PURPOSE: AMEND 2023 CAPITAL IMPROVEMENTS PROGRAM
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, The Wisconsin Department of Transportation (WisDOT) has
requested local governments to review existing local program project opportunities, and
submit applications for projects to be funded under the Bipartisan Infrastructure Law
(BIL) program; and
WHEREAS, the Department of Public Works plans to submit three (3) Projects for
FFY 2022 funding consideration that are not already a part of the Capital Improvements
Program (CIP) Plan; and
WHEREAS, the only reason these projects were not previously included in the CIP
is due to the funding balance for projects; and
WHEREAS, amending the 2023 CIP to include these projects will show the State
of Wisconsin that the City of Oshkosh is serious about completing these projects.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the 2023 Capital Improvement Program, on file in the City Clerk's Office, is
hereby amended to include South Washburn Street (from Dickinson Avenue to West 20th
Avenue), South Washburn Street (from West Waukau Avenue to S.T.H. 26), and Osborn
Avenue (from approximately 1,540’ east of South Koeller Street to Knapp Street) as shown
in attached Exhibits.

RE: Amend 2023 Capital Improvements Program
BACKGROUND
The federal Bipartisan Infrastructure Law (BIL) was signed into law on November 15,
2021. As a part of the BIL, funding for local infrastructure projects has been greatly
increased. The federal government will distribute the BIL funding to the states, which
will manage the funding. The Wisconsin Department of Transportation (WisDOT) has
requested local governments to review existing local program project opportunities, and
submit applications for projects to be funded under the BIL program. The federal
government recently adopted the federal fiscal year (FFY) 2022 budget, which includes
appropriations for the BIL. While the federal budget was just approved, the exact amount
of funding available to the State of Wisconsin and local municipalities in the State of
Wisconsin is still unknown. The application deadline for FFY 2022 project funding is
April 1, 2022. Plans, Specifications, and Estimates must be completed and have projects
ready to send out for bids by August 1, 2022. The State of Wisconsin anticipates that these
projects will have bid openings no later than November 2022.
The Department of Public Works plans to submit three (3) Projects for FFY 2022 funding
consideration that are not already a part of the Capital Improvements Program (CIP)
Plan: South Washburn Street (from Dickinson Avenue to West 20th Avenue), South
Washburn Street (from West Waukau Avenue to S.T.H. 26), and Osborn Avenue (from
approximately 1,540’ east of South Koeller Street to Knapp Street). A fourth street project,
South Koeller Street from West 7th Avenue to approximately 1,000’ north of West 7th
Avenue, will also be submitted. The South Koeller Street project is already a part of the
2022 CIP under the Annual Concrete Pavement Repairs project.
ANALYSIS
Amending the 2023 CIP to include these projects will show the State of Wisconsin that
the City of Oshkosh is serious about completing these projects. With bid openings likely
scheduled for November 2022, it is currently anticipated that construction would not start
until 2023.

The only reason these projects were not previously included in the CIP is due to the
funding balance for projects. Typically, an asphalt overlay project would be included in
the CIP, but due to funding considerations, one was not included in the 2023 CIP. With
the influx of money from the BIL, it is possible for the City of Oshkosh to complete some
projects through the State of Wisconsin.
The choice of streets is very limited for this funding. The funding program requires all
streets to be functionally classified as “Collector” or “Arterial”. This means the majority
of our streets are not eligible as they are classified as “Local” streets.
FISCAL IMPACT
There is no fiscal impact to passing this resolution; however, projects that receive funding
will be funded with 80% state/federal dollars and 20% local dollars. This cost share allows
the City of Oshkosh to complete some much needed projects utilizing a significant
amount of state/federal dollars, thus stretching our local dollars further.
RECOMMENDATIONS
I am hereby recommending that the Common Council amend the 2023 Capital
Improvements Program.
