HomeMy WebLinkAboutItem IIITEM II-1811 Oshkosh Ave- Design Standards Variance 1 PLAN COMMISSION STAFF REPORT JULY 20, 2021 ITEM II: RESIDENTIAL DESIGN STANDARDS VARIANCE TO ALLOW A FRONT DOOR OPENING REDUCTION AT 1811 OSHKOSH AVENUE GENERAL INFORMATION Applicant Ronecka and Donald Brunner Owner: Ronecka and Donald Brunner Action(s) Requested: The applicant is requesting approval of a variance from the City’s Residential Design Standards to allow a front door opening reduction at 1811 Oshkosh Avenue. Applicable Ordinance Provision the Variance is being requested: Code Reference Regulation Section 30-241(B)(3) Existing door openings on front façades shall not be closed or filled. Property Location and Background: Page 1 ITEM II-1811 Oshkosh Ave- Design Standards Variance 2 The subject property is a residential lot located at 1811 Oshkosh Avenue is approximately 22,980 square feet in area (.5275 acres). The property is located on the south side of Oshkosh Avenue, in between N Westfield St and N Koeller St. The property contains a 2116 square foot 2 story two-family residential structure (duplex) with a detached garage, which were built in 1920 and 2000 according to the City of Oshkosh Assessor website. The surrounding area consists primarily of single-family uses, with the exception being to the north. The property to the north, across Oshkosh Ave, is a current corporate business park redevelopment area. The subject property and the properties on the south, east, and west are zoned Single-family Residential-5 (SR-5). The properties to the north are zoned Corporate Business Park – Planned Development (CBP-PD). The owner plans to install a new front door that is smaller in size than the original front door. A replacement door that is the same dimensions as the original is no longer a common option and would require a custom order. Applicable ordinance prohibits front door opening reductions on front facades and this work would involve a front door opening reduction. Therefore, Plan Commission review and a design standards variance are necessary. Subject Site Existing Land Use Zoning Single-family Residential SR-5 Recognized Neighborhood Organizations None Adjacent Land Use and Zoning Existing Uses Zoning North Corporate Business Park – Planned Development CBP-PD South Single-family Residential SR-5 East Single-family Residential SR-5 West Single-family Residential SR-5 Comprehensive Plan Land Use Recommendation Land Use 2040 Land Use Recommendation Light Density Residential VARIANCE CRITERIA The City’s Zoning Ordinance establishes design standards for single and two-family homes with the overall purpose/intent to: “Maintain the basic architectural quality of residences within the community, to minimize adverse impacts on adjacent properties and neighborhoods resulting from architectural and building construction practices that may detract from the character and appearance of the neighborhood as a whole, and to ensure compatible design between existing and new homes.” Page 2 ITEM II-1811 Oshkosh Ave- Design Standards Variance 3 The standards apply to all single and two-family structures within the City and include the regulation that “Existing door openings on front façade shall not be closed or filled.” The work proposed will not significantly reduce the door area on the front façade. The Plan Commission is authorized to grant variances from the strict application of the standards when it is determined that one or more of the following apply: 1. The variance will not be contrary to the public interest. 2. Substantial justice will be done by granting the variance. 3. The variance is needed so that the spirit of the ordinance is observed. 4. Due to special conditions, a literal enforcement of the provisions of the Zoning Ordinance will result in unnecessary hardship. 5. The variance will not allow an alteration of a historic structure, including its use, which would preclude its continued designation as a historic structure. ANALYSIS The above image shows the Oshkosh Ave facing façade on the subject property. The applicant proposes reducing the front door opening on this façade. Page 3 ITEM II-1811 Oshkosh Ave- Design Standards Variance 4 The above images show the old door and the proposed new door that has an overall smaller opening. The owner would like to change out this door due to a prior occurrence where the door was kicked in, which caused large gaps between the door and the frame. The owner explained that these gaps allow for extensive heated and cooled air loss because the door no longer properly fits as it should. Staff calculated the difference between the current and proposed door area on the façade and found that the new door is roughly 8% smaller in size. 1811 Oshkosh Ave Front Door Existing Proposed % Change Door Area 21.75 sq. ft. 20 sq. ft. -8% 87” 36” 36” 80” Page 4 ITEM II-1811 Oshkosh Ave- Design Standards Variance 5 Staff researched local door options and found that an 87” tall door is no longer a common sized door and, as the owner stated in the application, would in fact require a special custom order. In working with the owner, staff considered:  Potential impact of the completed modifications on the architectural integrity of the home  Potential impact on neighborhood character  Whether the proposed work met the intent of the Residential Design Standards Staff considers the front door opening size reduction to be a change to an existing building under the zoning ordinance. Per Section 30-241(D)(1) a change includes any alteration to existing architectural features (in this case, a door) on a front façade. After evaluating the petitioner’s application, examining the property and surrounding context, staff is of the opinion that the proposed work will not have a significantly detrimental impact on the architectural integrity of the front façade and house overall. RECOMMENDATION Staff recommends approval of a variance from the City’s Residential Design Standards to allow for door opening reductions on the front façade with the following finding: Finding: 1.
