HomeMy WebLinkAbout40. 21-444AUGUST 24, 2021 21-444 ORDINANCE FIRST READING (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: AMEND LANDMARKS COMMISSION ORDINANCE TO CORRECT CODE REFERENCES INITIATED BY: CITY ADMINISTRATION A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 2- 48(B)(7) OF THE CITY OF OSHKOSH MUNICIPAL CODE PERTAINING TO THE LANDMARKS COMMISSION TO UPDATE AND CORRECT REFERENCE TO MUNICIPAL CODE SECTION WHEREAS, there is need to update the Landmarks Commission Ordinance to include the updated correct reference to the Historic Preservation Article within Chapter 30 of the City's Zoning Code. NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 2-48(B)(7) of the City of Oshkosh Municipal Code pertaining to the Landmarks Commission is hereby repealed and recreated to read as follows: SECTION 2-48 LANDMARKS COMMISSION (B) Duties, Purposes, and Functions The Landmarks Commission: (7) Shall implement and regulate the provisions of Article XIV, of Chapter 30 of this Code, Historic Preservation. [Statutory Reference §62.23(7) (me) Wis. Stats.] AUGUST 24, 2021 21-444 ORDINANCE FIRST READING CONT'D SECTION 3. This ordinance shall be in full force and effect from and after its passage, and publication. SECTION 4. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #20- AMEND LANDMARKS COMMISSION ORDINANCE TO CORRECT CODE REFERENCES (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 2-48(B)(7) OF THE CITY OF OSHKOSH MUNICIPAL CODE PERTAINING TO THE LANDMARKS COMMISSION TO UPDATE AND CORRECT REFERENCE TO MUNICIPAL CODE SECTION) on September 14, 2021. The ordinance revises the City's current ordinances to update and correct a code reference to the City's Historic Preservation Code. Lorenson, City Attorney DATE: August 20, 2021 RE: Amend Landmarks Commission Ordinance to Correct Code References BACKGROUND Council is being asked to approve an ordinance to correct the code references contained in section 2-48 pertaining to the Landmarks Commission. ANALYSIS When the City amended Chapter 30 not all of the references in other sections of the Codebook were identified and updated. One of those references that was missed during the update is in section 2-48 pertaining to the Landmarks Commission. The proposed ordinance updates the code reference to match the new numbering contained in Chapter 30, the City's zoning code. There are no substantive changes proposed to the section. FISCAL IMPACT There is no anticipated fiscal impact associated with the proposed ordinance change. RECOMMENDATION Staff recommends adoption of the Ordinance. Respectfully Submitted, Approved: Lynn A.
