HomeMy WebLinkAbout10. 21-302JUNE 8, 2021 21-302 RESOLUTION (CARRIED___6-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: AMEND POLICY FOR SPECIAL ASSESSMENTS RELATIVE TO FIFTY PERCENT REDUCTION ON REAR SIDE STREET FRONTAGE OF ANY LOT THAT ABUTS THREE STREETS INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh that the following amendment to the Policy for Special Assessments is approved: Page 3, Section I (B)(3) Add: 1. For any corner lots, the assessment rate would be reduced by 50% on the long side of the lot, as platted, up to a maximum deduction of 75 lineal feet. The short side of the lot, as platted, shall pay 100% of the assessment rate. For any lot which abuts two (2) streets and has a third side with frontage abutting an alley, the assessment rate shall be reduced by 50% on the alley side of the lot. (Res. #08-300). For any lot which abuts three (3) streets, the assessment rates shall be reduced by 50% on the rear side street frontage. BE IT FURTHER RESOLVED that these changes shall be effective for all projects beginning on or after the date of passage of this resolution. I:\Engineering\Tracy Taylor\Memos to Mayor & Common Council\2021\Amend Special Assess Policy-50% Reduction-3-Side Abument_6-3-21.docx Page 1 of 1 TO: Honorable Mayor and Members of the Common Council FROM: James Rabe, Director of Public Works DATE: June 3, 2021 RE: Amend Policy for Special Assessments Relative to Fifty Percent Reduction on Rear Side Street Frontage of Any Lot that Abuts Three Streets BACKGROUND Currently, the City of Oshkosh’s (City) Policy for Special Assessments addresses a fifty percent (50%) assessment rate reduction for corner lots and for any lots that abut two (2) streets and an alley. In the Assessments Section of the Policy regarding this reduction, the Policy states “For any corner lots, the assessment rate would be reduced by 50% on the long side of the lot, as platted, up to a maximum deduction of 75 lineal feet. The short side of the lot, as platted, shall pay 100% of the assessment rate. For any lot which abuts two (2) streets and has a third side with frontage abutting an alley, the assessment rate shall be reduced by 50% on the alley side of the lot.” This Section of the Policy does not address lots which abut three (3) streets. ANALYSIS This Policy amendment would address this situation. The Department of Public Works requests the addition of a final sentence of Section I.B.3 to read “For any lot which abuts three (3) streets, the assessment rates shall be reduced by 50% on the rear side street frontage.” FISCAL IMPACT This fiscal impact of this Resolution would be the reduction of assessment costs to property owners whose lots abuts three (3) streets. RECOMMENDATIONS I recommend approval of the proposed amendment to the Special Assessment Policy. Approved: Mark A. Rohloff City Manager
