RE: Approve Utility Box Wrap Pilot Program
BACKGROUND
The City of Oshkosh Business Improvement District (BID) has requested that the City allow for
the placement of wraps representing historical scenes, art, or other non-commercial images on
City-owned electrical cabinets in the right of way or on City property.
The City is willing to allow the BID’s request with the understanding that this is a pilot program
with an expiration and removal of the wrap twelve months after the wrap is installed. The City
will provide historical photograph options and approve the location of the selected photographs
at specific electrical cabinets. The wraps must be professionally created, installed, maintained,
and removed. The City will also perform periodic inspections after installation. City use,
functionality and appearance of the electrical cabinet will remain the priority over the existence
of the wrap. Sponsorships are not allowed to be identified or noted anywhere on the electrical
cabinet or wrap.
The costs, including designs, installations, maintenance, and removal are the BID’s
responsibility. There will be no cost to the City or taxpayers for the pilot program.

ELECTRIC CABINET WRAP AGREEMENT
Pilot Program
1. PARTIES. The parties to this Agreement are the City of Oshkosh (CITY) and the
City of Oshkosh Business Improvement District (BID). The CITY is a municipal
corporation with authority as described in Wisconsin Statutes. The BID is an
entity created by the CITY according to the requirements of Wis. Stat. 66.1109 for
the purpose of supporting downtown Oshkosh businesses.
2. REQUEST. The CITY has located various electrical cabinets in the right-of-way
or other City-owned property downtown and within the BID’s boundaries. The
BID has requested that the CITY allow it to place wraps representing historical
scenes, art, or other non-commercial images on the CITY-owned electrical
cabinets.
3. APPROVAL. The CITY agrees to allow the electrical cabinet wraps subject to the
terms and conditions of this Agreement. This general approval is subject to the
CITY’s approval of individual requests for individual electrical cabinets. The
BID understands that all of the terms of this Agreement are important to the
CITY.
4. PILOT PROGRAM. Prior to this request, the CITY has not previously allowed
these actions. The CITY is willing to allow the BID’s request with the
understanding that this allowance will be as part of a pilot program with an
expiration and removal of the wrap twelve (12) calendar months after the wrap is
installed, or earlier if required to be removed according to the terms of this
Agreement.
5. SUBJECT MATTER. The BID will be allowed to place historical photographs on
the CITY-owned electric cabinets. The CITY will provide the BID with historical
photograph options that are available through the Oshkosh Public Museum.
Only those historical photograph options approved and made available by the
Oshkosh Public Museum will be allowed to be used.
6. LOCATION. In addition to the requirement of selecting an historical
photograph made available by the CITY, the CITY must approve the location of
the selected photograph at specific CITY-owned electrical cabinets.

7. COST. There shall be no cost to the City and the City’s taxpayers for this pilot
program. The costs, including designs, installation, maintenance, and removal
shall be the BID’s responsibility.
8. QUALITY. The wrap must be professionally created, installed, maintained, and
removed by a reputable sign company. BID must present a schedule for periodic
inspections that is acceptable to the CITY. The CITY will inspect after installation
and any repairs and may, at the CITY’s sole discretion, require additional work
on the wrap.
9. CITY PRIORITY. The CITY use and the appearance of the electrical cabinet shall
always remain the priority over the existence of the wrap. While the BID is
responsible for the wrap, if the CITY may fix the problem at BID’s expense in an
emergency or if the BID doesn’t promptly fix the problem itself. The BID shall be
responsible for the following:
a. Vents, doors, locks, and other features required for cabinet use shall not be
blocked, obstructed, or damaged; and any blockage, obstruction, or
damage shall be repaired within twenty-four hours after notice unless an
emergency requires earlier attention;
b. Peeling shall be repaired within two (2) business days after notice;
c. Graffiti shall be removed within twenty-four hours after notice;
d. Damage to the wrap during access to or use of the electric cabinet by the
CITY, contractors, Wisconsin Public Service, or any other entity with a
lawful reason to access or use the cabinet.
10. SPONSORSHIPS. It is expected that various persons, businesses, and/or non-
profit entities may sponsor wraps. However, such sponsorships are not allowed
to be identified or noted anywhere on the cabinet or wrap.
11. REMOVAL. When the wrap is removed for any reason, the electric cabinet shall
be returned to a condition that is substantially similar to its condition before the
wrap was installed.
