FOR FINAL PHOSPHORUS COMPLIANCE ALTERNATIVE PLAN ($202,710.00) INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized to enter into and take those steps necessary to implement an appropriate professional services agreement with Jacobs Engineering Group, Inc. for professional assistance related to the development of a final phosphorus compliance alternative plan in the amount of two hundred two thousand seven hundred ten dollars ($202,710.00) Acct. Gohde, Assistant Director of Public Works / Utilities General Manager DATE: April 22, 2021 RE: Approve Professional Services Agreement with Jacobs Engineering Group, Inc. (Jacobs) for Final Phosphorus Compliance Alternative Plan ($202,710) BACKGROUND The City of Oshkosh’s (City) Wastewater Treatment Plant (WWTP) has submitted a legal challenge to their Wisconsin Discharge Elimination System (WPDES) permit, which became effective on January 1, 2019. The City is currently negotiating settlement terms with the Wisconsin Department of Natural Resources to receive the final permit. During the previous permit term, the City completed its Preliminary Phosphorus Compliance Alternatives Plan (PCAP). The PCAP included evaluation of optimization of the WWTP’s secondary treatment process; modifications to the WWTP, including the addition of tertiary treatment; and watershed- based compliance approaches to meet potential final permit effluent total phosphorus and total suspended solids requirements. Since completion of the PCAP, the City has been further investigating watershed-based compliance approaches, including water quality trading, the multi-discharge variance, and adaptive management. While the WPDES permit and compliance schedule has not been finalized, the next required step in the City’s current permit compliance schedule is to complete the Final Phosphorus Compliance Alternatives Plan (FCAP). Jacobs was chosen to assist in preparing this plan due to their extensive experience with these types of services and the City’s WWTP, and their assistance with the preparation of the PCAP. ANALYSIS The services to be provided with this agreement include updating compliance alternative background information, testing automated ferric chloride feed, pilot testing tertiary treatment technologies, revising compliance alternatives, selecting compliance strategy, and documenting the FCAP. Public Works staff carefully reviewed the scope of services and the proposed cost, and found that it is in line with the level of effort necessary to complete the project. FISCAL IMPACT The proposed fee is not to exceed $202,710. Funding for these services will come from the 2021 Wastewater Utility Operating Budget (Account #0551940-6450/Disposal Plant-Engineering & Consulting Fees). I have reviewed this agreement and in accordance with Section 12-16 of the Municipal Code, I am hereby recommending the Common Council approve the award of this professional services agreement.
