Adjournment 1 REDEVELOPMENT AUTHORITY MEETING MINUTES January 20, 2021 PRESENT: Jason Lasky, Lori Palmeri, Steve Hintz, Susan Panek, Thomas Belter, Archie Stam, Jack Bermingham STAFF: Allen Davis, Executive Director/Community Development Director; Darlene Brandt, Grants Coordinator; Anna Maier, Administrative Assistant Chairperson Palmeri called the meeting to order at 4:01pm. Roll call was taken and a quorum declared present. The minutes and closed session minutes of November 18, 2020 were approved as distributed. (Hintz, Belter) 21-01 Public Hearing: Approve Submittal of a Revised Community Development Block Grant 2020 Action Plan and Amend Citizen Participation Plan Related to CARES Act Funding No one appeared for the public hearing. Motion by Panek to move Res. 21-01. Seconded by Hintz. Ms. Palmeri asked for confirmation that HUD reduced the public comment time from thirty days to five days. Ms. Brandt replied affirmatively. Ms. Palmeri asked why that was. Ms. Brant replied that HUD lowered the review times so that funding can get out more quickly through the community if there are emergencies or pandemics. Unfortunately that waiver cannot be used for this particular amendment because it is part of this amendment, so the reduced comment period will be on the second and third rounds of funding. Mr. Hintz stated that it was a pretty good list, although some things did not seem to be immediately related to COVID. Some specifically identified COVID activities and others seemed like they could or could not be related to COVID. He asked if the interpretation of federal rules allows for a liberal reading of what is COVID related. Mr. Davis replied that these are related to the pandemic. In the application, they have to show how these projects or programs are related to addressing the pandemic. Rental assistance, for example, 2 is for people who have been unable to work and make rental payments due to COVID. There is a relationship between COVID and the programs. Ms. Brandt stated that all of the applications that staff has received or are considering are to prevent or to prepare for COVID-19 health crisis, so any of the activities being proposed under round one would be eligible. Ms. Palmeri asked if Mr. Hintz was looking at the table of items for round one funding provided. Mr. Hintz replied affirmatively. Ms. Palmeri asked what in particular on the list did not seem COVID related. Mr. Hintz replied that he thought all of them could be related, but he thought that some of them appeared more related than others. The item was called. Motion carried 7-0. 21-02 Approve Revised Land Sale for the Sale of Property along Pioneer Drive and East 7th Avenue to Brooklyn Association of Condominium Owners Motion by Stam to move Res. 21-02. Seconded by Lasky. Mr. Belter asked if there is any reason to believe that there are more tanks to remove beneath the dirt there. Mr. Davis replied that staff worked closely with AECOM to complete phase one and two. He thinks several storage tanks were found to the south, but no more on this particular property. Mr. Lasky asked what they would have to do with RDA being the seller. Mr. Davis replied that there could potentially be more liability and more clean up dollars. DNR is having to monitor for quite a few compounds, so they will have to keep the monitoring wells operating longer than they were anticipating. Mr. Lasky asked for confirmation that RDA is selling the property and owning the environmental liability until it is complete. Mr. Davis replied that he did not recall the timing for the DNR review and any kind of approval for the cleanup. Ms. Brandt stated that RDA can sell the property the way it is as long as they accept it as is. RDA would need to have them grant us an easement where the existing monitoring wells are located 3 until DNR is satisfied with all of the sampling results received and then the easement could be vacated. RDA would have to maintain those monitoring wells and the testing until that time. Mr. Lasky asked if it is currently a condition of the sale that the property is as is. Mr. Davis replied affirmatively, adding that’s why they’re asking for a reduction because they believe they will need to do some additional remediation when they change the parking lot. Ms. Brandt stated that the tank found in the 7th Avenue right of way was unknown. They did not know it was there at the time of demolition until it was unearthed. The same is true for the five underground tanks on 8th Avenue. Mr. Belter asked if phase one is supposed to find the underground tanks by looking through the history of the property. Ms. Brandt replied that phase one does a look at the past uses of the property, but there’s no way to know if, for example, any of the underground tanks from a gas station in the area were removed unless those old permits are somewhere out there. A lot of those were done without appropriate permits, so sometimes it not a known item until they start digging into the ground. Mr. Davis added that