PURPOSE: APPROVE GENERAL DEVELOPMENT PLAN FOR EXPANSION
OF A MULTI-FAMILY DEVELOPMENT AT 2750 MINERVA
STREET

WHEREAS, the Plan Commission finds that the General Development Plan for
expansion of a multi-family development at 2750 Minerva Street, is consistent with the
criteria established in Section 30-387 of the Oshkosh Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that a General Development Plan for expansion of a multi-family development
at 2750 Minerva Street, per the attached, is hereby approved with the following condition:
1. Approval of the revised 16-unit building presented at the June 1, 2021 Plan
Commission meeting.

BACKGROUND
The applicant requests approval of General Development Plan to allow for expansion of a multi-
family development. The subject area consists of an approximately 2.44 acre parcel located on
the east side of the Minerva Street (north) terminus. The site currently has two 8-unit apartment
buildings, built in 2007, and associated surface and garage parking areas. The surrounding area
consists of multi-family residential uses to the south, single family uses to the west, and
vacant/agricultural lands to the north and east. The 2040 Comprehensive Land Use Plan
recommends medium and high density residential use for the subject area.
ANALYSIS
The proposed expansion of the site will include one 16-unit building, for a total of two 8-unit
apartment buildings and one 16-unit building on the site. The applicant is requesting a base
standard modification (BSM) to allow for 32 units, where the maximum density for the site is 29
units (3,600 square feet of lot area per unit). Staff is supportive of the increased density as the
proposed use is consistent with the 2040 Comprehensive Land Use Recommendation of medium
and high density residential use for the site. The applicant intended to develop the subject area
as a phase II following the 2007 development. The zoning ordinance at that time would have
allowed for a density of 34.9 units.
The site currently has one access off of Minerva Street, which will remain as the only access
point. During the Plan Commission meeting the applicant identified potential solutions for
adding code compliant recreational spaces, which had previously been a Plan Commission
concern. The existing site has currently has 40 parking stalls (24 garage units, 16 open stalls). A
total of 30 new parking stalls will be added with the site expansion (11 garage units, 19 open
stalls), for a total of 70 parking stalls. A BSM is being requested as the provided number of stalls
is slightly under the minimum of two spaces per dwelling unit containing 0-2 bedrooms, plus
0.5 space per additional bedroom over two bedrooms per unit and one guest parking space for
every three dwelling units. All base standard modification requests will be addressed as part of
the SIP submittal.

FISCAL IMPACT
Approval of this project should result in an increase in the assessed property value for the site.
The developer is anticipating spending approximately $1 million on the project.
RECOMMENDATION
The Plan Commission recommended approval of the general development plan with conditions
on June 1, 2021. Please see the attached staff report and meeting minutes for more information.

Residential
ANALYSIS
Use
The proposed expansion of the site will include two new 8-unit apartment buildings, for a total
of four 8-unit apartment buildings on the site. The 8-unit apartment buildings are permitted in
the MR-12 district. The applicant is requesting a base standard modification (BSM) to allow for
32 units, where the maximum density for the site is 29 units (3,600 square feet of lot area per
unit). Staff is supportive of the increased density as the proposed use is consistent with the 2040
Comprehensive Land Use Recommendation of medium and high density residential use for the
site.
The applicant has noted that they had intended to develop the subject area as a phase II
following the 2007 development. The zoning ordinance at that time would have allowed for a

The proposed plans were discussed at a Plan Commission workshop on May 4, 2021. Plan
Commission was supportive of expansion of the multi-family use, but had concerns of lack of
recreation area for tenants.

Site Design/Access
The site currently has one access off of Minerva St., which will remain as the only access point.
The total impervious surface ratio for the site will be about 65%, which is over the maximum of
60% for the MR-12 district, and will require a BSM.
A BSM is also needed for recreation area not being provided, where code requires a minimum
recreation area of 200 sq. ft. plus 25 sq. ft. per bedroom. The site currently does not have any
recreation area and the expansion plans do not include recreation area. As previously noted,
Plan Commission voiced concerns of lack of recreation area on site and in the surrounding area.
The existing site has currently has 40 parking stalls (24 garage units, 16 open stalls). A total of 30
new parking stalls will be added with the site expansion (11 garage units, 19 open stalls), for a
total of 70 parking stalls. A BSM is being requested as the provided number of stalls is slightly

Staff has concerns of the requested increased impervious surface and lack of recreation area
resulting from the two proposed multi-family buildings. The applicant has the option to
modify their plans for only one new multi-family building with 8-16 units, which could serve to
meet the impervious surface requirement and provide space for recreation area.
Staff is supportive of the reduced parking as it is only slightly under the maximum and should
be sufficient to meet parking demands of the tenants. All base standard modification requests
will be addressed as part of the SIP submittal.
Signage
No signage plans were included with this request.
Landscaping
ITEM III B: GDP 2750 Minerva St. 4
The submitted plans did not include a landscaping plan. The applicant will need to meet all
landscaping requirements or apply for base standard modifications as part of the SIP process.
Storm Water Management/Utilities
A preliminary storm water management plan was included with this request. The Department
of Public Works has noted that the site will be subject to requirements of Chapter 14 of the City
of Oshkosh Municipal Code Storm Water Management. This will be addressed during the SIP
and Site Plan Review processes.
Site Lighting
Lighting plans for the site have not yet been submitted. Lighting plans will be required to be
submitted as part of the SIP request.
Building Facades
Building elevation plans were included with this request and will match the appearance of the
existing two buildings on the site. Staff does not have concerns with the proposed elevations as
they appear to be compliant with multi-family exterior design standards and are consistent with
the existing buildings on the site.
FINDINGS/RECOMMENDATION/CONDITIONS
In its review and recommendation to the Common Council on an application for a Planned
Development district, staff recommends the Plan Commission consider findings based on the
criteria established by Chapter 30-387 (C)(6):
(a) The proposed Planned Development project is consistent with the overall purpose
and intent of this Chapter.
(b) The proposed Planned Development project is consistent with the City’s
Comprehensive Plan and other area plans. (It is the responsibility of the City to
determine such consistency.)
(c) The proposed Planned Development project would maintain the desired
relationships between land uses, land use densities and intensities, and land use impacts
in the environs of the subject site.
(d) Adequate public infrastructure is or will be available to accommodate the range of
uses being proposed for the Planned Development project, including but not limited to
public sewer and water and public roads.
(e) The proposed Planned Development project will incorporate appropriate and
adequate buffers and transitions between areas of different land uses and development
densities/intensities.
(f) The proposed Planned Development project design does not detract from areas of
natural beauty surrounding the site.
(g) The proposed architecture and character of the proposed Planned Development
project is compatible with adjacent/nearby development.

(h) The proposed Planned Development project will positively contribute to and not
detract from the physical appearance and functional arrangement of development in the
area.
(i) The proposed Planned Development project will produce significant benefits in terms
of environmental design and significant alternative approaches to addressing
development performance that relate to and more than compensate for any requested
exceptions/base standard modifications variation of any standard or regulation of this
Chapter.
Staff recommends Plan Commission recommend the appropriate scale of development for the
proposed General Development Plan with one of the following options:
1) Denial of the proposed two 8-unit buildings.
2) Approval of the proposed two 8-unit buildings.
3) Approval of one 16-unit building.
4) Approval of one 12-unit building.
Final development plans and appropriate Base Standard Modifications will need to be
addressed during the Specific Implementation Plan (SIP) process.
The Plan Commission approved the general development plan with conditions on June 1, 2021.

Mr. Slusarek presented the item and reviewed the site and surrounding area as well as the land
use and zoning classifications in this area. The applicant requests approval of General
Development Plan to allow for expansion of a multi-family development.
Staff recommends Plan Commission recommend the appropriate scale of development for the
proposed General Development Plan with one of the following options:
1) Denial of the proposed two 8-unit buildings.
2) Approval of the proposed two 8-unit buildings.
3) Approval of one 16-unit building.
4) Approval of one 12-unit building.
Ms. Propp opened up technical questions to staff.
Mr. Hinz asked the difference in green space between the options.
Mr. Lyons said there is a 2% difference.

