ITEM II: APPROVE LAND ACQUISITION AND DETERMINE NECESSITY TO
ACQUIRE FOR RURAL II BASIN FOR SAWYER CREEK WATERSHED
GENERALLY LOCATED AT THE WEST 2700 BLOCK OF CLAIRVILLE RD
GENERAL INFORMATION
Applicant: City of Oshkosh-Department of Public Works
Property Owners: Kay E. Spanbauer, Angela Suhail, Carol Neubauer, and Kenric Klemz
Action(s) Requested:
The City of Oshkosh Department of Public Works is requesting approval to acquire
approximately 59.13 acres of vacant land west of the 2700 Block of Clairville Road in the Town of
Algoma. The property will be utilized to improve storm water management within the Sawyer
Creek Watershed.
On July 28, 2015 the Common Council approved official mapping of the subject site (Ordinance
15-361) to reserve the land for eventual acquisition by the City.

Property Location and Background Information:
The subject 59.13 acre area is large,
approximately 1,320 feet wide and 2,000
deep with a 60-footwide by 635-foot deep
strip connecting to Clairville Road. The
acquisition will take one entire land-locked
lot and part of two existing lots fronting on
Clairville Road. The land is currently is
currently undeveloped and mostly being
used agriculturally. The surrounding area
is predominantly agricultural with
exception of some low density single-family uses along Clairville Road. The 2040 Comprehensive
plan identifies the area suitable for light density residential development.
The subject site is part of the Zone D Expansion Area identified in the Cooperative Plan between
the City of Oshkosh and Town of Algoma. If the acquisition is approved and land sale finalized,
it is anticipated the land will attach (annex) to the City shortly thereafter.

ANALYSIS
The City hired a consultant to
prepare a regional storm water
management plan for the Sawyer
Creek Watershed. The plan
recommended the construction of
large basins on the outskirts of the
city to mitigate downstream
flooding from Sawyer Creek. The
first of these basins, located north
of James Road one mile of the City
limits was constructed in 2012. The
plan called for a second basin
located at this subject site. The
City officially mapped the area to
preserve the land and ensure
inadvertent development would

not take place until funding was available for acquisition. The second basin will also assist in
lowering the FEMA Floodplain elevation of Sawyer Creek in various parts throughout the City.
The Engineering Division is in the early stages of updating the city-wide Storm Water
Management Plan. Construction of this basin will aid in the development of the plan and help
determine future storm water mitigation needs in the area.
Staff is of the opinion that the intended use of the property is not in conflict with the light density
residential land use recommendation from the Comprehensive Plan. Storm water management
facilities such as the one being proposed at this site is not unlike infrastructure needed for the
development of new residential subdivisions.
This approval is the first step for the City to acquire this property. The City is required to follow
the acquisition process as required by state statute.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the proposed property acquisition located at the west 2700 Block of
Clairville Road as requested.