sometimes they are concreted or asphalted over and they can’t find it until they remove the concrete, which was the case in this particular location. Mr. Belter replied that it was a hopeful question. Hopefully this is the only tank that is there. Ms. Panek asked if they can ever come back to RDA for another reduction if they find more on the property. Ms. Brandt replied that it’s a possibility, but they probably wouldn’t find anything until they start parking lot improvements, which could be three to five years down the road. They would just be using the concrete asphalt area from the previous parking lot. They may have to do a little digging on the north side into the old railroad and Decades property, but she doesn’t anticipate anything up there other than the normal urban fill and those types of issues there. It’s always a possibility, but they will already own the property by that time, so she’s not sure. Ms. Palmeri asked for confirmation that the PAHs are not the same as PFAS. Ms. Brant replied affirmatively. The item was called. Motion carried 7-0. Listing of RDA Properties Mr. Belter stated that he liked the scattergram that showed where everything was. 4 Mr. Davis replied that the dots were almost all downtown until they started looking at blighted properties in neighborhoods. Otherwise it was mostly the redevelopment areas on Jefferson and the South Shore around 43 East 7th and Pioneer. As a reminder, to actually acquire any scattered sites, they have to go through a blighting process where they have to do an investigation, have a public hearing, and make a determination that it’s blighted before acquiring it. Ms. Panek asked how many properties RDA has owned and sold. Mr. Davis replied that staff could come up with that list as well. It would likely be larger than this list because it would include all the properties from the Marion Road redevelopment. All but maybe the little pocket park that’s contaminated is the only RDA owned property, which will be turned over to the Parks Department. As time has gone by, RDA has sold several parcels off for other developments and will be selling more properties on Jefferson, Sawyer, and Oshkosh Avenue. Otherwise RDA has been marketing individual lots. The RDA still functions as the land bank for redevelopment in the downtown, so that’s why they’re holding on to the Pioneer properties, which is probably ten or twelve properties staff are doing the RFP for right now. Ms. Panek replied that the reason she was asking is because sometimes she thinks that people do not understand the magnitude of what RDA does and this shows what RDA still has to offer. She is just wanting to say that RDA should celebrate that. Mr. Davis replied that they would be happy to compile what RDA has sold. The life cycle is acquisition, sometimes demolition, remediation, and then sale to a private entity, either residential or commercial. Staff could easily come up with that list for the next meeting and it would be a good thing to publicize as Ms. Panek suggested. Ms. Panek replied that she was not suggesting that staff come up with the entire list, but it is pretty neat to know that RDA does so much. Ms. Palmeri asked if the majority of these listings are potential infill development. Mr. Davis replied that he would say 99% of them are. Sometimes RDA ends up with unbuildable portions like the railroad right of way because it was inherited from the City. He doesn’t know if they will ever be able to sell long skinny strips of land to anyone except the adjoining property owners. Ms. Palmeri asked if they have a sense of how much value could be attributable to tax that’s off the rolls currently. Mr. Davis replied that staff could probably have the Assessor do some sort of calculation based on square footage, zoning, and condition. He thinks it is possible to do that, he just hasn’t asked in the past. 5 Executive Director’s Report Mr. Davis provided updates to the RDA. Mr. Belter made a motion for the Redevelopment Authority to convene into Closed Session pursuant to Section 19.85(1)(G) of the Wisconsin State Statutes to discuss the purchase a community garden proposal for 1210 Oregon Street and the purchase of 548 Otter Avenue in the City of Oshkosh. The site is located within the River East Neighborhood Association. Analysis The current owner approached City staff with an interest in selling the property to the City for the amount of $50,000. The assessed value of the property is $94,300 and the fair market value of the property is $106,000. The condition of the structure no longer supports that value. City staff has completed a field inspection and recommends acquisition and eventual demolition. The clean-up of the site would contribute to the neighborhood. The long term plan for the property would be to land bank the property for future redevelopment. The property owner has approached staff regarding acquiring the lot one the structure has been removed. Fiscal Impact The RDA/City would use a portion of the CDBG central city blight elimination funds for acquisition ($50,000) and demolition (estimated up to $10,000). If the site is not acquired, the City will pursue a court order to raze the structure with City funds and the owner would continue to own the lot. The City could be reimbursed for the demolition costs by a future lot buyer. Ongoing maintenance of the parcel would cost about $500/year for grass cutting/snow removal. Recommendation The RDA approves the Spot Blight Designation and approves the acquisition of 548 Otter Avenue for $50,000. Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis, Community Development Director DATE: March 10, 2021 RE: Approve Professional Service Agreement with AECOM for Final Design, Engineering, Permitting and Construction documentation – Pioneer Drive Riverwalk ($260,000) BACKGROUND The City has planned for the construction for this section of Riverwalk for many years, in conformance with the Fox River Corridor Plan. In addition, the City/RDA has also recently released the Request for Proposal (RFP) for the 43 E. 7th Ave site and the proposals are due April 16, 2021. The most recent Riverwalk segments in process are Lakeshore (completed 2020) and Rainbow Memorial Park (to be completed in 2021). The next high priority Riverwalk segment to be completed is Pioneer Drive, from Main Street to the east to the railroad tracks. This will also help connect the existing riverwalk to the Pioneer Island area, Marina and breakwater to the south. The City Council approved the Professional Services Agreement on March 9, 2021. ANALYSIS The proposed Agreement is based on an hourly contract, not to exceed $260,000. Specific elements of the services to be performed for the project are:  Final Construction drawings and Plan Specifications  Permitting – WisDNR and Army Corps of Engineers, as required  Bidding  Construction survey stake out  Construction observation/documentation  Civil/Structural engineering, as needed  Environmental/geotechnical engineering, as needed It is anticipated that the riverwalk construction will be bid this summer, with construction to start in late summer and construction complete, east to the railroad tracks, in late fall. (AECOM) is pleased to provide our proposal for the Pioneer Riverwalk Project. As you know from our past work with the City, AECOM can provide and has extensive experience with planning and design services, as well as successfully taking a river walk project, such as this, from a preliminary concept through a constructed project. The following proposal describes our project understanding, scope of services, and associated fees. Project Understanding The Fox River has long been recognized as a great asset of the City of Oshkosh. Revitalization efforts along the riverfront have been on-going for several years. One focus of the revitalization includes the Riverwalk Bicycle/Pedestrian Trail System (Riverwalk trail system). The Riverwalk trail system is a looped multi-use pathway and Riverwalk system that encompasses both the north and south sides of the Fox River between the Wisconsin Street Bridge and Lake Winnebago. The City has been implementing the Riverwalk trail system by constructing it in controlled, manageable segments. One of the last segments to construct is the Pioneer Drive section which will extend approximately 1,250 feet east from Main Street to just west of the Canadian National (CN) Wisconsin Central Ltd. Railroad crossing. Future projects are intended to continue along Pioneer Drive towards Pioneer Island. Currently, the site is a paved road with grass and other landscaping vegetation adjacent to the road. As part of the Riverwalk project, the roadway itself will be demolished and the Riverwalk will be constructed within the footprint of the roadway. The Riverwalk will consist of a 12 foot wide meandering ADA (Americans with Disability Act) accessible path. Areas of the path will be widened for benches and separate paths may be constructed to provide access to fishing locations. Landscaping will be placed within a 5 to 14 foot zone south of the walkway, to form a buffer between the walkway and future planned private development. Design Considerations Requiring City Concurrence AECOM discussed the project with City staff on March 1, 2021 to review several design elements. The design elements discussed during that call are listed below with the resolution reached. A change in these design elements have the potential to impact the budget and/or schedule, either negatively or positively. 1. In 2020, the City applied for funding through the Knowles-Nelson Stewardship Grant (herein referred to as the 2020 Grant) for this segment of the Riverwalk. The City was unsuccessful in obtaining grant funding, but the City would like to construct the project in 2021. a. Resolution: We understand the City is not interested in preparing another grant application for this portion of the Riverwalk. 