PURPOSE: APPROVE AMENDMENT NO. 1 TO PROFESSIONAL SERVICES
AGREEMENT WITH STRAND ASSOCIATES, INC. FOR
CONSTRUCTION-RELATED SERVICES FOR WITZEL AVENUE
UTILITY AND PEDESTRIAN IMPROVEMENTS ($105,000.00)
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the City and Strand Associates, Inc. previously entered into an
agreement in which Strand Associates, Inc. would provide the City with professional
services related to engineering design services for Witzel Avenue utility and pedestrian
improvements; and
WHEREAS, staff has requested a proposal from Strand Associates, Inc. to now
provide construction-related engineering services related to this project.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed to enter into and take
those steps necessary to implement an appropriate amended professional services
agreement with Strand Associates, Inc. for additional construction-related engineering
services in the amount of one hundred five thousand dollars. ($105,000.00).

RE: Approve Amendment No. 1 to Professional Services Agreement with
Strand Associates, Inc. (Strand) for Construction-Related Services for
Witzel Avenue Utility and Pedestrian Improvements ($105,000)
BACKGROUND
A professional services agreement with Strand for providing assistance with
engineering design services for the Witzel Avenue utility and pedestrian improvements
was reported to the Common Council (Council) on February 8, 2022. These services
included topographic surveying; preparing final drawings; preparing restoration and
erosion control drawings; preparing construction traffic control plan; preparing for,
attending, and documenting progress and utility meetings; preparing Wisconsin
Department of Natural Resources (WDNR) water main and sanitary sewer extension
permits; preparing WDNR Notice of Intent for land disturbance; and preparing final
technical specifications and estimated quantities for the City’s use in preparing a final
construction document package for bidding.
ANALYSIS
Staff has requested a proposal from Strand to provide construction-related engineering
services. These services will include providing contract administration services,
providing resident project representative services for up to thirteen (13) weeks of full-
time observation of construction, and providing record drawings in electronic format
from information compiled from the City’s Contractor’s records.
FISCAL IMPACT
Staff has reviewed the amendment and the costs. The amount of this amendment is
time and materials not to exceed $105,000. This will raise the total agreement amount to
$180,000. The cost of these services will be funded through Sanitary Sewer CIP projects
which have come in under budget and will be charged to Account 03210410-6802-
04213/Contract Control-Sanitary Sewer-Witzel Ave Sanitary Sewer Const.

RECOMMENDATIONS
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional
services of a specialized nature, including engineering services, may be procured
without the use of formal, sealed quotes. I have reviewed the proposal and in
accordance with Section 12-16 of the Code, I am hereby recommending the Council approve
this amendment.
