PURPOSE: APPROVE AGREEMENT WITH OSHKOSH FIRE DEPARTMENT
CHIEF OFFICERS FOR YEARS 2021, 2022 & 2023
INITIATED BY: ADMINISTRATIVE SERVICES DEPARTMENT
WHEREAS, the City of Oshkosh and the Oshkosh Fire Department Chief Officers
previously negotiated a Working Conditions Agreement for calendar years 2018-2020;
and
WHEREAS, the parties reached a tentative agreement for certain changes to the
labor contract for years 2021, 2022 & 2023; and
WHEREAS, the Oshkosh Fire Department Chief Officers have ratified these
changes and it is appropriate for the Common Council to approve this agreement.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the attached changes to the current labor agreement with the Oshkosh Fire
Department Chief Officers are approved and the proper City officials are authorized and
directed to enter into an appropriate agreement for these purposes, the execution copy
being deemed approved by their respective signatures, and said City officials are further
authorized and directed to take those steps necessary to implement the terms and
conditions of the labor contract.

RE: Approve Agreement with Oshkosh Fire Department Chief Officers for years
2021-2023
The City has reached a tentative agreement with the Oshkosh Fire Department Chief
Officers.
This agreement has been approved by the membership of the group for the contract years
of 2021, 2022 & 2023. A brief synopsis of agreement elements include:
1. The following across the board wage increase for each respective year:
2.5% in 2021, 2.25% in 2022, and 2.5% in 2023.
2. Maintained health insurance caps
3. Updated contractual language including: added recognition clause at the beginning
of the agreement and eliminated the present benefits language; reassigned 8 hours
of vacation time to combination holiday time; changed the uniform allowance to a
commissary; and other contractual language.
Included in this packet is the conceptual tentative agreement as well as the fiscal impact
for 2021 associated with the agreement. Please let me know if you have any questions,

TENTATIVE AGREEMENT
THE CITY OF OSHKOSH
to
OSHKOSH FIRE DEPARTMENT CHIEF OFFICERS
December 7, 2021
1. Add to beginning of agreement:
The City of Oshkosh recognizes the Oshkosh Fire Department Chief Officer
Association as the exclusive meet and confer agent for the purposes of
negotiating wages, hours, and conditions of employment pursuant to Wis. Stat. §
111.70(8)(b).
2. Article I -Work week
Replace Article I with:
Chief Officers are management personnel and are charged with the
responsibility of controlling and directing subordinate personnel in executing
their specified assignments.
Chief Officers designated as Battalion Chiefs are assigned to shift supervision
and/or a battalion and Chief Officers designated as Division Chiefs are assigned
to supervise a division and/or specific functional area.
Assignments for Chief Officers will be at the discretion of the Fire Chief, or
designee, based on the needs of the organization.
Shift Coverage:
At the discretion of the Fire Chief, or designee, in the event a vacancy occurs
with a Battalion Chiefs’ assignment for a shift due to a non-scheduled absence
with less than twenty-four (24) hours’ notice to the Fire Chief, or designee, an
hourly wage (hours worked x hourly rate based on a 52 hour workweek) will be
paid for hours worked to the Chief Officer filling the vacancy. Chief Officers
may split the shift as approved by the Fire Chief, or designee. A seniority/hours-
driven roster will be used to fill the position. The hours will be reset on January
1 of each year.
3. Article III – Medical Benefits Plan and Life Insurance
Keep 2020 contribution caps
Modify Health Insurance Employee Contributions section to read as:
A. Employee contributions for PPO with HRA:
Effective January 1, 2021, employees will contribute up to 12% up to a maximum
of $153.98 per month towards single; $288.77 per month towards dual and $356.14
per month toward the family premium equivalents.
B. Employee contributions for PPO without HRA:
Effective January 1, 2021, employees will contribute up to 15% up to a maximum
of $192.48 per month towards single; $360.96 per month towards dual and $445.18
per month toward the family premium equivalents.
Note: Health insurance premium contributions are actually made one month prior
to the effective dates shown.
4. Article V – Vacation
Modify vacation table – eliminate the 25 Years level effective 2022 – see related
holiday proposal
5. Article VI – Sick Leave
In the paragraph 1st on page 8 – modify sentence two (2) to read:
For calculation of the payment due Chief Officers, the accumulated unused sick
leave shall be converted to reflect the same accumulation as if accrued under the
52 hour per week schedule.
6. Article VII – Emergency Leave
Modify article to say:
Funeral Leave
In the case of death in the immediate family of a regular employee (parents,
children, spouse, father-in-law, mother-in-law, brother, sister, brother-in-law,
sister-in-law, step-child, step-parents, grandchildren, grandparents, son-in-law,
daughter-in-law, half-brother, half-sister or guardian) the employee will be paid
for the scheduled time lost from the day of death up to and including the calendar
day after the funeral, not to exceed three (3) scheduled work days for 40 hour
employees (two days for other employees) at their regular straight time, hourly
rate. No funeral leave will be paid to any employee while on sick leave or any
leave of absence. In the event the employee is called off from duty because of
death of an above relative, that duty day shall not be counted as part of this
provision.
7. Article VIII – Holiday Leave
Modify to:
All Chief Officers shall receive in lieu of paid leave or premium pay for working
any holiday, an annual payment of 168 hours at the 52 hour hourly rate. Equal
payments shall be made on a bi-monthly basis beginning with the second pay
period in January. Effective in 2022, after 25 years of service, Chief Officers shall
receive an additional eight (8) hours of combination holiday leave. If combination
holiday cannot be scheduled due to staffing constraints, it shall be paid out on the
2nd check in November. Upon separation, the hours accrued for payment shall be
prorated from January 1 of the current year.
8. Article XII – Present Benefits
Delete article and renumber appropriately
9. Article XV – Uniform Allowance
Modify to:
Uniforms
Effective 1/1/2022, the City shall provide all required clothing and operate a
clothing commissary as well as a maintenance allowance of $65.00 per year
payable in January. In the event an employee has worked less than 12 months in
the prior calendar year, the amount shall be prorated.
10. Schedule A - Wages
Effective at the beginning of each year’s pay period that includes the date
January 1.
a. 2021: 2.50%
b. 2022: 2.25%
c. 2023: 2.50%
11. Clean up language – as agreed to by both parties prior to ratification and
approval, more to be added:
a. Article III – Dental Insurance – Delete “Effective 2019:”
b. Article VI – Sick Leave
i. paragraph 3, change “A Chief Officer” to “Chief Officers”, and
delete bullet (e),
ii. paragraph 4, delete 2nd sentence – Delete “However, no leave shall
be granted under this subsection if the spouse of the employee is
employed and continues to work during the absence of the
employee.”
iii. paragraph 7, add “or designee”, after Director of Administrative
Services
c. Article XIV – Pension – Delete paragraph 1 and 2. Delete in paragraph 3:
“Effective the first full pay period in January of 2013,”
d. Gender neutral references to staff
e. Where Fire Chief approval is referenced, add “or Designee”
