Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Mark Lyons, Planning Services Manager DATE: August 19, 2021 RE: Accept Storm Water Drainage Easement at 0 Witzel Avenue BACKGROUND The City of Oshkosh Department of Public Works is requesting acceptance of a storm water drainage easement at 0 Witzel Ave to improve surface water drainage emanating from the property and surrounding properties. The proposed easement is to be located across the southern lot line and 107-feet of the southwestern lot line on Lot 1 of CSM 7616, also known as 0 Witzel Ave. This property is currently under construction to build multi-family residential apartments. The purpose of the easement is to allow the Department of Public Works to construct a surface level drainage swale on the south property line. ANALYSIS The proposed 15,392 square foot easement is 20-feet wide, “L” in shape, and is located along the southern border and partially along the southwesterly corner of the property for 107-feet. The storm water drainage swale is intended to collect surface water from the north and flow easterly. The City shall be allowed to use the easement property for all purposed related to its public storm water management system. The City will have continued rights to access the easement area for surface level and/or underground storm water drainage facilities. The City has been working with the property owners who have agreed to grant the easement. RECOMMENDATION The Plan Commission recommended acceptance of the easement on August 17, 2021. Please see the attached staff report and meeting minutes for more information. GENERAL INFORMATION Applicant: City of Oshkosh Department of Public Works Owner: Moorehead Barr Properties Actions Requested: The City of Oshkosh is requesting acceptance of a storm water drainage easement at 0 Witzel Ave to improve storm water drainage on this property and surrounding properties. Applicable Ordinance Provisions: N/A Property Location and Background Information: The proposed easement is to be located across the southern lot line and a 107-feet of the southwestern lot line on Lot 1 of CSM 7616, also known as 0 Witzel Ave (Parcel# 0614920100). The Department of Public Works does not have concerns with the proposal and is coordinating with the owners to have the appropriate easement documents signed and recorded at the Winnebago County Register of Deeds upon Common Council approval. RECOMMENDATION/CONDITIONS Staff recommends approval of the acceptance of the proposed storm water drainage easement at 0 Witzel Ave (Parcel# 0614920100) as proposed. The Plan Commission recommended acceptance of the easement on August 17, 2021. The following is Plan Commission’s discussion on the item. Site Inspections Report: No commissioners reported visiting the site. Staff report accepted as part of the record. The City of Oshkosh is requesting approval of two street right-of-way dedications, acceptance of three storm sewer easements, two sidewalk easements and one grant access easement. Mr. Nau presented the items and reviewed the site and surrounding areas as well as the land use and zoning classifications in the areas. Staff recommends approval of the requests with the findings and conditions listed in the staff reports. Mr. Hinz opened up technical questions to staff. There were no technical questions on this item. Mr. Hinz asked for any public comments and asked if the applicant wanted to make any statements. There were no statements from the applicant.
