Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Mark Lyons, Planning Services Manager DATE: August 19, 2021 RE: Accept Sidewalk Easement at 1403 Jackson Street BACKGROUND The City of Oshkosh Department of Public Works is requesting acceptance of an easement to allow construction of a sidewalk and wheelchair ramp compliant with the Americans with Disabilities Act (ADA) and installation of a pole with an overhead arm at the northwest corner of Jackson Street and Congress Avenue. The subject property is Lot 1 of Block 3 of Masterson’s Park Plat, also known as 1403 Jackson Street. The property contains a single-family home with associated amenities. The City has begun to implement recommendations from the recently adopted Jackson Street Corridor and Safety Study. As part of the approved plan, the City is making a number of changes and upgrades to traffic over and along Jackson Street, including transportation modes such as pedestrian, vehicular, and bicycle. The part of the approved plan that affects this property is the installation of an ADA compliant sidewalk and ramp and installation of a pole with an overhead arm for an upgraded pedestrian crossing. ANALYSIS The proposed easement is a ten-foot by ten-foot, 50 square foot triangular easement located at the southeast corner of the property. Inadequate area is available to construct the proposed structures entirely within public right-of-way due to the width of the Jackson Street pavement and narrow terrace. The purpose of the easement is to allow the City to construct an ADA compliant sidewalk and wheelchair easement partially on the subject property. The easement will allow the City to access, survey, lay, construct, use, operate, maintain, repair, replace, relocate, and/or remove public sidewalk as well as accessory sidewalk uses including signage, all of which may be over, under, and through the property. The initial use of the easement is for curb, ADA compliant public sidewalk, a pole with arm overhanging the street, a wireless electric pedestrian push button, and appropriate pedestrian and vehicular signals and signage. The City would be allowed in the future to install underground conduit and wires as well as an electric pull box if the City’s system warrants such additions. City Hall, 215 Church Avenue P.O. Applicable Ordinance Provisions: N/A Property Location and Background Information: The City has begun to implement recommendations from the recently adopted Jackson Street Corridor and Safety Study. The City Attorney’s office has drafted the necessary easement documents. The Department of Public Works does not have concerns with the proposal and is coordinating with the property owners to have the appropriate easement documents signed and recorded at the Winnebago County Register of Deeds upon Common Council approval. RECOMMENDATION/CONDITIONS Staff recommends approval of the acceptance of the proposed easement located at 1403 Jackson Street as proposed. The Plan Commission recommended acceptance of the easement on August 17, 2021. The following is Plan Commission’s discussion on the item. Site Inspections Report: No commissioners reported visiting the site. Staff report accepted as part of the record. The City of Oshkosh is requesting approval of two street right-of-way dedications, acceptance of three storm sewer easements, two sidewalk easements and one grant access easement. Mr. Nau presented the items and reviewed the site and surrounding areas as well as the land use and zoning classifications in the areas. Staff recommends approval of the requests with the findings and conditions listed in the staff reports. Mr. Hinz opened up technical questions to staff. There were no technical questions on this item. Mr. Hinz asked for any public comments and asked if the applicant wanted to make any statements. There were no statements from the applicant. There were no other public comments on this item. Item I-E – Accept Easement – 1403 Jackson Street 3 There were no public comments on this item. Mr. Hinz closed public comments and asked if the applicant wanted to make any closing statements. There were no closing statements from the applicant. Motion by Mitchell to adopt the findings and recommendation as stated in the staff report. Seconded by Davey. Mr. Hinz asked if there was any discussion on the motion.
