Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Mark Lyons, Planning Services Manager DATE: August 19, 2021 RE: Accept Sidewalk Easement at 3087 Oregon Street BACKGROUND The City of Oshkosh Department of Public Works is requesting acceptance of an easement to allow construction of a sidewalk and wheelchair ramp compliant with the Americans with Disabilities Act (ADA). Future use of this easement would allow underground conduit and wires as well as an electric pull box. The subject property is located to the northwest of the Oregon Street and West Waukau Avenue intersection and is known as 3087 Oregon Street. The property contains a single-family home with associated amenities and two storm easements. Oregon Street is currently being reconstructed and, as part of the future sidewalks planned for this area, the City is making a number of changes to improve pedestrian, vehicular, and bicycle traffic. With these future improvements, the southeasterly corner of the property will be affected to allow the installation of an ADA compliant sidewalk and ramp. ANALYSIS The proposed easement is a ten-foot by twelve-foot by fifteen-foot, 57 square foot triangular easement located at the southeast corner of the property. Inadequate area is available to construct the proposed structures entirely within public right-of-way due to the width of the Oregon Street pavement and narrow terrace. The easement will allow the City to access, survey, lay, construct, use, operate, maintain, repair, replace, relocate, and/or remove public sidewalk as well as accessory sidewalk uses including signage, all of which may be over, under, and through the property. The initial use of the easement would be for a curb and ADA compliant public sidewalk, the City would be allowed to install underground conduit and wires as well as an electric pull box if the City’s system warrants such additions in the future. RECOMMENDATION The Plan Commission recommended acceptance of the easement on August 17, 2021. Please see the attached staff report and meeting minutes for more information. Item I-F – Accept Easement – 3087 Oregon St 2 The purpose of the easement is to allow the City to construct ADA-compliant sidewalk and wheelchair easement partially on the subject property. The easement will allow the city to access, survey, lay, construct, use, operate, maintain, repair, replace, relocate, and/or remove public sidewalk as well as accessory sidewalk uses including signage, all of which may be over, under, and through the property. The initial use of the easement would be for curb and ADA compliant public sidewalk, the City would be allowed in the future to install underground conduit and wires as well as an electric pull box if the City’s system warrants such additions. The City Attorney’s office has drafted the necessary easement documents. The Department of Public Works does not have concerns with the proposal and is coordinating with the property owners to have the appropriate easement documents signed and recorded at the Winnebago County Register of Deeds upon Common Council approval. RECOMMENDATION/CONDITIONS Staff recommends approval of the acceptance of the proposed easement located at 3087 Oregon Street as proposed. The Plan Commission recommended acceptance of the easement on August 17, 2021. The following is Plan Commission’s discussion on the item. Site Inspections Report: No commissioners reported visiting the site. Staff report accepted as part of the record. The City of Oshkosh is requesting approval of two street right-of-way dedications, acceptance of three storm sewer easements, two sidewalk easements and one grant access easement. Mr. Nau presented the items and reviewed the site and surrounding areas as well as the land use and zoning classifications in the areas. Staff recommends approval of the requests with the findings and conditions listed in the staff reports. Mr. Hinz opened up technical questions to staff. There were no technical questions on this item. Mr. Hinz asked for any public comments and asked if the applicant wanted to make any statements. There were no statements from the applicant.
