HomeMy WebLinkAbout29. 21-321JUNE 8, 2021 21-321 ORDINANCE FIRST READING (CARRIED________LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVE CLOSURE OF WISCONSIN STREET FROM CHURCH AVENUE TO WEST IRVING AVENUE AND WEST IRVING AVENUE FROM JACKSON STREET TO WISCONSIN STREET INITIATED BY: DEPARTMENT OF PUBLIC WORKS A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AUTHORIZING A VARIANCE TO SECTION 25-23 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO STREETS TO REMAIN OPEN TO TRAFFIC DURING THE COURSE OF EXCAVATION WORK. WHEREAS, it is necessary to spot repair and remove a hazardous “hump” that has formed near the end of the asphalt pavement on Wisconsin Street and to install pavement patches on West Irving Avenue; and WHEREAS, the City of Oshkosh Municipal Code Section 25-23 requires a passageway of not less than ten (10) feet in the travelled portion of the street to remain open on various streets within the City of Oshkosh, including Wisconsin Street and Irving Avenue; and WHEREAS, a variance from the terms of section 25-23 to close Wisconsin Street and West Irving Avenue for the purpose of providing a safe and secure working environment for the construction crew, operators, and the general public will be necessary; and WHEREAS, the anticipated work will be done the week of July 12th. NOW, THEREFORE the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. The Department of Public Works Streets Division is hereby granted a variance from the provisions of Section 25-23 of the City of Oshkosh Municipal Code to close Wisconsin Street from Church Avenue to West Irving Avenue and West Irving Avenue from Jackson Street to Wisconsin Street for pavement repair subject to the following conditions: JUNE 8, 2021 21-321 ORDINANCE FIRST READING CONT’D A. Street Division shall provide all necessary and required signage for the closure of the street and detour of traffic. B. Street Division shall at least seven (7) days prior to the anticipated closure provide notice through the Department of Public Works construction updates and install advance warning signs for motorists. C. Street Division shall work to minimize the effects of the street closure upon emergency services and the public. D. The Director of Public Works is hereby authorized to take such other action as may be necessary and appropriate in consultation with the Police and Fire Chiefs of the City of Oshkosh to protect the health, safety and welfare of the citizens. SECTION 2. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate temporary signage indicating the closure. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #21-XXX A GENERAL ORDINANCE OF THE CITY OF OSHKOSH TO APPROVE CLOSURE OF WISCONSIN STREET FROM CHURCH AVENUE TO WEST IRVING AVENUE AND WEST IRVING AVENUE FROM JACKSON STREET TO WISCONSIN STREET on June 22,2021. The ordinance allows the temporary closure of Wisconsin Street from Church Avenue to West Irving Avenue and West Irving Avenue from Jackson Street to Wisconsin Street, for purposes of pavement repair. Advance notice of the closure to motorists will be provided. I:\Engineering\Tracy Taylor\Memos to Mayor & Common Council\2021\Street Div Closure-WI St & W Irving Ave Memo_6-3-21.docx Page 1 of 1 TO: Honorable Mayor and Members of the Common Council FROM: James Rabe, Director of Public Works DATE: June 3, 2021 RE: Approve Closure of Wisconsin Street from Church Avenue to West Irving Avenue and West Irving Avenue from Jackson Street to Wisconsin Street BACKGROUND Pavement conditions on Wisconsin Street, just north of Church Avenue, warrant significant spot repair to remove a hazardous “hump” that has formed near the end of the asphalt pavement. Pavement patches on West Irving Avenue, between Wisconsin Street and Jackson Street, are required. In an effort to minimize impacts on the travelling public, the Street Division of the Department of Public Works intends to conduct the repairs to both of these streets at the same time. Section 25-23 of the Municipal Code of the City of Oshkosh requires Wisconsin Street and Irving Avenue (from Elmwood Avenue to Hazel Street) to remain open during excavation. Detour routes will be posted for the duration of the work utilizing approved truck routes. We recognize that local, non-commercial traffic will identify and use different routes around the construction area. Access to properties will be maintained for the duration of the work or individual properties will be notified if driveway access will be restricted. Advanced warning signs will be placed seven (7) days prior to the closure to warn drivers. It is anticipated the work will be done the week of July 12th. However, the work may be delayed if other emergencies occur. ANALYSIS Based on the narrow street width and the excavation limits needed for the repairs, staff determined Wisconsin Street and West Irving Avenue need to be closed to traffic in order to maintain the safety of our workers and the general traveling public. The time frame will be limited as much as possible to minimize the impact to the traveling public. It is anticipated that the work will be completed within a couple of days, depending on cooperative weather and other emergencies that may occur. Additionally, worker safety and driver safety will be compromised during this work, if done under traffic. FISCAL IMPACT There are no fiscal impacts to this ordinance. RECOMMENDATIONS I recommend approval of the request to close Wisconsin Street and West Irving Avenue. Approved: Mark A. Rohloff City Manager