2. AECOM understands the City has been working on vacating Pioneer Drive K:\PROPOSAL\City of Oshkosh\OPP-1102005-Pioneer Drive Riverwalk Design and CM\OPP- 1102005_Pioneer Riverwalk Design & CM Proposal.docx 2/10 a. Resolution: The Riverwalk will be able to be constructed within the former roadway. It is acceptable for Pioneer Drive to be demolished between Main Street and the railroad crossing. No additional roadway improvements will need to be designed by AECOM on the north end of Pioneer Drive east of the railroad crossing; the City of Oshkosh is currently evaluating extending 9th Avenue. Shoreline or seawall improvements and associated permitting is not required. AECOM does not need to prepare street vacation documents or a certified survey map (CSM) for the property. CSM documents will be prepared at a later date under a separate contract or change order to this project, if requested. 3. The design will not encroach into the CN Railroad right-of-way. a. Resolution: Project limits should terminate west of the railroad within an acceptable offset so that railroad permitting, and co-ordination is not required. 4. The condition of the concrete pavement for Pioneer Drive is showing signs of its age. AECOM recommends the concrete be crushed and reused as base course for the path as opposed to salvaging portions of the concrete pavement and repurposing it as a Riverwalk. City should confirm the existing roadway should not be salvaged. a. Resolution: Demolition of the road is acceptable. New grading plan will be required for the Riverwalk and surrounding grades. Grading plan does not need to accommodate or tie into existing roadway grades, except at the Main Street intersection or driveway approaches. Project Specifications to include crushing the material as an alternate. Crushed material is already available (Vinton Stockpile) and project documents should indicate utilizing this material first before crushing and reusing on-site material. 5. Geotechnical Engineering services are not required. a. Resolution: AECOM should assume a subsurface exploration will be completed by the City of Oshkosh's 2021 Geotechnical Drilling Firm. AECOM will prepare a scope of work for the City’s contractor as well as a boring location diagram. 6. According to the FEMA Flood Map Service Center, the floodway for the Fox River generally follows the shoreline north of Pioneer Drive, however the 100 and 500-year floodplain encroaches into a portion of the roadway. Final grades should be designed at or near existing with minimal site filling to avoid floodway impacts. a. Resolution: Flood Study is not required to be completed as part of this project. 7. According to the WDNR Surface Water Data Viewer, wetland indicators are present along the south shore of the Fox River within the project area. The WDNR Surface Water Data Viewer wetland indicators are based on soils data, and may not be fully representative of actual wetland impacts. a. Resolution: Since the project area is currently a roadway and the intent of the project is to remove the road and replace with the Riverwalk, AECOM assumes a Wetland Delineation will not be required. Permit documents will include a map from the WDNR Surface Water Data Viewer along with an explanation of the current conditions (pavement) being unsuitable conditions for wetlands. If a wetland delineation is required, schedule impacts are anticipated due to the time of year in which delineations can be performed (during the growing season in Wisconsin). 8. The 2020 Grant design drawings utilized County Contour data. a. Resolution: To minimize project costs, AECOM has assumed the City will perform the site survey to document existing conditions and they will provide a survey basemap in AutoCAD Civil 3D format that can be used as an existing conditions map. The map will, at a minimum, include ground shots and topographical surface shown at 1-foot contour intervals, location of roadway, curbing, driveway approaches, sidewalk, and landscaping, top of bank, Fox River water level on date of survey, underground and overhead utility locations, utility structure locations with invert and rim elevations as appropriate, light pole and other structure locations, center of railroad, property lines, and existing easements. The date of survey, horizontal and vertical datums will also be referenced. 9. The 2020 Grant indicated the Riverwalk would be constructed using Concrete pavement. The City should confirm concrete pavement is preferred over asphalt pavement. Resolution: The City would like the Riverwalk to remain concrete to aesthetically match the other Riverwalk segments in this area. Pavement section details for concrete will be used. Engineering cost estimates will be based on concrete pavement. 