Warranty Deed is attached hereto as Exhibit A. Oshkosh,WI 54903-1130
2_ The Property that was subject to the aforementioned Warranty Deed 90302600000
is within the City of Oshkosh,Winnebago County,State of Parcel Identification Number (PIN)
Wisconsin,and more particularly described as:
Lots 1,2,and 3 of Block 22 in the plat of the ORIGINAL THIRD WARD,
in the third ward,in the City of Oshkosh,Winnebago County,Wisconsin,
per Leach's map of 1894,excepting therefrom the South 53 feet thereof.
3. The Redevelopment Authority of the City of Oshkosh is the current owner of the Property.
4. The Warranty Deed described above and attached hereto included a reversionary covenant which is fully set
forth in"Rider A"attached to the Warranty Deed,but in summary allowed the purchaser of the Property to
return ownership interest back to the seller for the full purchase price in the event that the Wisconsin
Department of Natural Resources did not approve of the environmental remediation efforts occurring at the
time of the conveyance and close its case file for the referenced remediation efforts.
5. On June 4,2002,the Wisconsin Department of Natural Resources issued a case closure letter pursuant to
NR726 for the Property,which addressed the environmental remediation,efforts that were referenced in the
"Rider A"attached to the Warranty Deed described herein.
6. The Redevelopment Authority acknowledges that the WDNR's issuance of a case closure letter for the
Property that addressed the ongoing environmental remediation at the time of the 2001 Warranty Deed has
resulted in the expiration of the covenant requiring the reversion of the title to the property back to the seller.
7. The Redevelopment Authority in its capacity as a purchaser of the Property further acknowledges that the
expiration of the reversionary covenant renders this covenant null and void.
