PURPOSE: DECLARE END TO EMERGENCY FOR WAIVING BIDS &
APPROVE CLOSURE OF THE 600 BLOCK OF WEST 9TH AVENUE
INITIATED BY: PUBLIC WORKS DEPARTMENT
WHEREAS, on June 21, 2021, in accordance with Sections 2-20(D) and (E) of the
City of Oshkosh Municipal Code and §62.15(1b) of the State of Wisconsin Statutes, the
City Manager declared an emergency for the purpose of authorizing the waiving of bids
and the closure of 600 block of West 9th Avenue and signed an Emergency Declaration
formalizing that action; and
WHEREAS, the actions of the City Manager and staff have adequately addressed
the emergency and there is no longer a need for the emergency declaration to remain in
effect.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the actions of the City Manager and staff in response to the Emergency are
hereby ratified and affirmed.
BE IT FURTHER RESOLVED that Emergency declared on June 21, 2021, for the
purpose of authorizing the waiving of bids and the closure of 600 block of West 9th
Avenue is hereby ended.

RE: Approve Resolution to Declare End to Emergency for Waiving Bids and Approving
Closure of the 600 Block of West 9th Avenue
BACKGROUND
On June 21, 2021, City Manager, Mark Rohloff, in accordance with Section 2-20(C) of the Municipal Code
and §62.15(1b) of the State of Wisconsin Statutes, signed an Emergency Declaration declaring an
emergency for the purpose of authorizing the waiving of bids and the closure of the 600 block of West
9th Avenue. In June 2021, it was discovered that the public portion of the water service at 643 West 9th
Avenue was leaking. The service was determined to be make of lead, which, per the City of Oshkosh’s
Municipal Code, requires a full replacement of the service. The Municipal Code also requires West 9th
Avenue to remain open at all times. In order to prevent endangering the health, safety, and welfare of
the resident of 643 West 9th Avenue, the City’s Water Distribution Division crew performing the repair,
and the traveling public, an emergency was declared so there would be no delay in replacing the water
service at 643 West 9th Avenue and so it could be completed in a safe and efficient manner.
ANALYSIS
Pursuant to the Declaration of Emergency, the replacement of the water service at 643 West 9th Avenue
was completed. There is no longer a need for the emergency declaration. Therefore, it is necessary for
the Council to declare an end to the emergency.
FISCAL IMPACT
There is no fiscal impact to this resolution. The costs for the replacement of the water service totaled
$7,752.90. Funds were available within the 2021 Water Utility 2021 Operating Budget (Account No.
05411867-6401-08675 / Water Distribution Exp/Mainten-Contractual Services-Maint-Services).
RECOMMENDATIONS
It is recommended the Council pass the Resolution declaring an end to the Emergency declared on June
21, 2021 for the purpose of waiving bids approving closure of the 600 block of West 9th Avenue.
