HomeMy WebLinkAboutMinutesPROCEEDINGS OF THE COMMON COUNCIL CITY OF OSHKOSH, WISCONSIN NOVEMBER 10, 2020 REGULAR MEETING held Tuesday, November 10, 2020 at 6:00 p.m. virtually. Mayor Palmeri presided. PRESENT: Council Members Bob Poeschl, Michael Ford, Deb Allison-Aasby, Jake Krause, Matt Mugerauer, Lynnsey Erickson, and Mayor Lori Palmeri ALSO PRESENT: Mark Rohloff, City Manager; Pamela Ubrig, City Clerk; and Lynn Lorenson, City Attorney Council Member Poeschl read the Invocation. The Pledge of Allegiance was led by Council Member Poeschl. CITIZEN STATEMENTS There were no citizen statements to Council. PUBLIC COMMENT ON AGENDA ITEMS Resolution 20-439 Approve Conditional Use Permit Amendment for an Institutional Residential Use at 851 County Road Y (Plan Commission Recommends Approval) Mary Anne Mueller, 448 Algoma Boulevard, Winnebago County Corporate Council, explained the request for the conditional use was to allow another occupant on the property. CONSENT AGENDA ITEMS Report of Bills by the Finance Director Approval of Cash Report from September 2020 Receipt & Filing of the Oshkosh Public Library Minutes from September 24, 2020 Receipt of Claim filed with the City’s Insurance Company: A) Davis Child Care Center for alleged water main break PROCEEDINGS OF THE COMMON COUNCIL – NOVEMBER 10, 2020 2 Resolution 20-438 Approve Conditional Use Permit for a Group Development at the 2600 Block of Witzel Avenue (Plan Commission Recommends Approval) Resolution 20-439 Approve Conditional Use Permit Amendment for a Institutional Residential Use at 851 County Road Y (Plan Commission Recommends Approval) Council Member Mugerauer asked if there was a long term solution other than a mobile home on the property. Ms. Mueller explained the Winnebago County Judiciary Committee had requested solutions for housing individuals due to Act 184. She stated the County was responsible for housing 980 Sex Offenders who were residents of Winnebago County at the time of the crime and explained there was a requirement of a buffer zone. Resolution 20-440 Approve Agreement with Foust Excavating, Inc. for 2020/2021 Sidewalk Snow & Ice Removal Contract Resolution 20-441 Approve Amendment to Professional Services Agreement for 2020 Wastewater Utility Technical Services / Jacobs Engineering Group (+$52,620.00) Resolution 20-442 Award Bid for Public Works Contract No. 20-02 Southwest Industrial Park / Clairville Road to Vinton Construction Company ($2,587,589.47) Resolution 20-443 Award Bid to Fortress Fence for Fencing Improvements for Fire Department ($37,480.00) Resolution 20-444 Approve Purchases of Rectangular Rapidly Flashing Beacons (RRFB’s) from TAPCO for the S. Washburn & W. 9th Avenue Roundabout Crosswalks ($50,439.05) Resolution 20-445 Approve Special Event – Brittany Stieg to utilize Riverside Park Parking Lot for a Food Drive / November 21, 2020 Resolution 20-446 Approve Special Event – Father Carr’s Place 2B to utilize City streets for the Drive thru Children’s Christmas Express/December 19, 2020 Resolution 20-447 Approve Operator Licenses PROCEEDINGS OF THE COMMON COUNCIL – NOVEMBER 10, 2020 3 MOTION: ADOPT (Allison-Aasby; second, Ford) CARRIED: Ayes (7) Poeschl, Ford, Allison-Aasby, Krause, Mugerauer, Erickson, Mayor Palmeri ACTION TAKEN ON ORDINANCES AND RESOLUTIONS Ordinance 20-448 Amend Ordinance Pertaining to Enforcement of Parking Restrictions FIRST READING; LAID OVER UNDER THE RULES Mr. Rohloff explained there was a revised memo provided to Council. Council Member Ford explained the ordinance would update the statutes with current practices. Ms. Lorenson stated the changes would shorten the collection time, amend fees and penalties. Resolution 20-449 Adopt the 2021 Annual Operating Budget & Establish the Property Tax Levy for the City of Oshkosh MOTION: ADOPT (Mugerauer; second, Ford) CARRIED: Ayes (7) Poeschl, Ford, Allison-Aasby, Krause, Mugerauer, Erickson, Mayor Palmeri Council Member Ford explained the tax levy was below 3% and tax levy for debt service went down by 7.84% which allowed dollars to be allocated elsewhere. Council Member Mugerauer thanked staff and stated his support of the budget. Council Member Allison-Aasby praised staff and Council for their work on the budget. Mayor Palmeri stated her appreciation for the process. Resolution 20-450 Approve the Financing of 2021 Capital Improvement Projects MOTION: ADOPT (Poeschl; second, Ford) CARRIED: Ayes (7) Poeschl, Ford, Allison-Aasby, Krause, Mugerauer, Erickson, Mayor Palmeri PROCEEDINGS OF THE COMMON COUNCIL – NOVEMBER 10, 2020 4 Council Member Ford stated the upcoming years would have some difficult decisions regarding debt revenues. COUNCIL DISCUSSION, DIRECTION TO CITY MANAGER & FUTURE AGENDA ITEMS Mayor Palmeri mentioned a presentation from the Overdose Fatality Review Team on December 8, 2020. Deputy Mayor Krause explained the dates for the City Manager review would be on November 16 and November 30, 2020 at 5:30 p.m. Mr. Rohloff stated staff had made changes to the website based on the input from Council and asked if Council would like a presentation. Mayor Palmeri asked if Council was interested in a joint