10. According to the City of Oshkosh Assessment Services Division Property Records, the property adjacent to Pioneer Drive is currently owned by the City of Oshkosh Redevelopment Authority. However, AECOM understands the City may be in the process of selling this property. Future use of this property will need to be determined. The 2020 concept designs developed for the 2020 Grant incorporated a driveway connection to the parking lot located just east of Main Street (U.S. Route 45) and to the south of Pioneer Drive. a. Resolution: Pioneer Drive should be abandoned up to Main Street. The driveway connection shown in the 2020 Grant drawings can be removed from the project. Although Main Street is a state road, AECOM assumes permitting with WisDOT will not be required, however co-ordination with WisDOT should be anticipated due to the signalized intersection. Based on past experience, AECOM anticipates WisDOT will need approximately 2 weeks to develop a design to accommodate changes to the intersection, however longer scheduling coordination should be anticipated in determining an agreement, such as who will be responsible for funding for the change. AECOM assumes the City has a municipal agreement in place with WisDOT and that City staff will handle co-ordination with WisDOT. AECOM will include a High-intensity Activated Crosswalk (HAWK) System as an alternate bid item for this intersection. 11. The City has considered construction of a Trailhead Parking Lot within the vicinity of the Pioneer Riverwalk. Conceptual drawings were prepared in 2020 near the east end of the Riverwalk segment. a. Resolution: AECOM understands the design, permitting, bidding, and construction schedule for this project will be condensed due to the desire to construct this Riverwalk in 2021. AECOM recommends this Riverwalk project evaluate conceptual locations for a Trailhead parking lot for future tie in, but the actual design of the parking lot, including stormwater management, be considered as a separate project to be constructed in the future. Conceptual locations could include the location proposed in 2020 or utilizing on- street parking if 9th Avenue is extended. 12. Past Riverwalk projects have incorporated new aerial lighting. This segment of the Riverwalk currently has existing streetlights. In an effort to minimize overall project costs, it was recommended to utilize existing streetlights as opposed to installing new lights. a. Resolution: Our scope of services is limited to Civil Engineering. Electrical engineering services related to design of installation of conduit, connectors, fuses, vaults, hand holes, electrical and communication wiring, light poles, and bollards and resulting plan sheets are not included. AECOM understands the City may be interested in solar lighting. AECOM will include solar lighting as an alternate in the bid form and will work with the City Electrical department and Parks department on specifications. 13. Past Riverwalk projects have incorporated lit bollards along the Riverwalk to supplement aerial lighting. As noted in the previous comments, existing lights are proposed to be used as opposed to installation of new lights and wiring. As such, the City may want to consider installation of solar bollards. a. Resolution: Based on previous discussion, we understand the City is still determining the feasibility of maintaining solar bollards. At this time, we assume solar bollards will not be installed as part of this project and this segment of the Riverwalk will not have bollards. However, AECOM will include solar lighting as an alternate in the bid form and will work with the City Electrical department and Parks department on specifications. 14. The City requested to have bid documents prepared within 30-40 days from notice to proceed. The main hurdle is obtaining permits within that timeframe. The permit process with regulatory agencies can take a considerable amount of time. A minimum of 14 days should be anticipated for a review time after submittal to the WDNR. Given past experience, City of Oshkosh site plan review is anticipated to take 2-3 months for approval. Therefore, in order to get bid documents to prospective bidders on schedule, the permitting efforts will likely overlap with the bidding process. a. Resolution: Based on our extensive Riverwalk experience we propose to meet with the regulatory agencies early in the project to discuss the project and verify any concerns they may have with permitting the project. We will discuss solutions and modify the concept plan accordingly in an attempt to expedite the K:\PROPOSAL\City of Oshkosh\OPP-1102005-Pioneer Drive Riverwalk Design and CM\OPP- 1102005_Pioneer Riverwalk Design & CM Proposal.docx 4/10 permit review process. We understand this project will be placed on the next Site Plan Review agenda for discussion. Plans prepared as part of the 2020 Grant will be used to facilitate construction. Furthermore, we anticipate existing storm outfalls can be utilized as is and that upgrades or new outfalls and associated permitting with the WDNR will not be incorporated or required as part of this project. 