The Street, Pauls Place shall continue through the curve, head west to its western terminus eliminating the Joes Place street name. 2. Developer’s Agreement for Pickart Estates Phase II shall be finalized as approved by City staff prior to Common Council Approval; 3. The Declaration of Protective Covenants, Conditions, Easement and Restrictions for Pickart Estates shall be finalized as approved by City staff prior to Common Council Approval; 4. All water, grading and drainage, sanitary sewer, storm sewer, and paving plans shall be approved by the Department of Public Works prior to Common Council Approval; 5. Street lighting plan shall be approved by the Electrical Division prior to Common Council Approval. 1 ITEM: FINAL PLAT FOR THE CREATION OF A 15-LOT SINGLE-FAMILY RESIDENTIAL SUBDIVISION AT THE NORTH 3300 BLOCK OF W. 9TH AVENUE (PICKART ESTATES PHASE II) Plan Commission meeting of April 5, 2022. GENERAL INFORMATION Petitioner/Owner: K&P Development, LLC. Actions Requested: The applicant is requesting approval of a final plat containing 15 single-family lots and street dedications identified as Pickart Estates Phase II. Applicable Ordinance Provisions: Requirements governing platting are located within Article XIII, Subdivisions; Sections 30-441 through 30-446 of the Zoning Ordinance. Property Location and Background Information: The area of this request is part of a single undeveloped 16.31 acre parcel generally located at the north 3300 block of W. 9th Avenue, approximately 350 feet east of Clairville Road. An overall preliminary plat for Pickart Estates containing 60 single-family lots was approved by the Common Council on April 10, 2018 (Res 18-204). The final plat for Pickart Estates Phase I was approved August 15, 2018 (Resolution 18-422) which created 25 single-family lots and right-of-way dedications. Proposed Phase II will create 15 additional lots and right-of-way utilizing 7.05 acres located on the northern side of the parent parcel, west of Phase I. The property is currently undeveloped, being used agriculturally and has a Single-Family Residential - 5 District (SR-5) zoning designation. The general area has a mix of uses including sporadic single-family uses along W. 9th Avenue, agricultural lands to the south, east, west and vacant wetlands to the north. Subject Site Existing Land Use Zoning Undeveloped/Agricultural Single Family Residential-5 (SR-5) Item III – Final Plat - Pickart Estates Phase II – N. 3300 Block of W. 9th Avenue 2 Recognized Neighborhood Organizations None Adjacent Land Use and Zoning Existing Uses Zoning North Agricultural General Agriculture District (A-2, Winnebago County) South Retention Pond Single Family Residential-5 (SR-5) East Single-Family Residential Single Family Residential-5 (SR-5) West Agricultural Single Family Residential-5 (SR-5) Comprehensive Plan Land Use Recommendation Land Use 2040 Land Use Recommendation Light Density Residential ANALYSIS The subject site was formerly part of the Zone C Expansion Area identified in the Cooperative Plan between the City of Oshkosh and Town of Algoma. On February 27, 2018, the property attached to the city as part of the Pickart Voluntary Attachment (Ordinance 18-107) to initiate the process of this proposed residential development. The area was attached with a Single Family Residential – 5 (SR-5) Zoning to permit the proposed residential development. The City’s Comprehensive Land Use Plan 2040 recommends this area suitable for light density residential development; the proposed final plat is consistent with that recommendation. The final plat utilizes 7.05 acres of the remaining 16.31 acres originally planned for Pickart Estates. As shown, the plat will create 15 single- family lots and additional right-of-way dedication. Phase two nearly matches the approved preliminary plat with exception of a few very minor dimensional changes. The proposed lots range in size from 10,887 square feet (0.250 acres) to 26,206 square feet (0.602 acres) with all lots meeting SR-5’s minimum code requirements in regard to width (60 feet minimum), depth (100 feet minimum) and area (7,200 square feet minimum). With the proposed dwelling unit total of 15 units on the 7.05 acre area, Item III – Final Plat - Pickart Estates Phase II – N. 3300 Block of W. 9th Avenue 3 the density for the development is considered very low at approximately 2.1 units per acre (one unit per 20,473 square feet). The Single-Family Residential-5 (SR-5) zoning district has a maximum density requirement of 5 units per acre or one unit per 7,200 square feet when taking right-of-way into account. The final plat’s new right-of-way dedication shows the continuation of Pauls Place from Phase I curving to the north and west until transitioning to an east to west street named Joes Place. A temporary cul-de-sac easement will be provided to construct a vehicle turnaround until the next Phase is implemented. All of the proposed street dedications are 60 feet wide, meeting the code requirement for local residential streets. The proposed street names have been submitted and approved by Winnebago County. For addressing, Pauls Place follows the north-south address