HomeMy WebLinkAboutSecond Addendum to the COVID-19 CORONAVIRUS Fire Service Mutual Aid Pact A RECEIVED °`' S`r�k`' OCT U 7 2021 CITY CLERK'S OFFICE SECOND ADDENDUM TO THE COVID-19 CORONAVIRUS FIRE SERVICE MUTUAL AID PACT THIS SECOND ADDENDUM ("Second Addendum") shall serve as an understanding and agreement to extend the existing COVID-19 Coronavirus Fire Service Mutual Aid Pact originally entered on March 27, 2020 ("Pact") and extended by Addendum ("Addendum") through December 31, 2021, between the following municipalities (jointly referred to as "Members") located within Winnebago County and/or adjacent to Winnebago County that provide fire protection: City of Oshkosh, City of Kaukauna, Town of Grand Chute, City of Appleton, Neenah-Menasha Fire Rescue, and Village of Fox Crossing. WHEREAS, the Members entered into the Pact on March 27, 2020 and extended the Pact through December 31, 2021. The parties again desire to extend the Pact to December 31, 2023 as the effects of COVID-19 have continued to impact staffing availability as well as calls for service. NOW THEREFORE, the Members hereby incorporate the previous statements and 1 mutually agree to the following: 1. The Pact shall terminate on December 31, 2023 unless further modified in writing by all Members. 2. This Addendum is not intended to modify, amend or in any way change any other terms of the Pact other than as set forth herein. 3. The Pact is attached as Exhibit A. The Addendum is attached as Exhibit B. 4. Revision or modification to this Second Addendum must be agreed to by the parties and signed by the authorized representative of each party. Reliance on mutual aid under this agreement when resources may be depleted due to the current Emergency is intended to supplement existing mutual aid agreements pertaining to firefighting and first responder capabilities and is not intended to be a substitute for maintenance of an adequate level of firefighting capability and/or first responder care. This agreement is entered into by and between the following municipalities located within Winnebago County and/or adjacent to Winnebago County that provide fire protection: City of Oshkosh, City of Kaukauna, Town of Grand Chute, City of Appleton, Neenah-Menasha Fire Rescue, and Village of Fox Crossing. This agreement shall be binding upon each of the parties and is entered into pursuant to §323.15(4) Wis. Stats. Heads of Emergency Management; Duties and Powers; Powers During an Emergency. This agreement shall become effective on the date executed; a copy hereof shall be filed in the office of the municipal clerks of the respective parties. OPERATION: Each member municipality hereby authorizes their Fire Chief to request and afford mutual aid from and to other pact members when properly requested. In the absence of the Fire Chief, departmental personnel are authorized to act employing the appropriate chain of command. RULES AND REGULATIONS for the technical operation of this pact shall be as follows and shall be adhered to by member Fire Departments and First Responder groups under the direction of their Fire Chiefs. A. Nothing contained herein shall in any way require a pact member to, at any time, materially impair the service necessary for the protection of their individual municipalities. (Right of Refusal) B. The Fire Chiefs from the participating Departments shall select one of their members to act as the Regional Coordinator for purposes of requests under this Agreement. The designation of Regional Coordinator may change or the Chiefs may designate deputy or • alternate Coordinators during the period of Emergency as necessary to provide for continuity of operations. C. Each member Fire Department shall provide, and update as reasonably necessary, the following information: 1. names of chief officers 2. business numbers of the departments, if available 3. a copy of the department personnel roster showing the chain-of- command 4. a list of personnel with special skills or certifications 5. a list of any or all equipment available for mutual aid 6. maps of the community D. Fire Departments subject to shortages of personnel and/or equipment during the Emergency period may make a request through the Regional • Coordinator. The municipality requesting mutual aid should be specific as to what equipment and personnel are required and the estimated time period to be covered by the request. E. The Regional Coordinator shall review all requests and available resources and facilitate the fair and equitable distribution of resources to each participating municipality under this Agreement. F. Aiding departments shall respond in official Fire Department dress and vehicles unless specifically authorized by both their own and the requesting department to respond in casual attire and/or with personal vehicles. Directions to the appropriate facility shall be provided by the aided department. G. Each department shall maintain full charge of daily operations for that department. H. The Fire Chiefs of the various signatories are hereby authorized to further enact the details of this pact for efficient day-to-day operation. Liability: In accordance with Wisconsin State Statutes § 323.41, for purposes of Wisconsin State Statutes §§ 895.35 and 895.46, personnel acting in response to a request for assistance shall remain employees of the department which they are employed by and covered by their department for all liability purposes. In accordance with Wisconsin State Statutes §323.40, if a member of a responding department is injured or killed while responding to, acting at, or returning from an incident covered under this agreement, the department of which they are a member, or the municipality by which they are employed shall grant them the same 2 compensation and insurance benefits that it would provide if the incident occurred in the department's jurisdiction. All wage and disability payments, pension and worker's compensation claims, damage to equipment and clothing, and medical expense shall be paid by the municipality regularly employing the employee. For all other purposes, each municipality shall be legally responsible for their own personnel. No Signatory shall be held liable to another signatory for damages, loss of equipment, injury to personnel or payment of compensation arising as a result of assistance rendered under the terms of this agreement. All parties shall exercise due diligence in returning lost or forgotten equipment or material to the rightful owner. All parties shall procure their own respective commercial insurance policies satisfactory to insure for liability of the actions of their own employees that may arise as a result of a mutual aid response. Good Afternoon, The City of Appleton reissued a mask wearing mandate in city building effective Aug 5th. Our current Fire Service Mutual Aid Pact expires on December 31, 2021. As the number of COVID cases increases in our area, I wanted to reach out and see if we as a group wanted to meet again in the future?
