HomeMy WebLinkAbout10. 22-141APRIL 12, 2022 22-141 RESOLUTION (CARRIED___7-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVE COOPERATIVE PURCHASE OF TWO BACKHOE/LOADERS FROM BROOKS TRACTOR FOR STREETS DIVISION AND WATER DISTRIBUTION DIVISION ($297,295.29) INITIATED BY: PURCHASING DIVISION WHEREAS, it is necessary to replace the backhoe/loader unit for both the Street Division and the Water Distribution Division; and WHEREAS, by participating through the State of Wisconsin Sourcewell Cooperative Purchase program, staff was able to obtain a more competitive price for replacement of the backhoe/loader units; and WHEREAS, section 12-15 of the City of Oshkosh Municipal Code provides that purchases may be done without the use of formal sealed quotations or bids pursuant to a contract with any other local, state or federal governmental unit or agency; and WHEREAS, Brooks Tractor Incorporated holds the Sourcewell cooperative contract (#032119-JDC) for John Deere Heavy Construction Equipment. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed pursuant to Section 12-15 of the Oshkosh Municipal Code to purchase the above mentioned vehicles from: BROOKS TRACTOR INCORPORATED 1031 Lawrence Drive De Pere, WI, 54115 Total: $297,295.29 APRIL 12, 2022 22-141 RESOLUTION CONT’D BE IT FURTHER RESOLVED that the proper City officials are hereby authorized and directed to enter into an appropriate agreement for the purpose of same. Urben, General Services Manager DATE: April 5, 2022 RE: Approve Cooperative Purchase of Two Backhoe/Loaders from Brooks Tractor for Streets Division and Water Distribution Division ($297,295.29) BACKGROUND The Common Council allocated $330,000 in the 2022 CIP to purchase a backhoe/loader unit for both the Street Division and the Water Distribution Division. The Streets Division unit is a 2004 John Deere backhoe with 3,005 hours and ongoing mechanical issues with its outriggers and hydraulic system. The Water Distribution unit is a 2008 John Deere 4WD backhoe with 8,602 hours and recent hydraulic and torque hub leaks. The two new units will include the backhoe/loader, dipper stick coupler and bucket(s). ANALYSIS Purchasing has confirmed that Brooks Tractor Incorporated holds the Sourcewell cooperative contract (#032119-JDC) for John Deere Heavy Construction Equipment. Purchasing has confirmed this purchase is pursuant to the cooperative purchase exception of our purchasing ordinance and that the contract pricing will save 21% from list price (approximately $32,000 per unit). The table below lists the two units being procured, the amount allocated for each vehicle in the 2022 CIP, cooperative contract pricing with trade-in and the account numbers to be charged. For Unit 1 the 2004 trade-in received a credit of $33,000. For Unit 2 the 2008 trade- in received a credit of $30,000. *Backhoe/Loader price + attachments – trade in credit. With trade-in the total fiscal impact of this purchase is $297,295.29. See table above for account numbers to be charged. RECOMMENDATION Section 12-15 of the Municipal Code provides that subject to approval of the City Manager, cooperative purchases pursuant to a contract with any other local, state or federal governmental unit or agency may be made without following a competitive bidding or quotation process. In accordance with Section 12-15 of the Municipal Code and with approval by the City Manager, Purchasing recommends the Common Council award this purchase to Brooks Tractor Incorporated, 1031 Lawrence Drive, De Pere, WI, 54115 for $297,295.29.
