PURPOSE: AMEND PARKS ORDINANCES TO ADD WILLIAM WATERS
PLAZA AS A PARK AND TO CLARIFY AUTHORITY PERTAINING
TO PARKING AUTHORIZATION WITHIN PARKS

A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 19-2
OF THE CITY OF OSHKOSH MUNICIPAL CODE TO ADD WILLIAM WATERS PLAZA
TO THE LIST OF PARKS; AND REPEALING AND RECREATING SECTION 19-7(K) OF
THE CITY OF OSHKOSH MUNICIPAL CODE TO CLARIFY AUTHORITY
PERTAINING TO PARKING AUTHORIZATION ON GRASS AND TRAILS
WHEREAS, there is need to update certain provisions of the City Municipal Code
pertaining to the City of Oshkosh Parks to add William Waters Plaza to the list of Parks
under the jurisdiction of the Parks Department and to clarify authority pertaining to
parking authorization on grass and trails to allow the Parks Director to delegate such
authority as he/she deems appropriate or is necessary in their absence.
NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as
follows:
SECTION 1. That William Waters Plaza is hereby added to the list of Parks under
the jurisdiction of the Parks Department within Section 19-2 of the City of Oshkosh
Municipal Code.
SECTION 2. That Section 19-7(K) of the City of Oshkosh Municipal Code
pertaining to Zoning Interpretations is hereby repealed and recreated to read as follows:
SECTION 19-7 BOATING REGULATIONS
(K) Parking Prohibited on Grass and Trails
No person shall drive or park any motor driven vehicle or trailer upon the grass
or trail(s) or park any place other than upon the established roadways or parking
lots unless authorized to do so by the Parks Director or designee.

SECTION 3. This ordinance shall be in full force and effect from and after its
passage, and publication.
SECTION 4. Publication Notice. Please take notice that the City of Oshkosh enacted

AUTHORIZATION WITHIN PARKS (A GENERAL ORDINANCE OF THE CITY OF

City’s current ordinances to add William Waters Plaza to the list of Parks under the
jurisdiction of the Parks Department. The ordinance also clarifies authority pertaining to
parking authorization on grass and trails to allow the Parks Director to delegate such
authority as he/she deems appropriate or is necessary in their absence.

RE: Amend Parks Ordinances pertaining to Add William Waters Plaza as a Park and to
Clarify Authority Pertaining to Parking Authorization within Parks
BACKGROUND
William Waters Plaza has been and is continuing to be redeveloped and has been assigned to the Parks
Department and it is therefore appropriate to assign it formally as a park within the City’s code to the
Parks Department.
In addition, occasionally it is necessary to amend ordinances to provide clarity, improve readability or
for other routine matters. Staff makes notation of such suggested revisions and then brings them forward
for Council action. With regard to the Parks ordinance staff is proposing language to clarify authority
pertaining to parking authorization on grass and trails to allow the Parks Director to delegate such
authority as he/she deems appropriate or is necessary in their absence.
ANALYSIS
The ordinance revisions would add William Waters Plaza to the list of parks assigning jurisdiction to the
Parks Department and making rules applicable to parks applicable to the plaza as well. The proposed
revisions would also clarify authority to grant special permission for parking on the grass in the park to
allow the Parks Director to delegate such authority as he/she deems appropriate or is necessary in their
absence. In practice the Assistant Parks Director often is more familiar and handles these requests.
A tracked changes version of the proposed ordinance revisions is attached for comparison.
FISCAL IMPACT
There is no anticipated fiscal impact associated with this ordinance update.
RECOMMENDATION
Staff recommends adoption of the ordinance as proposed.

SECTION 19-2 PARK DEFINITION
As used in this Chapter, the term "park" is defined to mean all lands and water heretofore and
hereafter acquired by the City for park or recreational purposes, or placed under the jurisdiction
of the Parks Department, and includes, without limitation, parks, parkways, greenways,
recreational facilities and structures, and privately owned lands the use of which has been
granted or leased to the City for park, recreational, or like public purposes, including:
