HomeMy WebLinkAbout02. 21-167APRIL 13, 2021 21-167 RESOLUTION PURPOSE: APPROVE AMENDMENT TO COMMUNITY DEVELOPMENT BLOCK GRANT 2020 ANNUAL ACTION PLAN FOR CARES ACT ROUND 3 FUNDING; ACCEPT AND AWARD CARES ACT ROUND 2 FUNDS FROM STATE OF WISCONSIN DEPARTMENT OF ADMINISTRATION INITIATED BY: COMMUNITY DEVELOPMENT DEPARTMENT PLAN COMMISSION RECOMMENDATION: Approved Determination of Consistency WHEREAS, on March 27, 2020 the Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public Law 116-136, was signed into law to respond to growing effects of a public health crisis; and WHEREAS, the CARES Act made funds available as Community Development Block Grant Coronavirus (CDBG-CV) funds to entitlement communities; and WHEREAS, the City of Oshkosh was awarded $292,664 in Round 3 CARES Act funds from the US Department of Housing and Urban Development (HUD) and the CARES Act requires that the City amend its approved CDBG 2020 Annual Action Plan, as amended, to include these funds; and WHEREAS, the City is recommending funding to organizations identified on the attached Exhibit A in the amount of $292,664 in Round 3 HUD funds, and that the CDBG 2020 Annual Action Plan be amended to include these programs and activities to prevent, prepare for and respond to COVID-19; and WHEREAS, the State of Wisconsin Department of Administration (DOA) has CDBG-CV2 CARES Act Round 2 funds available to Wisconsin entitlement communities and Oshkosh is eligible for a grant award of $210,269.89 for public service programs and activities to prevent, prepare for or respond to the COVID pandemic; and (CARRIED__6-1P__LOST________LAID OVER________WITHDRAWN________) APRIL 13, 2021 21-167 RESOLUTION CONT’D WHEREAS, proposed programs and activities to be carried out by the City with the DOA CDBG-CV2 funds must be consistent with the HUD CDBG-CV Round 1 and Round 3 programs and activities and the City’s Annual Action Plan, as amended. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the Council hereby approves of the proposed amendment to the CDBG 2020 Annual Action Plan to include programs and activities to be funded with Round 3 CDBG-CV funds in the amount of $292,664, per the attached “Exhibit A”, contingent upon final approval by the US Department of Housing and Urban Development; and the proper City officials are hereby authorized and directed to file and execute any and all necessary documents and assurances required by HUD. BE IT FURTHER RESOLVED that the proper City officials are hereby authorized and directed to request CDBG-CV2 funds from the State of Wisconsin Department of Administration for programs and activities to prepare, prevent or respond to the COVID pandemic, as noted on the attached “Exhibit A”, contingent upon final approval by the Wisconsin Department of Administration, and that said proposed public service programs/activities to be funded are consistent with the City of Oshkosh CDBG 2020 Annual Action Plan, as amended, and the City hereby accepts said funds from the State of Wisconsin for said purpose, and the proper City officials are hereby authorized and directed to file and execute any and all necessary documents and assurances required by the Wisconsin Department of Administration. BE IT FURTHER RESOLVED that the proper City officials are hereby authorized to carry out all actions necessary to implement the City’s obligations under the terms of these grant agreements. EXHIBIT A ROUND 2 CDBG-CV2 WISCONSIN DEPARTMENTT OF ADMINISTRATION ROUND 3 CDBG-CV US DEPARTMENT OF HOUSING & URBAN DEVELOPMENT TO: Honorable Mayor and Members of the Common Council FROM: Darlene Brant, Grants Coordinator, Community Development DATE: April 8, 2021 RE: Approve Amendment to Community Development Block Grant 2020 Annual Action Plan for CARES Act Round 3 Funding; Accept and Award CARES Act ROUND 2 Funds from State of Wisconsin Department of Administration BACKGROUND Earlier this year Council approved an amendment to the 2020 CDBG Annual Action Plan to increase the Action Plan and award funds in the amount of $494,757 under Round 1 of the CDBG-CV funding. Staff is now requesting approval of a second amendment to the 2020 CDBG Annual Action Plan to include Round 3 funds from the US Department of Housing and Urban Development (HUD) in the amount of $292,664. Staff is also requesting Council accept and award $210,269.89 in CDBG-CV2 CARES Act Round 2 funds from the Wisconsin Department of Administration (DOA) to be awarded to agencies to prevent, prepare for or respond to the COVID pandemic, as well as funds to administer the DOA grant. The Plan Commission held a public hearing on April 6 and recommends Council approve amending the 2020 CDBG Annual Action Plan, accept and award these CARES Act funds. ANALYSIS Oshkosh has received three rounds of funding under the CARES Act to prevent, prepare for or respond to the COVID-19 health crisis. Round 1 funds - $494,757 from HUD Round 2 funds - $210,269.89 from State of Wisconsin, Department of Administration Round 3 funds - $292,664 from HUD Earlier this year Council amended the 2020 CDBG Annual Action Plan to accept and award CDBG-CV Round 1 CARES Act funds from HUD. At that time, staff felt the best approach would be to have the Grant Review Committee recommend funding only utilizing Round 1 funds until the first quarter of 2021 in the event of a public health crisis / pandemic outbreak to ensure the City would have funds available to immediately address the situation. The pandemic situation appears to be stabilizing and staff would like to get the funds into the community to assist those in need so at this time, staff is requesting Council approve the second amendment to the 2020 CDBG Annual Action Plan to include the CDBG-CV Round 3 CARES Act funds in the amount of $292,664. The Grant Review Committee is recommending awards to public service agencies as noted on the attached matrix and staff is recommending grant administration funds and an award to Wisconsin Women’s Business Initiative Corporation (WWBIC) for emergency micro business loans for eligible small businesses impacted by COVID. WWBIC is working with several communities around the State on emergency micro business