15. This Riverwalk segment should include installation of the historical railroad portal. a. Resolution: The railroad portal will be installed as close as possible to the railroad line. Final location will take into consideration potential future trailhead parking lot location, extension of 9th Avenue, try to minimize obstructions for future development, and be situated far enough away from the railroad so as not to require permitting from the railroad. The “1899” text will be facing east so that it is legible when walking from the future Pioneer Island segment of the Riverwalk. Scope of Services Based on the above assumptions, the following sections describe our scope of services. Task A: Design Engineering To kick off the project, AECOM recommends holding a stakeholder meeting with City staff to reach concurrence on the items discussed previously in the Design Considerations Requiring City Concurrence section of this proposal. This meeting will use the concept design plans prepared as part of the 2020 Grant application. It is anticipated the proposed Pioneer Riverwalk segment plans will include the following design engineering elements and components.  12-foot wide concrete pavement path, including pavement removal, grading and backfill with bench bump-outs placed in 400-foot intervals.  Two 7-foot wide concrete pavement fishing paths. One adjacent to S Main Street and the other near the CN Railroad  Existing overhead fixtures and wiring will be used in-place. Bollards will not be installed.  Maintain vehicle access to parking lot north of Riverside Endodontic located off Pioneer Drive.  Design for future connection to trailhead parking lot.  Utilize existing stormwater drainage system.  Coordination with utility companies as applicable.  Erosion Control and Site Restoration.  Incorporating future connections of the South Shore Riverwalk and Pioneer Island Riverwalk. Following the stakeholder meeting and upon receipt of the existing conditions basemap prepared by the City, AECOM will develop a plan set which will include plans and details for the Riverwalk. Details will generally be based on the previous Riverwalk construction design standards. AECOM assumes the Pioneer Riverwalk plan set will incorporate the following sheets:  Cover and Sheet Index  Legend and Project Information  Existing Conditions showing overall project  Erosion Control and Demolition (3 close-up sheets)  Proposed Riverwalk Conditions which includes:  1 sheet showing overall project. Conceptual location of trailhead parking lot and future Riverwalk connections will be included.  3 close-up sheets with plan and alignment profile views  Typical cross sections K:\PROPOSAL\City of Oshkosh\OPP-1102005-Pioneer Drive Riverwalk Design and CM\OPP- 1102005_Pioneer Riverwalk Design & CM Proposal.docx 5/10  Civil Details Design of electrical related items are not included in our scope of services; however, AECOM will show proposed locations of solar powered bollards on our drawings so that a contractor can provide an alternate bid cost for them. AECOM assumes site restoration of disturbed area will consist of topsoil, seeding and stabilization and a specific landscaping plan will not be required. Concurrent with design development, AECOM will prepare a geotechnical drilling scope of work and boring location diagram. AECOM will provide this document to the City so that drilling can be completed by the City of Oshkosh's 2021 Geotechnical Drilling Firm. Deliverables: Geotechnical scope of work document. AECOM will provide one (1) set of draft 95% Construction plans for the Riverwalk which will be provided in electronic format to the City for review. These plans will be used for permitting and bidding, concurrently. AECOM has budgeted for one (1) set of consolidated review comments from regulators and bidders. 100% Construction documents which incorporate permitting and bidding comments will be provided in electronic format as the Issued for Construction drawings. Task B: Permitting AECOM anticipates the following permits will be required for this project:  City of Oshkosh Site Plan Review  WDNR Construction Site Storm Water Notice of Intent (NOI) AECOM will schedule a Site Plan Review pre-application meeting with the City of Oshkosh utilizing the conceptual designs prepared in 2020 as part of the Stewardship Grant application. We anticipate the pre-application meeting will be combined with the Stakeholder Meeting discussed in Task A and will be used as a planning workshop to discuss the proposed design criteria and goals of the project early in the design phase of the project. Based on decisions made as part of that meeting, AECOM will prepare designs described in the Design Engineering task. These designs will be used in the application to the City of Oshkosh Site Plan Review and WDNR NOI. Site disturbance is anticipated to be greater than one acre; therefore coverage under the WDNR Construction Site Storm Water Notice of Intent (NOI) permit will be required. An attachment to the Site Plan application and the NOI will be a Storm Water Management and Erosion Control Plan (SWMECP). We anticipate that stormwater management will not be required for the Riverwalk, and that the project will be designed in accordance with criteria