PURPOSE: ESTABLISH PERMIT FEES FOR WORK IN RIGHT-OF-WAY
PERMITS
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the Council has approved creation of a Right-of-Way Permit Civil
Engineering Technician position to be funded by Right-of-Way permit fees; and
WHEREAS, it is therefore necessary to revise the current fee schedule to include
fees related to Right-of-Way permits for this purpose.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the fee schedule for the City of Oshkosh is hereby amended to include the
following:
Public Works / Engineering
Right-of-Way Permit Fees
Base fee: $15.00
Cost per foot: $0.75
Cost per structure: $25.00
BE IT FURTHER RESOLVED that the fees established by this Resolution shall be
effective upon passage and for permits issued on and after January 1, 2022.

RE: Establish Permit Fees for Work in the Right-of-Way
BACKGROUND
The Right-of-Way (ROW) Permit process is necessary to ensure that the requirements of the City
of Oshkosh are met, and the City’s infrastructure is protected during construction-related
activities of other entities.
The ROW Permitting process involves many steps, including: reviewing and processing license
applications and required bonds, communicating with potential applicants regarding the process
and what information is necessary on applications, receiving permit applications, reviewing
applications, communication with applicants regarding information they may be missing in their
applications, issuing permits, reviewing site conditions during construction, inspecting work
prior to surface restoration, and conducting post-construction inspections and warranty follow-
ups.
Previously, the review of ROW Permit applications was currently handled by a Civil Engineer in
the Engineering Division of the Department of Public Works. This position is also responsible
for the review of private development site plans to ensure compliance with City of Oshkosh
requirements and the design of Sanitary Sewer and Water Main construction projects managed
by the Engineering Division. This Civil Engineer position is funded by the Water, Sanitary, and
Storm Water Utilities. The workload on this one position is excessive, and has been for many
years.
Also, the ROW Permit inspections prior to surface restoration were previously performed by
Street Division Supervisors, when they are able to. The inspections post-construction and for
warranty follow-ups were handled by Engineering Division staff. These inspections were
coordinated by the Civil Engineer responsible for the permit reviews, but were often conducted
by summer intern staff.
During the review of the 2022 Operating Budget, Council approved the creation of a Right-of-
Way Permit Civil Engineering Technician position, provided that this position be funded by
Right-of-Way Permit fees.

ANALYSIS
Municipal Code Section 25-16 allows the Common Council to establish fees for the issuance of
Right-of-Way Permits. After a thorough review of all of the 2019 and 2020 permits, Staff
recommends the following permit fee structure:
Base fee: $15.00
Cost per foot: $0.75

FISCAL IMPACT
The revenue will be used to offset the cost for the added position.
RECOMMENDATIONS
I recommend establishing the above permit fees for Work in the Right-of-Way Permits.
