PURPOSE: APPROVE SPECIAL EVENT / OSHKOSH JAZZ FESTIVAL
(LARSON/BOEHME) / TO UTILIZE THE 400 BLOCK OF N. MAIN
STREET FOR THE OSHKOSH JAZZ FESTIVAL / AUGUST 27,
2022
INITIATED BY: CITY ADMINISTRATION
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that approval is granted to the Oshkosh Jazz Festival (Kris Larson/Erin Boehme)
to utilize the 400 Block of N. Main Street on Saturday, August 27, 2022 from 6:00 a.m. to
10:30 p.m. (actual event time 1:00 p.m. to 9:00 p.m.) for the Oshkosh Jazz Festival in
accordance with the municipal code and the attached application, with the following
exceptions/conditions:
A. Oshkosh Jazz Festival will coordinate set-up and start times with the
Oshkosh Farmers Market manager.
B. Allowance of alcohol on N. Main St. will be determined by approval of a
Special Class “B” Retailers License.
BE IT FURTHER RESOLVED that as a condition of approval, the Event
Organizer shall pay the City’s actual costs for extraordinary services, includes costs
associated with security for permitting the Special Class “B” Retailers License.
Approval of this request shall not be interpreted as approval to conduct the event
during any period of emergency order or declaration prohibiting such event. Approval
of this event shall not be interpreted to supersede any emergency order or declaration
applicable to such event and all events shall remain subject to all applicable ordinances,
orders, declarations and requirements for public gatherings.

SUBJECT: Approve Special Event – Oshkosh Jazz Festival Inc. to utilize N. Main Street for
the Oshkosh Jazz Festival / August 27, 2022
BACKGROUND
The first annual Oshkosh Jazz Festival was hosted on the 400 Block of N. Main Street August
28, 2021. The event was an afternoon/evening of live Jazz music with participants seated in the
right-of-way and purchasing food and beverages from local businesses. Alcoholic beverages
remained inside licensed establishments.
ANALYSIS
The Oshkosh Jazz Festival Inc. has submitted a Special Event permit application for the
Oshkosh Jazz Festival once again be hosted on the 400 block of N. Main St. on August 28, 2022.
The event organizer is requesting alcoholic beverage sales and consumption on the City Street
for the duration of the event.
Per Section 4-12 of the Oshkosh Municipal Code, the event organizer will be required to
submit a Special Class “B” Retailers License request to accommodate the sale of alcoholic
beverages at their event. If approved, a temporary ordinance change will be brought forward
for the Council’s review to allow a variance to Section 17-7 of the Oshkosh Municipal Code to
allow the sale and consumption of alcoholic beverages on the 400 block of N. Main Street.
The Special Events ordinance allows for applicants to apply for Special Events Permits up to
one year in advance. It has been common practice that the Special Class “B” Retailers License
be applied for closer to the event date due to any changes that may occur to Section 4-12.
RECOMMENDATION
City staff is recommending the approval of the Special Event Permit with the condition that
allowance of alcohol on N. Main St. will be determined by the approval of the Special Class
“B” Retailers License at a later time. The permit will specify that additional costs associated
with security for the Special Class “B” License will be paid by event organizers.
