The City's interest arises pursuant to an easement agreement 91230480000,91230480100, dated August 9, 1976, and recorded with the Winnebago 91230490000, 91230490100, County Register of Deeds on November 12, 1976, as Document 91230500000, 91230510000, Number 486775,with the purpose of using the easement for a 91230520000, 91230530000, public sanitary force main. 91230540000, 91230550000, 91230560100,91230560200 3. A copy of the recorded easement is attached and incorporated Parcel Identification Number (PIN) as Exhibit A. A copy of a map identifying the easement to be released is attached and incorporated as Exhibit B. 4. The Property subject to the recorded easement was subsequently platted or otherwise divided through documents recorded with the Winnebago County Register of Deeds which also identified the sanitary force main easement therein. These subsequent divisions are as follows: a. Lots 1-8 of the Rusch&Kienast Plat,Lots 92-98 of the First Addition to Rusch&Kienast Plat, and Lots 148-156 of the Second Addition to Rusch& Kienast Plat. b. Lot 93 of the First Addition to Rusch&Kienast Plat, which includes part of the sanitary force main easement,was subsequently converted to a condominium, specifically Units 2661 (PIN 91229930000, address: 2661 Clover Street), and 2663 (PIN 91229930100, address: 2663 Clover Street) of the CLOVER CONDOMINIUM. c. Lots 148, 149,and 156, of the Second Addition to Rusch& Kienast Plat,which include part of the sanitary force main easement, were subsequently converted to twindominiums, specifically Units 1 (PIN 91230480100, address 2797 Clover Street)and 2 (PIN 912048100, address 2799 Clover Street), of the 2797&2798 Twindominium, and Units 1 (PIN 1230560100, address 2727 Clover Street)and 2 (PIN 91230560200, address 2719/Clover Street),of the 2717-2719 Clover Condominium. 1 March 03, 2021 1 5. The City of Oshkosh releases all right, title, and interest in the real property arising under the recorded easement. While this Release also applies to the easement as shown on subsequent divisions of the Property, including the plats or condominium documents, such releases specific to those divisions will be the subject of separate documents. The City abandons as-is, and releases all right,title, and interest in any and all of its City utilities and facilities that remain within the easement that is being released. The property owner may use or remove any remaining utilities or facilities that have been abandoned, or undertake any other lawful action within the released easement, all at property owner's own risk. 6. This Release does not affect any other easement, agreement,property right, obligation, or encumbrance that is not explicitly identified in this document.
