HomeMy WebLinkAbout26. 21-251MAY 11, 2021 21-251 ORDINANCE FIRST READING (CARRIED___7-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVE CLOSURE OF WASHINGTON AVENUE FROM BOWEN STREET TO HAZEL STREET INITIATED BY: DEPARTMENT OF PUBLIC WORKS A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AUTHORIZING A VARIANCE TO SECTION 25-23 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO STREETS TO REMAIN OPEN TO TRAFFIC DURING THE COURSE OF EXCAVATION WORK. WHEREAS, it is necessary to make permanent repairs on the water service lateral within the public right-of-way at 901 Washington Avenue; and WHEREAS, the City of Oshkosh Municipal Code Section 25-23 requires a passageway of not less than ten (10) feet in the travelled portion of the street to remain open on various streets within the City of Oshkosh, including Washington Avenue from Bowen Street to Hazel Street; and WHEREAS, a variance from the terms of section 25-23 to close Washington Avenue for the purpose of providing a safe and secure working environment for the construction crew, operators, and the general public will be necessary; and WHEREAS, the anticipated work will be done the week of May 24th and the closure is anticipated for a period of one to two (1-2) days; and NOW, THEREFORE the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. Water Distribution Division is hereby granted a variance from the provisions of Section 25-23 of the City of Oshkosh Municipal Code to close Washington Avenue from Bowen Street to Hazel Street for the permanent repair of the water service lateral located at 901 Washington Avenue subject to the following conditions: MAY 11, 2021 21-251 ORDINANCE CONT’D A. Water Distribution Division shall provide all necessary and required signage for the closure of the street and detour of traffic. B. Water Distribution Division shall at least seven (7) days prior to the anticipated closure provide notice to the Department of Public Works and install advance warning signs for motorists. C. Water Distribution Division shall work to minimize the effects of the street closure upon emergency services and the public. D. The Director of Public Works is hereby authorized to take such other action as may be necessary and appropriate in consultation with the Police and Fire Chiefs of the City of Oshkosh to protect the health, safety and welfare of the citizens. SECTION 2. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate temporary signage indicating the closure. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #21-251 APPROVE CLOSURE OF WASHINGTON AVENUE FROM BOWEN STREET TO HAZEL STREET on May 11, 2021. The ordinance allows the temporary closure of Washington Avenue from Bowen Street to Hazel Street for the permanent repair of the water service lateral located at 901 Washington Avenue. Advance notice of the closure to motorists will be provided. Gohde, Assistant Director of Public Works DATE: May 6, 2021 RE: Approve Closure of Washington Avenue from Bowen Street to Hazel Street BACKGROUND In March, the Water Distribution Division temporarily repaired a water service lateral leak on the public side of the service at 901 Washington Avenue. This was only temporarily repaired due to the weather at that time. The Water Distribution Division would like to permanently repair this water service at this time. Section 25-23 of the Municipal Code of the City of Oshkosh requires Washington Avenue to remain open during excavation. It is anticipated that it will take one to two (1 – 2) days to complete this work. The street will be temporarily patched upon completion of the lateral replacement. The permanent pavement patch will be completed at a later date, while open to traffic. The Water Distribution Division requests permission to close Washington Avenue in front of the subject property in order to complete this water service repair, while maintaining a safe and secure working environment for the construction crew, operators, and the general public. This is not uncommon, given the equipment and work zone required for completion of this work and the location of the water main in relation to the property and within the right-of-way. A detour route will be posted for the duration of the work. Access to properties will be maintained for the duration of the work or individual properties will be notified if driveway access will be restricted. Advanced warning signs will be placed seven (7) days prior to the closure to warn drivers. It is anticipated the work will be done the week of May 24th. However, the work may be delayed if other emergencies occur. ANALYSIS Based on the excavation limits needed for the repair due to the water main being located on the far side of Washington Avenue from the property, staff determined Washington Avenue needs to be closed to traffic in order to maintain the safety of our workers and the general traveling public. The time frame will be limited as much as possible to minimize the impact to the traveling public. Additionally, worker safety and driver safety will be compromised during this work, if done under traffic. Based on the timeframe requested by the Water Distribution Division, staff is recommending waiving the rules and requests the Council adopts this ordinance on the first reading. RECOMMENDATIONS I recommend approval of the request to close Washington Avenue. I also recommend waiving the rules and adopting this ordinance on the first reading. Approved: Mark A.
