HomeMy WebLinkAbout21. 22-175APRIL 26, 2022 22-175 RESOLUTION (CARRIED __7-0____ LOST _______ LAID OVER ________ WITHDRAWN _______) PURPOSE: REMOVE RENTAL HOUSING ADVISORY BOARD MEMBER INITIATED BY: MAYOR PALMERI WHEREAS, Lydia Christensen was appointed to the Rental Housing Advisory Board on June 1, 2021 for a term expiring on May 31, 2023; and WHEREAS, Ms. Christensen has not attended any Rental Housing Advisory Board meetings and has generally not contacted board members or staff, despite numerous attempts to contact Ms. Christensen. NOW, THEREFORE, BE IT RESOLVED by the Common Council that Lydia Christensen is hereby removed from the Rental Housing Advisory Board. City Hall, 215 Church Avenuenue P.O. Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Kelly Nieforth, Community Development Director DATE: April 21, 2022 RE: Remove Rental Housing Advisory Board Member BACKGROUND Lydia Christensen was appointed to the Rental Housing Advisory Board in June 2021 for a term expiring on May 31, 2023. She has not attended any RHAB meetings and typically does not respond back to staff email or correspondences. ANALYSIS Vacancies and removal of Board and Commission members are governed by Wisconsin Statutes. Section 17.03 of the Wisconsin Statutes provides that vacancies are caused by death, resignation, removal, or non-residency when residency is a requirement. Section 17.12 of the Wisconsin Statutes provides a method for the removal of an appointed City official, such as a Board member, by the Common Council. In this case, because the appointment is made by the Council upon recommendation of the Mayor, the Council may remove the person with or without cause. Cause is defined by the Statutes as inefficiency, neglect of duty, official misconduct, or malfeasances in office. Because of Ms. Christensen’s repeated failure to either attend meetings or notify the appropriate staff and/or Board members of her status and her failure to respond to inquiries regarding service on the Rental Housing Advisory Board, this behavior qualifies as neglect of duty which removal is warranted. FISCAL IMPACT There is no fiscal impact to this resolution. RECOMMENDATION I request that the Common Council remove Lydia Christensen from the Rental Housing Advisory Board.
