ROBERT P. SERWAS, under oath, deposes and states as follows:
1. I am a co-owner of the real property located at 1004 S. Main Street, Oshkosh, Wisconsin,
(the "Property")having the following legal description:
Lots One (1), Two (2) and Three (3), Block Twenty-two (22), according to the
recorded Plat of the Original Third Ward, in the Third Ward, in the City of
Oshkosh, Winnebago County, Wisconsin, per Leach's Map of 1894, excepting
therefrom the South 53 feet thereof.
2. The records on title for the Property reflect that there was an environmental remediation
being done to the Property. As a result, an exception was established in Schedule B-
Section 2 of the title insurance commitment issued by Bay Title as agent for First
American Title with respect to the Property.
3. Through my attorneys, we procured documents from the Wisconsin Department of
Natural Resources, which establish that the remediation was closed. A copy of the
closure letter and other documents related thereto that were provided by the Wisconsin
Department of Natural Resources are attached as Exhibit "A". It should be noted that the
City of Oshkosh was notified of the Department of Natural Resource's actions and
acknowledged the same on May 28, 2002.
4. I make this affidavit for the purpose of causing the title insurance company to release
exception#9 to Schedule B— Section 2 to the title insurance commitment assigned file
number OTI-20471-FA issued by Bay Title, as agent for First American Title.

Dear Mr. Anderson:
The Wisconsin Department of Commerce (Commerce) PECFA Site Review Section has
received all the items required as conditions for closure of the above-referenced site. This site
is now listed as "closed" on the Commerce database and has been included on the Wisconsin
Department of Natural Resources (WDNR) Geographic Information System (GIS) Registry of
Closed Remediation Sites to address residual groundwater contamination above NR 140
Wisconsin Administrative Code enforcement standards.
It is in your best interest to keep all documentation related to the investigation and rernediation
of your site. This information may be needed for future property transactions.
If future site conditions indicate that any remaining contamination poses a threat, and
subsequent information indicates a need to reopen this case, any original claim under the
PECFA fund would also reopen and you may apply for assistance to the extent of remaining
eligibility. If contamination is encountered during routine subsurface work, appropriate
measures must be implemented to assure any residual contamination is managed following all
applicable State of Wisconsin regulations and standards.

Groundwater contamination that appears to have originated on the property located at 1004 S.
Main Street, Oshkosh, Wisconsin has migrated onto your property within the South Main Street
right-of-way (ROW) adjacent to the 1004 S. Main Street Property. The levels of Benzene
contamination in the groundwater on your property are above the state groundwater enforcement
standards found in Chapter NR140, Wisconsin Administrative Code. The Wisconsin Department of
Commerce has granted case closure for this site because the groundwater contaminant plume is
stable or receding, and is expected to degrade naturally over time. Case closure means that the
Department of Commerce will not require any further investigation or cleanup action, other than the
reliance on natural attenuation, or natural degrading of contaminants, over time.
As an affected property owner, you have the right to contact the Department of Commerce to
provide any technical information that you may have that indicates that closure should not be
granted for this site. If you would like to submit information to the Department of Commerce that is
relevant to this closure request, you should mail the information to: Thomas Verstegen,

All properties within the site boundaries where groundwater contamination exceeds chapter NR
140 groundwater enforcement standards will be listed on the Department of Natural Resources'
geographic information system (G1S) Registry of Closed Remedial Sites. The information on the
GIS Registry includes maps showing the location of properties in Wisconsin where groundwater
contamination above chapter NR 140 enforcement standards was found at the time that the case
was closed. This GIS Registry will be available to the public on the Department of Natural
Resources' internet web site.
Should you or any subsequent property owner wish to construct or reconstruct a well on your
property, special well construction standards may be necessary to protect the well from the
residual groundwater contamination. Any well driller who proposes to construct a well on your
property in the future will first need to call the Diggers Hotline (1-800-242-8511) if your property is
located outside of the service area of a municipally owned water system, or contact the Drinking
Water program within the Department of Natural Resources if your property is located within the
designated service area of a municipally owned water system, to determine if there is a need for
special well construction standards.
A copy of the Department closure letter is enclosed for your records. This closure letter is part of
the GIS Registry of Closed Remediation Sites.
