through the State of Wisconsin; and
WHEREAS, the City of Oshkosh reviewed potential projects and determined that
the rehabilitation of South Washburn Street from West 20th Avenue to Dickinson Avenue
met the program criteria; and
WHEREAS, the Common Council for the City of Oshkosh amended the City’s 2023
CIP at its meeting on March 22, 2022 which was properly noticed and open to the public
for discussion and comment to allow for the City to apply for the BIL funding for this
project; and
WHEREAS, the Council has received a staff memorandum in relation to this
Resolution committing to the project which has also been made publicly available with
this Resolution on the City’s website, and has had the opportunity to hear from the public
in relation to the acceptance of this funding, and finds that it is advantageous to the City
of Oshkosh to accept this funding for purposes of completing this project to rehabilitate
a portion of South Washburn Street within the City of Oshkosh.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the City hereby accepts funding under the Bipartisan Infrastructure Law
for the rehabilitation of South Washburn Street from West 20th Avenue to Dickinson
Avenue.

BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh that
the State/Municipal Financial Agreement between the City of Oshkosh and the Wisconsin
Department of Transportation outlining the responsibilities for the City and the State of
Wisconsin as they relate to the cost sharing for the Rehabilitation of South Washburn
Street from West 20th Avenue to Dickinson Avenue is hereby approved and the proper
City officials are hereby authorized to execute and deliver the agreement in substantially
the same form as attached hereto, any changes in the execution copy being deemed
approved by their respective signatures, and said City officials are authorized and
directed to take those steps necessary to implement the terms and conditions of the
Agreement.
Money for this purpose is hereby appropriated from:

RE: Approve State/Municipal Agreement with the Wisconsin Department of
Transportation (WDOT) for the Rehabilitation of South Washburn Street
from West 20th Avenue to Dickinson Avenue
BACKGROUND
The federal Bipartisan Infrastructure Law (BIL) was signed into law on November 15,
2021. As a part of the BIL, funding for local infrastructure projects has been greatly
increased. The federal government distributes the BIL funding to the states, which will
manage the funding. The WDOT has requested local governments to review existing
local program project opportunities, and submit applications for projects to be funded
under the BIL program. The federal fiscal year (FFY) 2022 funding included an allocation
of $1,038,177 for the Oshkosh Metropolitan Planning Organization (MPO). The MPO area
consists of the City of Oshkosh, Winnebago County, and the townships surrounding the
City of Oshkosh. The MPO Technical Advisory Committee (TAC) recommended
funding the City of Oshkosh applications for South Washburn Street (West 20th Avenue
to Dickinson Avenue) and Osborn Avenue (approximately 1,600 feet west of Mason
Street to Knapp Street).
ANALYSIS
The BIL funding provides a unique opportunity for local governments to receive
unprecedented funding to improve streets within their jurisdiction. The funding is being
routed through the Surface Transportation Program (STP). In the case of the City of
Oshkosh projects, it is being routed through the STP-Urban program. This program
requires funding to be utilized on streets that are functionally classified as a Collector or
Arterial. This means that “Local” streets are not eligible for funding under this program.
Utilizing the BIL funding provides the City of Oshkosh the ability to resurface some
streets that would otherwise wait several years for a reconstruction project to take place.
This will improve the overall condition of streets within the City of Oshkosh, addressing
an age-old concern within the community, and meeting multiple goals within the City’s
Strategic Plan.

FISCAL IMPACT
The total cost of the pavement rehabilitation of South Washburn Street is estimated to be
$701,180. This cost does not include utility construction costs. Funding for the
State/Municipal agreement will be split between Federal funding ($508,568) and the City
(remaining balance of participating costs and all utility-related costs). The City’s portion
of the Project, including utility costs, will be funded through the South Washburn Street
Asphalt Construction/West 20th Avenue Project in the 2023 Capital Improvement
Program:

RECOMMENDATIONS
I recommend approval of the State/Municipal Agreement.