loans and received excellent recommendations on their administration of such a program. The Wisconsin Department of Administration has CDBG-CV2 CARES Act Round 2 funds available to Wisconsin entitlement communities and Oshkosh is eligible for a grant award of $210,269.89 for public service programs and activities that are consistent with the City’s 2020 CDBG Annual Action Plan, as amended, also to prevent, prepare for or respond to the COVID pandemic. The recommendation is to award funds to public service agencies and grant administration funds as noted on the attached matrix. Staff is recommending Council proceed with accepting both Round 2 funds from DOA and Round 3 funds from HUD at this time to stay in compliance with a July deadline to accept and award both the DOA and HUD funds. FISCAL IMPACT If approved, all Round 3 CDBG-CV HUD funds ($292,664) will be awarded and become part of the City’s 2020 CDBG allocation and Annual Action Plan, as amended. Expenditures will be charged against the CDBG budget A/N 0303-0740 and reimbursed by HUD. A budget amendment request will come before Council at a future date to fund these activities. If approved, all Round 2 CDBG-CV2 DOA funds ($210,269.89) will be awarded and a separate project number setup in A/N 0249-0740 Community Development Special Funds for ease of tracking expenditures and reimbursements. The DOA funds are not part of the CDBG program funding. A budget amendment request will come before Council at a future date to fund these activities. The attached matrix illustrates all three rounds of funding allocations and proposed awards for Rounds 2 and 3. RECOMMENDATION The Plan Commission made a determination of consistency that the proposed projects/ programs to be carried out with CDBG CARES Act funds are consistent with the City’s approved plans and recommended approval of the amendment to the 2020 CDBG Annual Action Plan to allocate $292,664 in Round 3 CDBG-CV funds and acceptance and award of the Wisconsin Department of Administration Round 2 CDBG-CV2 CARES Act funds in the amount of $210,269.89. BACKGROUND Earlier this year the Plan Commission approved an amendment to the 2020 CDBG Annual Action Plan to increase the Action Plan and award funds in the amount of $494,757 under Round 1 of the CDBG-CV funding. Staff is now requesting approval of an amendment to the 2020 CDBG Annual Action Plan to increase the CDBG allocation to include Round 3 funds from the US Department of Housing and Urban Development (H UD) in the amount of $292,664. Staff is also requesting the Plan Commission recommend that Council accept and award $210,269.89 in CARES Act funds from the Wisconsin Department of Administration (DOA) to be awarded to three agencies to prevent, prepare for or respond to the COVID pandemic, as well as funds to administer the DOA grant. Please refer to the table below for a breakdown on funding sources and recommended awards for Round 2 and Round 3. ANALYSIS Oshkosh has received three rounds of funding under the CARES A ct to prevent, prepare for or respond to the COVID-19 health crisis. Round 1 funds - $494,757 from HUD (awards approved in January 2021) Round 2 funds - $210,269.89 from State of Wisconsin, Department of Administration Round 3 funds - $292,664 from HUD Staff solicited proposals from public service organizations in late 2020 to identify the needs in the community to address the pandemic. Twenty-one applications were received. The Grant Review Committee, consisting of members of the Oshkosh Area Community Foundation, United Way, Common Council, and community members, re-reviewed the public service applications received to consider awards under Rounds 2 and 3. A summary of all comments received by the City will be included with the 2020 Action Plan amendment and will be provided to the Department of Administration as well, as part of the agreement to be entered into in this regard. Prior to Council consideration, these plans are reviewed by the Plan Commission for consistency with the City’s Comprehensive Plan, as amended, official maps, and other planned activities of the City and that projects/activities proposed prevent, prepare for or respond to the COVID pandemic. In this regard, staff has reviewed the proposed projects and activities to be carried out with Round 2 funds from the State DOA and Round 3 CDBG-CV funds, and none have been identified as being contrary to the Comprehensive Plan, official maps, or other planned activities of the City and applicable Federal regulations, and the proposed projects/activities to prevent, prepare for, or respond to the pandemic. RECOMMENDATIONS/CONDITIONS Staff recommends approval of amending the 2020 Annual Action Plan to allocate $292,664 in Round 3 CDBG-CV funds from HUD, as noted above, together with a finding that listed projects/activities are not in conflict with the City of Oshkosh Comprehensive Plan, official maps or other planned activities of the City and the proposed projects/activities prevent, prepare for or respond to the COVID pandemic. Staff also asks that the Plan Commission recommend Council accept and award $210,269.89 in CARES Act funds from the Wisconsin Department of Administration (DOA) to be awarded to three agencies to prevent, prepare for or respond to the COVID pandemic, as well as administrative funds to administer the DOA grant, as noted above. The Plan Commission recommended approval of the item as presented at its April 6, 2021 meeting. The following is the Plan Commission’s discussion on this item. Ms. Propp opened up technical questions to staff. Ms. Davey asked what the $22 is for. Ms. Brandt replied that the $22 is to round up the Round 1 funding for ADVOCAP. It is what the committee wanted to do. Ms. Propp opened the public hearing. There were no public comments on this item. Ms. Propp closed the public hearing. Motion by Davey to adopt the findings and recommendation as stated in the staff report. Seconded by Groth. Ms. Propp asked if there was any discussion on the motion. Ms. Propp stated that she did not know Ms. Brandt was retiring and she wanted to acknowledge Ms. Brandt for the work she has done for the City. Motion carried 7-0.
