HomeMy WebLinkAboutFarm Lease - Northwest Industrial Park 1-} IQ3 v 01 RECEIVED Oshkosh OCT 25 2021 October 4, 2021 CITY CLERK'S C F:C7- Mr. Robert Walter 3630 Walter Street Oshkosh, WI 54901 RE: Farm Lease—Northwest Industrial Park Dear Mr.Walter: This letter is to confirm the lease agreement for an estimated 78 acres (more or less) of four sections of farm land in the City of Oshkosh's Northwest Industrial Park area within Parcel numbers 018005101, 018005301, 0180153&0180152 at$132 per acre from the signing for this agreement thru October 31,2023. The lease property shall solely be used for agricultural purposes. Lessee shall not allow recreation activities on the leased property. Recreation activities includes, without limitation, hunting, snowmobiling, motorcycling, or ATV's. Lessee has inspected properties and leases them as is. Lessee cannot sublease or assign its interests in the leased property. Permitted crops include low-level type plantings (i.e. soybeans, alfalfa, grass, etc.). Corn is permitted under this current agreement. 2o2- Ab,'t___ Payment for the year of farming must be sent by October 31,2-erg,payable to the City of Oshkosh,mailed to P.O. Box 1130, Oshkosh, WI 54903-1130. Payment amount for the year will be determined by farmed acreage as verified by United Co-op of Pickett and submitted with payment. As agreed, you will lease the land for the term from the date this agreement is fully signed until October 31, 2023. Should the City of Oshkosh need to access any of the land on these parcels before October 31, 2023, the lessee will be compensated for any crops that are planted on this parcel at a rate of $200 per acre. The City of Oshkosh will not be held liable for any damage incurred to crops on this parcel that are not removed from the leased property annually by October 31. Lessee shall not alter the leased property and agrees to remove all personal property, fixtures, and/or crops by the end of the lease. Lessee affirmatively agrees that any personal property, fixtures or crops remaining on the leased property at the termination of the lease should be considered to have no appreciable value. As part of this lease agreement, lessee will protect/hold harmless the City of Oshkosh against any incidents, actions, claims or demands of any kind or character related to the leased property arising during the term of the lease. Lessee further agrees to fully indemnify and refund to the City within 30 days of written demand all such sums the City may be obligated to pay on such actions, claims or demands.
