OVERLAY (MR-12-PD) AT 2570 MINERVA STREET

A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30-
387 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO ZONING DISTRICTS.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 30-387 of the Oshkosh Municipal Code pertaining to
Zoning Districts and the map therein described is hereby amended by changing the
district character of the properties located at 2570 Minerva Street from Multi-Family
Residential 12 District (MR-12) to Multi-Family Residential 12 District with a Planned
Development Overlay (MR-12-PD).
BEING ALL OF LOT 1 OF CERTIFIED SURVEY MAP NUMBER 5167 RECORDED AS
DOCUMENT NUMBER 1217329, WINNEBAGO COUNTY REGISTER OF DEEDS AND
ADJACENT ½ RIGHT-OF-WAY OF MINERVA STREET, ALL LOCATED IN THE
NORTHWEST ¼ OF THE NORTHWEST ¼ OF SECTION 11, TOWNSHIP 18 NORTH,
RANGE 16 EAST, CITY OF OSHKOSH, WINNEBAGO COUNTY, WISCONSIN.
SECTION 2. This Ordinance shall be in full force and effect from and after its
passage and publication.
SECTION 3. Publication Notice. Please take notice that the City of Oshkosh

STREET on June 22, 2021. This ordinance changes the zoning of the properties located at
2570 Minerva Street from Multi-Family Residential 12 District (MR-12) to Multi-Family
Residential 12 District with a Planned Development Overlay (MR-12-PD). The full text of

BACKGROUND
The applicant requests a zone change from the existing Multi-family Residential 12 District (MR-
12) to Multi-family Residential 12 District with a Planned Development Overlay (MR-12-PD).
The subject area consists of an approximately 2.44 acre parcel located on the east side of the
Minerva Street (north) terminus. The site currently has two 8-unit apartment buildings, built in
2005, and associated surface and garage parking areas. The surrounding area consists of multi-
family residential uses to the south, single family uses to the west, and vacant/agricultural lands
to the north and east. The 2040 Comprehensive Land Use Plan recommends medium and high
density residential use for the subject area.
ANALYSIS
The applicant is requesting this zone change to establish a Planned Development Overlay to
provide flexibility to accommodate future development of the subject property. The applicant has
submitted preliminary plans for expansion of the existing multi-family use. Staff is supportive of
the proposed zone change to include a Planned Development Overlay as it will serve to
accommodate future expansion of the vacant portion of the site and provide further review of future
development which is appropriate due to the proximity of the neighboring single family residential
properties to the west.
RECOMMENDATION
The Plan Commission recommended approval of rezone as requested on June 1, 2021. Please see
the attached staff report and meeting minutes for more information.

from one classification to another but relies on the Comprehensive Plan and good planning
principles.

ANALYSIS

addressed as General Development Plan (GDP) review under the subsequent item.
Staff is supportive of the proposed zone change to include a Planned Development Overlay as it
will serve to accommodate future expansion of the vacant portion of the site. The proposed MR-12-
PD zoning designation is also consistent with the 2040 Comprehensive Land Use Plan
recommendation (medium and high density residential). Also, the Planned Development Overlay
will provide further review of future development which is appropriate due to the proximity of the
neighboring single family residential properties to the west.

RECOMMENDATION/CONDITIONS
Staff recommends approval of the zone change from Multi-family Residential 12 District (MR-
12) to Multi-family Residential 12 District with a Planned Development Overlay (MR-12-PD) as
requested.
The Plan Commission approved of the zone change as request on June 1, 2021. The following is
Plan Commission’s discussion on the item.

Mr. Slusarek presented the item and reviewed the site and surrounding area as well as the land
use and zoning classifications in this area. The applicant is requesting this zone change to
establish a Planned Development Overlay to provide flexibility to accommodate future
development of the subject property. The applicant has submitted preliminary plans for
expansion of the existing multi-family use, which will be addressed as General Development
Plan (GDP) review under the subsequent item. Staff recommends approval of the zone change
from Multi-family Residential 12 District (MR-12) to Multi-family Residential 12 District with a
Planned Development Overlay (MR-12-PD) as requested.
Ms. Propp opened up technical questions to staff.

Proposed GDP- written description
Zoning Map Change Request:
A zoning Map amendment is requested to change current zoning from MR-12 to MR-12 PD to allow review of the proposed property to be
conducted as a Planned Development. A portion of Parcel #1230090000 was formerly developed with multifamily apartments with the intent to
develop the remaining portion later. Since that time the zoning district has changed. A PD district is needed to allow the PD process to review
compliance issues resulting from the zoning change.
GDP:
General project themes and images:
The existing parcel was formerly developed with two (8) unit apartment buildings and one (24) stall tenant garage building on its south portion with
the intent to construct additional apartments to the north in the future. This development proposes an additional two (8) unit apartment buildings
and one (11) stall tenant garage at the currently undeveloped north portion of the parcel.
General mix of Dwelling Unit types and/or land uses:
The existing apartment buildings consist of (16) two-bedroom dwelling units and (24) detached tenant garage stalls. The development proposes an
additional (16) two-bedroom dwelling units and (11) detached tenant garage stalls.
Approximate residential densities and nonresidential intensities as described by dwelling units per acre:
There are no non-residential intensities proposed. The development proposes to create a parcel resulting in 13.38 dwelling units per acre.
General treatment of natural features, including parkland:
Generally, the site is intended to be engineered to provide the required storm water management treatment and meet the City of Oshkosh landscape
requirements.
General relationship to nearby properties and public streets:
At the north end of Minerva Street, the development proposes to add two (8) unit apartment buildings at the east side of the street. On the same
side of the street extending southward, there are currently four existing (8) unit apartments with the same relationship to Minerva Street. There are
no other public streets adjacent to the proposed development.

Proposed exceptions from the requirements of the Zoning Ordinance:
• The current zoning of the parcel is proposed to be changed from an MR-12 to an MR-12 PD. An MR-12 PD normally allows a density of up
to twelve units per acre, the development proposes 13.38 units per acre.
• The parcel currently supports three buildings and the development proposes three more.
• The development proposes to bring the total dwelling units on site to (32) two-bedroom units. With garage stalls and exterior parking
stalls, there are (70) proposed parking stalls.