meeting with the Oshkosh Area School District in January. Council Member Ford stated he supported the joint meeting. Council Member Mugerauer expressed his support for a joint meeting with a defined agenda. He asked if staff had worked on the assessment information. Mr. Rohloff explained staff had waited for information from the City of Janesville on the transportation fee model. He stated the City of Janesville decided to create a task force regarding special assessments. He explained Janesville had worked with R.A. Smith who conducted a study and scheduled a workshop for January. He mentioned he would provide Council a copy of the report from by Janesville when received. Mayor Palmeri suggested to review and discuss extended schedule for the sidewalk replacement and rehabilitation program. Council Member Mugerauer agreed with the discussion topic as part of the workshop. Mayor Palmeri asked if staff would like to discuss the mask ordinance. Mr. Rohloff explained Governor Ever’s signed an executive order urging citizens to stay home as much as possible and did not include any new directives. He stated staff would review the Governor’s order and the mask ordinance could be placed on the next agenda. Mayor Palmeri asked Council if they would like to hold a December 22nd Council meeting. Council Member Mugerauer stated the 2nd meeting in December had historically been PROCEEDINGS OF THE COMMON COUNCIL – NOVEMBER 10, 2020 5 cancelled and he supported that. Mayor Palmeri explained previous meetings had been held at 12:00 p.m. as well. She asked if there was an immediate need for the December 22, 2020 meeting. Mr. Rohloff explained there were no urgent issues. He stated there would be a 5-week gap if Council decided not to hold a meeting on December 22, 2020. He explained that the consent agenda portion for the Council Meeting on January 12, 2021 would be significant due to year end and new year purchases from the approved budget. Council Member Poeschl stated he would support either side; if necessary, he woud prefer a noon meeting. Council Member Allison-Aasby expressed her support for no 2nd meeting in December. Deputy Mayor Krause stated he did not see a need for the December 22, 2020 meeting. Council Member Erickson explained she was not opposed or supportive to either side. Mayor Palmeri stated Council would not hold the December 22, 2020 meeting. Mr. Rohloff stated staff would prepare an ordinance for the cancelled meeting to be added to the agenda in the near future. COUNCIL MEMBER ANNOUNCEMENTS & STATEMENTS Report of Council Liaison for Boards & Commissions Council Member Ford Plan Commission  County Housing Discussion Deputy Mayor Krause Traffic and Parking Advisory Board  Jackson Street Corridor Plan and Safety Study  South Main Street Restriping Study Mayor Palmeri Advisory Park Board  Lakeshore Park Phase I schedule Diversity Equity and Inclusion Committee PROCEEDINGS OF THE COMMON COUNCIL – NOVEMBER 10, 2020 6  University of Oshkosh - roundtable discussion on building confidence with minority communities in regards to COVID-19 Council Member Mugerauer explained over 32,000 citizens had voted in the November General Election and the Clerk’s office had mailed out over 16,000 absentee ballots and nearly 4,000 citizens voted early in-person at City Hall two weeks prior to the election. He stated within 47 minutes of closing the polls the districts had reported their numbers. He expressed his appreciation to the Clerk’s office and all of the individuals who assisted with the election. Council Member Mugerauer stated he reached out to the Oshkosh Area School District regarding the bussing agreement. CITY MANAGER ANNOUNCEMENTS & STATEMENTS Mr. Rohloff informed Council of the cooperative purchase of the light duty pickup truck for the Parks Department ($26,614.00). He explained the 3rd Quarter Strategic Plan Update had been provided to Council and the City was on track with most items and mentioned that some disruptions were due to COVID-19. Council Member Mugerauer asked if the missing data for the library was normal. Mr. Rohloff stated the key performance indicators’ (KPI) were relatively new and the library had typically provided their information annually. Mr. Rohloff stated for outstanding issues staff had reviewed the possible zone change for the transitional housing that was listed on the outstanding issues list. Mr. Rohloff stated the COVID-19 numbers continue to plateau at a high number and staff had implemented online City services. He explained there would be information in the Oshkosh Herald. Mayor Palmeri stated the rapid test site at the UWO Culver Family Welcome Center was open to anyone who needed a test with sign up at COVID19Test.com. Council Member Allison-Aasby asked if the site was open to only Oshkosh or Winnebago residents only. Mayor Palmeri explained the site was open to anyone who needed a test. Mr. Rohloff explained Fire Chief Stanley was nominated for an Award from the PROCEEDINGS OF THE COMMON COUNCIL – NOVEMBER 10, 2020 7 National Fallen Firefighter Foundation Sponsored by Maglite for his Leadership on Community-wide Fall Prevention Program.