Mr. Ford asked if there would be a need for the BSM for the green space.
Mr. Lyons said it will depend on the SIP.
Mr. Mitchell asked if Plan Commission requires the same recreation space for similar buildings
or is there flexibility.
Mr. Lyons said that the code requires it on any multi-family with three buildings or more and
that would be per lot.
Mr. Mitchell asked if there was any possibility of park fees for the developers.
Mr. Lyons said that parkland dedications requirements are only triggered during new CSMs or
Plats. Recreational space and parkland are different and recreational space cannot accept any
fee in lieu of.
Mr. Mitchell said that the model had front yard space has recreational space and wanted to
know of similar developments.
Mr. Lyons said that this is unique to this area. Recreational space can between the front building
setback line and the front of the building. There are not a lot of buildings that exceed the setback
like this. The ordinance does talk about preferred uses of recreational space. This would not
apply to front yard recreational space. They can achieve total recreational space from multiple
spaces.
Mr. Mitchell asked if there was a way to permit a playground or swing set in the front yard.
Mr. Lyons said that it could go through plan development of BSM to allow in front yard.
Ms. Propp asked for any public comments and asked if the applicant wanted to make any
statements.
Chet Wesenberg from Wesenberg Architects and Homes said they came up with an alternate
plan for 16 units. There was discussion about a 12 unit plan, but it would not be efficient. This
will help with the recreational area and parking spaces.
Mr. Wesenberg said originally there was an 18 unit plan approved for this site. Zoning was
changed to the current zoning it is today. The original zoning would’ve allowed 34 units. The
new 16 unit plan will be moved approximately 24 feet which will provide additional
recreational lawn as well as enhanced landscaping along the shared property line with the
shared single family home.
Ms. Propp asked to describe the 16 unit plan.
Mr. Wesenberg said the new plan will be 8 one bedroom units and 8 two bedrooms units.

Mr. Hinz asked what the enhanced landscaping would include.
Mr. Wesenberg said spruce trees and arborvitaes would be a part of the plan.
Mr. Hinz asked how deep the water for the retention pond would be.
Mr. Wesenberg said that wasn’t determined yet.
Mr. Mitchell asked about the handicap accessibility in the units.
Mr. Wesenberg all the first floor units will be handicap accessible. The code requires one unit to
be type A accessibility which is a higher need of accessibility and the remaining units will be
type B. Type B requires clear floor space in front of plumping fixtures and all first floor units
have zero step entry.
Mr. Mitchell asked about the rental range.
Mr. Wesenberg said it will be between $800-900.
Mr. Mitchell asked what the vision is for the recreational area.
Mr. Wesenberg said the front will be mowed lawn. The area to the north will have swing sets,
sandbox something to that nature.

Mr. Coulibaly asked if there was a difference in approving the 16 unit building versus the two 8
unit buildings.
Mr. Lyons said that there is a greater degree of recreational space for the revised 16 unit
building versus the two 8 unit buildings.

Proposed GDP- written description
Zoning Map Change Request:
A zoning Map amendment is requested to change current zoning from MR-12 to MR-12 PD to allow review of the proposed property to be
conducted as a Planned Development. A portion of Parcel #1230090000 was formerly developed with multifamily apartments with the intent to
develop the remaining portion later. Since that time the zoning district has changed. A PD district is needed to allow the PD process to review
compliance issues resulting from the zoning change.
GDP:
General project themes and images:
The existing parcel was formerly developed with two (8) unit apartment buildings and one (24) stall tenant garage building on its south portion with
the intent to construct additional apartments to the north in the future. This development proposes an additional two (8) unit apartment buildings
and one (11) stall tenant garage at the currently undeveloped north portion of the parcel.
General mix of Dwelling Unit types and/or land uses:
The existing apartment buildings consist of (16) two-bedroom dwelling units and (24) detached tenant garage stalls. The development proposes an
additional (16) two-bedroom dwelling units and (11) detached tenant garage stalls.
Approximate residential densities and nonresidential intensities as described by dwelling units per acre:
There are no non-residential intensities proposed. The development proposes to create a parcel resulting in 13.38 dwelling units per acre.
General treatment of natural features, including parkland:
Generally, the site is intended to be engineered to provide the required storm water management treatment and meet the City of Oshkosh landscape
requirements.
General relationship to nearby properties and public streets:
At the north end of Minerva Street, the development proposes to add two (8) unit apartment buildings at the east side of the street. On the same
side of the street extending southward, there are currently four existing (8) unit apartments with the same relationship to Minerva Street. There are
no other public streets adjacent to the proposed development.

Proposed exceptions from the requirements of the Zoning Ordinance:
• The current zoning of the parcel is proposed to be changed from an MR-12 to an MR-12 PD. An MR-12 PD normally allows a density of up
to twelve units per acre, the development proposes 13.38 units per acre.
• The parcel currently supports three buildings and the development proposes three more.
• The development proposes to bring the total dwelling units on site to (32) two-bedroom units. With garage stalls and exterior parking
stalls, there are (70) proposed parking stalls.
