HomeMy WebLinkAbout37. 21-165MARCH 23, 2021 21-165 RESOLUTION PERTAINING TO INSTALLATION OF CASINGS NEAR THE WISCONSIN AND SOUTHERN RAILROAD IN THE SOUTHWEST INDUSTRIAL PARK AS PART OF CONTRACT 20-02 INITIATED BY: COMMUNITY DEVELOPMENT WHEREAS, the City and Watco Companies have agreed to install casings around the existing utilities near the Wisconsin and Southwest Railroad in the Southwest Industrial Park as part of the contract 20-02 part B project; and WHEREAS, the City and Watco Companies wish to enter into a Memorandum of Understanding setting forth their agreement with respect to installing and paying for the required casings; and WHEREAS, the City will undertake the installation of casings and other protective equipment and Watco will promptly reimburse the City for the costs incurred for the installation of casings and other protective equipment. NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Memorandum of Understanding with Watco Companies is hereby approved and the proper City officials are hereby authorized to execute and deliver the agreement in substantially the same form as attached hereto, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Kelly Nieforth, Economic Development Services Manager DATE: March 18, 2021 RE: Approve Agreement with Watco Companies Pertaining to Installation of Casings near the Wisconsin and Southern Railroad in the Southwest Industrial Park as Part of Contract 20-02 BACKGROUND The City of Oshkosh has leveraged multiple grants to enhance the City’s freight transportation amenities in the City’s Southwest Industrial Park to attract private business investment in the park. Over $2.5 million dollars in grants have been obtained by city staff to construct the transload terminal and improve the access to the northern portion of the Southwest Industrial Park. With the anticipated expansion of rail near the transload terminal, the City is requiring that existing city utilities have casings installed around them in order to protect the City’s utility investment from the proposed rail spurs and industry lead track planned for the park. ANALYSIS The installation of the casings are part of Contract 20-02, which will also construct and pave streets in the industrial park. The City and Watco Companies (owner of Wisconsin and Southern Railroad) wish to enter into a MOU which requires Watco Companies to pay for all costs associated with the installation of casings around City utilities because of the additional tracks. FISCAL IMPACT Watco Companies will pay for the costs to install casings around the City’s water and sanitary pipes near the rail expansion area which will cost approximately $180,889. RECOMMENDATIONS The City Council approves the resolution and authorizes staff to execute the MOU with Watco Companies.
