ITEM I: PUBLIC HEARING: CONDITIONAL USE PERMIT REQUEST FOR AN OFF-
SITE PARKING LOT AT 130 JOSSLYN STREET
GENERAL INFORMATION
Applicant: Ganther Construction / Architecture, Inc.
Owner: Lourdes Academy
Action(s) Requested:
The applicant is requesting a Conditional Use Permit to establish an off-site parking lot.
Applicable Ordinance Provisions:
Off-site parking lot land uses are permitted only through a Conditional Use Permit (CUP) in the
Urban Industrial District (UI) as regulated in Section 30-61(C) of the Zoning Ordinance. Criteria
used for Conditional Use Permits are located in Section 30-382 of the Zoning Ordinance.
Property Location and Background Information:
The subject site consists of a vacant 1.47 acre parcel located on the east side of Josslyn Street,
north of Witzel Avenue. The property currently has four storage buildings and associated
gravel parking area and has an Urban Industrial (UI) zoning designation while the 2040
Comprehensive Land Use Plan recommends Mixed Use use for the site.

ANALYSIS
Use
The applicant is proposing to construct a surface parking lot on the subject site for Lourdes
Academy students and staff. The proposed parking lot will have 96 parking spaces and one
existing storage building will remain to be utilized by Lourdes academy for equipment storage.
The parking lot is on a separate parcel from Lourdes Academy, which requires a conditional use
permit as off-site parking lot is a conditional use in the UI district.

The parking lot will have two access driveways off of Josslyn Street. The plans also include
preserving one existing storage building toward the rear of the lot.

The proposed parking lot will meet setback requirements for the UI district. The total proposed
impervious surface area for the site is under the maximum. The Department of Public Works
has reviewed the plan and noted that the abandoned driveway aprons in the public right-of-
way will need to be removed.
Signage
The applicant’s submittal does not include signage.
Lighting
A lighting plan has been included with this request. The submitted plan meets the minimum
lighting level of 0.4 fc for all vehicle parking and circulation areas. It appears that lighting
levels may be exceeding the maximum lighting level of 0.5 fc along the north and south
property lines. This can be addressed during the Site Plan Review process. Light fixtures will
be full-cutoff fixtures mounted at 25’ which is within the maximum mounting height for the UI
district.
Storm Water Management
The applicant has been in contact with the Department of Public Works regarding storm water
management for the site. Plans will be required and reviewed during the Site Plan Review
process.
Landscaping
Street frontage, paved area, and bufferyard landscaping points are required for the proposed
parking lot.

Street Frontage
The provided landscaping plan meets the code requirement of 30 street frontage landscaping
points per 100 linear feet of street frontage. The plan is also meeting the requirement that 50%
of the points shall be devoted to medium trees.
Paved Areas
The provided landscaping plan meets the code requirement of 30 yard landscaping points per
10 parking stalls. Code further specifies that 30% of the points shall be devoted to tall trees and
40% devoted to shrubs. Deciduous trees are required at all parking row ends and intermediate
parking lot islands.
The plan meets the tall tree point requirement, but is short of the minimum point requirement
for shrubs. Based on the planting schedule, the applicant has attributed too many points
toward perennial plantings provided in the bio filtration areas. The plan is also missing
required deciduous trees at 8 parking row ends. These items can be addressed during the site
plan review process.
Bufferyard
A 0.4 opacity bufferyard is required along the north property line as the site is abutting an MR-
12 zoning district. The applicant is providing sufficient evergreen tree landscaping along with a
6’ solid fence along with a 10’ setback to meet this requirement. The applicant is also providing
at least 50% of the required points on the exterior side of the fencing per bufferyard
requirements.
RECOMMENDATION/CONDITIONS
In its review and recommendation to the Common Council on an application for a Conditional
Use Permit, staff recommends the Plan Commission make the following findings based on the
criteria established by Chapter 30-382 (F)(3):
(1) Is in harmony with the Comprehensive Plan.
(2) Would not result in a substantial or undue adverse impact on nearby property, the
character of the neighborhood, environmental factors, traffic factors, parking, public
improvements, public property or rights-of-way, or other matters affecting the public
health, safety, or general welfare.

(3) Maintains the desired consistency of land uses, land use intensities, and land use
impacts as related to the environs of the subject property.
(4) The conditional use is located in an area that will be adequately served by, and will not
impose an undue burden on, any of the improvements, facilities, utilities or services
provided by public or private agencies serving the subject property.
(5) The potential public benefits outweigh any potential adverse impacts of the proposed
conditional use, after taking into consideration the applicant’s proposal and any
requirements recommended by the applicant to ameliorate such impacts.
Staff recommends approval of the proposed Conditional Use Permit for an off-site parking lot at
130 Josslyn Street as proposed with the findings listed above.

Conditional Use Project Narrative
The project area consists of a 1.46 acre parcel on the east side of Josslyn Street, north of Witzel Avenue.
The property is currently utilized for storage with multiple buildings and a gravel lot, zoned urban
industrial (UI). Neighboring properties are zoned Residential (MR-12 to the north), Urban Industrial
(south and east), and Institutional (west). The owner, Lourdes Academy, is proposing the construction
of a surface parking lot for students and staff with one of the buildings to remain for Lourdes equipment
and storage needs. The project will provide 96 parking spaces with access to Josslyn Street, traffic
generation is not deemed to have significant change with use associated to general school hours and
evening post-school activities. The traffic and parking advisory board will review for a mid-block
crosswalk for pedestrians. The side yard adjacent to multi-family (north) will have a fence/landscape
bufferyard with other parking lot landscaping and lighting upgrades. Overall, the impervious surface will
be reduced from that of the existing condition with onsite post construction stormwater management
controls.
