Mayor Palmeri presided. PRESENT: Council Members Bob Poeschl, Michael Ford, Deb Allison-Aasby, Matt Mugerauer, Lynnsey Erickson, and Mayor Lori Palmeri EXCUSED: Council Member Jake Krause ALSO PRESENT: Mark Rohloff, City Manager; Pamela Ubrig, City Clerk; and James Rabe, Director of Public Works Council Member Poeschl read the Invocation. The Pledge of Allegiance was led by Poeschl. PUBLIC HEARINGS Resolution 20-354 Approve Final Resolution for Special Assessments for Concrete Pavement, Asphalt Pavement, Sidewalk (New & Rehabilitation), Driveway Aprons, Sanitary Sewer Main & Laterals (New & Relay), Water Main & Laterals (New & Relay) & Storm Sewer Mains & Laterals (New & Relay) Relating to Contract No. 20-04 A) Snell Road (Jackson Street to 600’ East of Moser Street) B) North Main Street (Snell Road to 2,300’ South of Snell Road) C) Moser Street from Snell Road to 150’ South of Snell Road MOTION: ADOPT (Allison-Aasby; second, Poeschl) CARRIED: Ayes (6) Poeschl, Ford, Allison-Aasby, Mugerauer, Erickson, Mayor Palmeri John Rucinsky, 3680 N. Main Street, stated his concerns with the sidewalks being installed and asked if there had been a safety study done regarding pedestrian crossing. John Boyle, 375 E. Snell Road, suggested no sidewalk installation on Snell Road. PROCEEDINGS OF THE COMMON COUNCIL - AUGUST 24, 2020 2 Council Member Mugerauer asked what the policy stated and how it applied to the area. Mr. Rabe stated the policy applied to the implementation of the bicycle and pedestrian circulation plan, which called for bike lanes and sidewalks in that area. He explained sidewalks would be installed on the South side of Snell Road to allow for future connections to the west side of Moser Street and to the North side of Fernau Avenue. Council Member Mugerauer clarified there was sidewalk currently only on the east side of Main Street. Mr. Rabe confirmed that was correct and the reason for that was because not all of the parcels were in the city limits. He stated the installation of sidewalk on the West side would vary due to various properties being outside the city limits. He explained eleven of the properties on the East side of the road were within the city limits and the sidewalk was installed/extended to Snell Road. Council Member Mugerauer questioned the timeframe that the bike and pedestrian circulation plan was approved. Alexa Naudzinuas, Associate Planner, stated an update to the plan was approved in 2019; the original plan was from 2011. Mayor Palmeri asked if there was part of the plan that was prioritized. Ms. Naudzinuas stated that the City had success implementing new sidewalks and bike facilities that help create healthy and safe communities. She explained that connectivity was key, working with the County to connect parks was important and helped create equity among all residents. Mayor Palmeri asked how many apartments were in the complex in that area. Ms. Naudzinuas stated that she did not have the number and would provide the information to Council. Mr. Rabe stated he did not have the number of units in the apartment complex. Council Member Poeschl stated the importance of the project was to create safer access to resources in the community. Mr. Rucinsky stated that he was not against of the sidewalks on one side of the road or the other. He explained that on the South side of Snell there was fewer residences that had PROCEEDINGS OF THE COMMON COUNCIL - AUGUST 24, 2020 3 access off of Main Street. He mentioned that citizens would walk down a sidewalk where there were no residences and then cross in front of the County Park was a potential safety hazard. Mr. Boyle stated he agreed with Mr. Rucinsky and believed the sidewalks be installed on the North side where the residential were located would be safer for individuals particularly at the intersection of Moser Street to the County Park. He felt that several businesses within the area could assist by absorbing a portion of the assessment. He explained that 3 years ago he was required to put in new aprons on 28th Street; he expressed he felt a lot of the businesses were getting beat up due to the construction and asked if there was a restitution for that. He requested Council lower the interest rate below the current 6%. David Paulick, 140 West 28th Avenue, stated that he paid $2,500 for an apron assessment and asked if there was a way to receive a credit on that assessment. He encouraged the PROCEEDINGS OF THE COMMON COUNCIL - AUGUST 24, 2020 4 Council to complete the assessment study. He asked what would happen if the City went forward with every property owner paying a smaller amount each year regardless of improvements to any location. He suggested property owners should get a credit or put the 2020 assessments under a new program. Mayor Palmeri stated the topic was not on the agenda and would be included on a future agenda. Justin Gierach, Engineering Division Manager, explained the assessment policy stated if the improvement was not in need of repair, a credit would be given. Mr. Paulick stated that the work related to 28th Avenue was in relation to the sewer and the street was rated at a 2 or 3 on the PACER rating. He stated the sewer repairs did not benefit property owners on the street and the street did not need to be repaired. Council Member Ford asked staff who would be the contact for citizens that spoke about credits. Mr. Rabe stated citizens would contact the Engineering Division at 920-235-5065. Council Member Mugerauer questioned if the packet provided to citizens showed a cost under apron and did that mean they would get a bill for it. Mr. Gierach stated cost estimates were provided to property owners. He explained the assessment had not been certified to include the actual assessment costs. He stated the assessment costs would not exceed the estimated amount and the property owner would only be billed for the necessary completed work. Council Member Mugerauer explained information in the packet was a worst case+ scenario. He stated property owners would only be billed for the completed work. Council Member Poeschl asked staff to provide a scenario as to why the City would provide an assessment estimate for the apron that would not be completed. Mr. Gierach stated that at the time of preparation of the assessments that cost was an estimate provided to the property owner; in reality if there was a newer apron that had been installed there would be a credit. He explained if the apron was replaced under what previously existed the improvement would be assessed to the property. Mayor Palmeri asked about the interest rate of 6% and what the potential was to change that. PROCEEDINGS OF THE COMMON COUNCIL - AUGUST 24, 2020 5 Mr. Rohloff stated that the 6% had been set by policy and had previously been reduced in prior years. He stated the City was paying a little over 2% interest, which was the lowest the City have paid in previous year. He mentioned that staff tried to encourage property owners to find another funding sources rather than using the City’s payment options. He stated Council could revisit the topic and mentioned this was a standard practice among other municipalities. Council Member Mugerauer stated Council should review the interest rate. He asked staff if there were other reasons that the street was being improved other than the infrastructure for the Aviation Industrial Park and the apartment complex. Mr. Rabe responded that after staff reviewed the street project, the street was deemed in need of repair as well as the sewer utility. Mr. Rabe stated he did not recall the PASER rating on these streets, maybe a 3 and the extension of street life, by code a minimum of 3 years. He explained history showed it had been 10-15-20 years depending on traffic usage.
