John Kasper,President, Oshkosh Chamber of Commerce, fonvarded a copy of the correspondence you
sent him regazding code concems with your pybn sign. Having reseazched this issue I find there aze a
couple issues where you may be under[he wrong impression.
In your lettcr,you state that[he first Corzection Nolice you received regazding code violations with this
sign was on February 2, 2003. Resea�ching the file, I have discoveced that the first notice was actually
sent on September 17, 2002 and this most recent notice was sent as a follow up to this first�otice as the
inspector had not heard from you or the elec[rician regarding compliance with the first notice.
Discussing this with the inspector, 1 have learned he also discussed these code concerns with you in a
phone conversa[ion the aftemoon of September 6, 2002.
I also believe you may be under[he wrong understanding of what remains[o be wlrected (or reinspected
for complianceJ You sta[e in your letter that the inspector was requiring you[o install a sepazate
electrical line to your portion of the sigu(per a September 2002,phone eonversation.) Having discussed
� this with the inspector, [his issue while discussed,was not included in the Correction Notiee sent on
September 17,2002. This is indeed an issue that could be subject to in[elpretations and having been
advised of your business agreement with WG&R,the inspec[or did not feel it was worth pursuing this
issue. Specifically, section NEC 240-24(b) requires each occupant[o have ready access to all over
ewrent protection(eircuit breakers)supplying power to that occupancy. The intent of this eode is to
allow separate tenants/businesses/occupants ready access to all their circuit breakers For safety pueposes.
While the situation you have is not ideal and could be problematic in the event power needed to be
disconnected,it becomes an intetpretation as to what is meant by"occupancy" and whether you truly
have "ready access" [o[he over current pmtection for your sign. As a result, the inspector did not include
this issue in the Correction Notice.
What remains to be verified for code compliance aze the following issues:
1. NEC 225-30- The pylon sign must be served by one branch circuit from the building supplying the
power. Meaning, ihe power being supplied by WG&R must be done with one circuit There cannot
be two electric circuits runniug from Ihe building to the pylon siga This is a safety issue iutended to
protect service personnel from believing they have disconnected power[o the sign without realizing
ihere is more than one power supply(the same principle as your building not being allowed ro have
more than one source of powerJ A[this time it is uncleaz whe[her there is one or two circuits
supplying power to this sign. In a past couversation with the electriciaq the inspector was infortned
a new circuit was pulled to supply power to this sign, thus the reason this item was included on the
Correction Notice. Possibty the convecsation was misinterp�eted. We aze contacting the elechician
to clarify this. Ultimately, the inspector will need to check the circuit pane] and site to deteimine
compliance.
2. NEC 410-15(b)(1) -A minimum of a 2"x4" hand hole wi[h a iain tight cove�shall be provided. This
is to provide access to the wiring in the pole for future service or installation work.
3. NEC 410-15(b)(3) - The metal pole shall be provided with a gro�nding termina] accessible from the
hand hole. All meta] structures aze required to be bonded/grounded to prevent accidental shocks in
the even[the metal pole becomes energized. Same principle as grounding the water and gas piping
or the steel framing in a building.
Reviewing your letter, I can understand why you had the impression that a separate circui[needed to be
provided from your building based upon your initial conversation with the inspectoc However,you will
note upon review of[he Coirec[ion Notice, this issue was not included.
Finally, I would cequest your assistance in securing compliance on the remaining issues (if not already
cocrected) and azcanging for the reinspection of this i�stallation to vedFy compliance(the purpose of
sending the second Coirection Notice.) Please verify with B.Q. E]ecMe that the corrections have been or
are being made and have him contact our inspector for a re-inspection.
I hope this cleazs the air regazding[he issue I believe tha[was causing you the most concem. [n the
future, if you have questions or concems please call me at 236-5045 (just as you did when you reques[ed
additional time to install the landscaping on youi site.)