grid numbering system (500 through 800 Block). As proposed, Joes place should follow the east-west grid numbering system (3400 Block). During review, the Oshkosh Fire Department (OFD) raised concern that due to the broad, gradual curve of Pauls Place & Joes Place, one may not know when one street ends and the other begins, potentially causing confusion. OFD is recommending that Pauls place continue through the curve to the western end of Phase II. 300 and 400 Block Pauls Place addresses will be used for this segment. Per the preliminary plat, the street makes a more distinct 90° turn to the south becoming Jasons Place which connects to W. 9th Avenue. City Police and Fire Departments have reviewed the final plat and have not indicated any problems other than the recommended continuation of Pauls Place/removing Joes Place. Both departments do not anticipate problems servicing the proposed development. The Oshkosh Area School District has been notified of the proposed subdivision and has not responded with concerns about being able to accommodate the additional population. Engineering & Storm Water The Department of Public Works has reviewed availability of city utilities to serve the development and reported that city water and sanitary is available from Phase I of the development. City staff has been working with the applicant to prepare a Developer’s Agreement with the City for construction of utilities and street construction. The agreement is nearing completion and must be finalized prior to being approved by the Common Council. Water, grading and drainage, sanitary sewer, paving and storm water plans have been submitted for Phase II. The developer has been working with the Department of Public Works on finalizing the designs based on the city’s code regulations. Approved plans will be required prior to Common Council approval. The final plat does show all required easements for public facilities. A Declaration of Protective Covenants, Conditions, Easement and Restrictions for Pickart Estates Subdivision has been submitted. The city does not enforce protective covenants but are reviewed to ensure they are not less restrictive than the City of Oshkosh’s Municipal Code. City staff is Item III – Final Plat - Pickart Estates Phase II – N. 3300 Block of W. 9th Avenue 4 working with the developer to finalize the language for any required easements and must be completed prior to Common Council approval. Parkland Dedication Dedicated parkland was included within the preliminary plat and dedicated in Phase I. Parkland dedication requirements for the whole development equates to 66,000 square feet of area (1,100 square feet per lot). The Parks Department recommended dedication of land versus fees in-lieu- of as there is a lack of city parkland/recreational areas in this part of the city. Parks Department staff worked with the developer to determine the location for the park which was platted as Outlot 4 near the center of the subdivision. Outlot 4 is sized at 66,000 square feet which meets the minimum dedication requirement. Street Lighting/Terrace Tree Plans The final plat’s street lighting plan has been reviewed by the Electrical Division. Minor revisions will be required prior to Common Council Approval. A terrace tree plan has been submitted and the locations meet the Subdivision Regulations. The plan shows 31 total trees including 11 Autumn Blaze Maples, 10 Redmond Lindens and 10 Skyline Honey locusts. This meets the Subdivision Regulation requirement of a minimum of one tree per lot. There is a note on the plan that states final street terrace tree planting species and locations to be determined by the City Forester so the plan can be adjusted prior to planting. RECOMMENDATIONS/CONDITIONS Staff recommends approval of the 15-lot Pickart Estates Phase II final plat with the following conditions: 1. Developer’s Agreement for Pickart Estates Phase I shall be finalized as approved by City staff prior to Common Council Approval; 3. Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. Mr. Nau said that is correct. Mr. Perry asked for any public comments and asked if the applicant wanted to make any statements. Ben Warntjes, from Excel Engineering; 100 Camelot Ct, Fond du Lac, made himself available for any questions from staff. Shawn Christian, 601 Paul’s Place, asked if the retention pond is going to be increased before phase II starts. Mr. Warntjes said that it would be concurrently with phase II. There were no other public comments on this item. There were no public comments on this item. Mr. Perry closed public comments and asked if the applicant wanted to make any closing statements. Item III – Final Plat - Pickart Estates Phase II – N. 3300 Block of W. 9th Avenue 6 Mr. Warntjes said the pond will be expanded in phase II and storm water management will be fully accounted for. The pond discharge currently goes up to the northeast and it will be shifting to the northwest. There were no closing statements from the applicant. Motion by Ford to adopt the findings and recommendation as stated in the staff report. Seconded by Marshall. Mr. Perry asked if there was any discussion on the motion.
