PURPOSE: ACCEPT STORM SEWER EASEMENT AT 780 FOX FIRE DRIVE
INITIATED BY: CITY OF OSHKOSH DEPARTMENT OF PUBLIC WORKS
PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the City
hereby accepts a storm sewer easement at 780 Fox Fire Drive, per the attached, and the
proper City officials are authorized and directed to execute any and all documents
necessary for purposes of same.

RE: Accept Storm Sewer Easement at 780 Fox Fire Drive
BACKGROUND
The City of Oshkosh Department of Public Works is requesting acceptance of a storm sewer
easement to allow construction of a storm sewer inlet, piping, and related structures through a
portion of 780 Fox Fire Drive to improve surface water drainage emanating from rear yards of
properties to the north. The proposed easement will be located at the southeasterly corner of Lot
1 of Meadow Ridge Plat, also known as 780 Fox Fire Drive. The property contains a single-family
home and associated amenities.
ANALYSIS
The proposed 150 square foot 10-foot by 15-foot easement is rectangular in shape and is located
at the southeasterly corner of the property. The storm sewer inlet is intended to collect surface
water from the north and flow into storm sewer located in West 9th Avenue. The easement will
allow the City to access the property and construct storm inlet and related structures within the
easement area. The City will have continued rights to access the easement area to maintain,
replace, relocate, or remove the storm sewer facilities. The City has been working with the
property owners who have agreed to grant the easement.
RECOMMENDATION
The Plan Commission recommended acceptance of the easement on August 17, 2021. Please see
the attached staff report and meeting minutes for more information.

GENERAL INFORMATION

Actions Requested:
The City of Oshkosh is requesting acceptance of a storm sewer easement to allow construction
of a storm sewer inlet, piping and related structures through a portion of 780 Fox Fire Drive.
Applicable Ordinance Provisions:

Property Location and Background Information:
The proposed easement is to be located at the southeasterly corner of Lot 1 of Meadow Ridge
Plat, also known as 780 Fox Fire Drive. The property contains a single-family home and
associated amenities.
The purpose of the easement is to allow the Department of Public Works to construct a storm
sewer inlet and piping behind public sidewalk on W. 9th Avenue. This will improve surface
water drainage emanating from rear yards of properties to the north.

The City Attorney’s office has drafted the necessary easement documents. The Department of
Public Works does not have concerns with the proposal and is coordinating with the owners to
have the appropriate easement documents signed and recorded at the Winnebago County
Register of Deeds upon Common Council approval.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the acceptance of the proposed storm sewer easement at 780 Fox
Fire Drive as proposed.
The Plan Commission recommended acceptance of the easement on August 17, 2021. The
following is Plan Commission’s discussion on the item.
Site Inspections Report: No commissioners reported visiting the site.
Staff report accepted as part of the record.
The City of Oshkosh is requesting approval of two street right-of-way dedications, acceptance
of three storm sewer easements, two sidewalk easements and one grant access easement.
Mr. Nau presented the items and reviewed the site and surrounding areas as well as the land
use and zoning classifications in the areas. Staff recommends approval of the requests with the
findings and conditions listed in the staff reports.
Mr. Hinz opened up technical questions to staff.