set forth in the WDNR Bureau of Watershed Management Program Guidance Runoff Management Policy Management Team Storm Water Management Program’s Design Considerations for Post- Construction Performance Standards for Public Trails near Waterways or Wetlands, dated May 2017. AECOM will prepare an endangered resources review, performed by a Certified ER Reviewer which will be included as an attachment to the NOI. Deliverables: Pre-Application meeting agenda and minutes, Site Plan Application, NOI Application, and associated attachments such as the SWMECP and the Endangered Resources Review. AECOM assumes the City will pay for any review or permit fees that maybe required. Task C: Bidding As has been successfully used on previously Riverwalk project segments, AECOM anticipates that the following items or activities will be developed for the bidding process:  Project Manual (to be uploaded onto the Quest System for distribution to interested bidders). This will contain:  Bidding and Contract Documents (Engineers Joint Contract Documents Committee [EJCDC] and City Standard Specifications will be utilized).  Technical Specifications.  Bid Form. AECOM will provide a draft bid invitation to the City for review and we assume the City will publish this as an advertisement for bids. AECOM will also provide PDF bidding documents which will be uploaded by the City onto the Quest system for distribution to interested bidders. Our bidding documents will assume the City will purchase and install the benches. Deliverables: 95% bidding documents will be provided in electronic format to the City for review. 100% Project bidding documents consisting of one (1) plan set and project manual will be provided in electronic format for upload to Quest. Task D: Construction Documentation and Management AECOM will provide a part-time Resident Project Representative (RPR) services. Our budget assumes a construction time frame of 16 weeks at 5 days per week for one on-site AECOM RPR and that 4 field design changes may be required during construction. AECOM will provide a RPR and on-site testing staff as-needed to document construction. Field and laboratory testing will be provided as necessary to document compliance or noncompliance with project plans and specifications. In addition, we will work with the City and contractor on contract administration issues. A summary of tasks is provided below AECOM’s past experience with construction documentation/management of Riverwalk projects indicate that the following services are needed to successfully complete the project:  Provide as needed or part-time Resident Project Representative (RPR) services during construction events as project requirements dictate to evaluate and document compliance with the Construction Documents.  Provide on-site material testing staff as-needed to document construction and compliance or noncompliance with project plans and specifications.  Coordinate with survey crews to provide stakeout locations and cut sheets for Contractor’s use during construction. A budgetary allowance is included for layout work associated with walkway alignments and grading. We have included six (6) 8-hour trips to the site in the budget, along with survey data set up, associated truck and equipment rental.  Review contractor’s progress schedule, schedule of submittals/submissions, and schedule of values prepared by contractor, and consult with the City concerning their appropriateness.  Review contractor submittals and material samples for conformance with contract documents.  Maintain correspondence files, reports of job conferences and meetings, shop drawings and sample submissions, reproductions or original contract documents including all addenda, change orders, field orders, and additional drawings issued subsequent to the execution of the contract.  Maintain reports for the construction contractor activities; weather conditions when on the job site; data relative to questions of extras or deductions; list of visiting officials, representatives of manufacturers, fabricators, suppliers and distributors; daily activities; decisions; observations in general; and specific observations in more detail as in the case of observing test procedures.  Review applications for payment from the contractor for compliance with the established procedure for their submission, and forward with recommendations to the City noting, in particular, relation to the schedule of values, work completed, materials and equipment delivered at the site, but not incorporated in the work.  Provide vehicles, necessary equipment, and material for inspection. Please note if the construction schedule changes, AECOM reserves the right to submit an amendment request for consideration to increase or decrease the budget based on the actual Construction Schedule. As always, AECOM will only bill for actual time incurred. Deliverables: AECOM will provide a construction documentation report and As-Built Record Drawings for the project. One hard copy and electronic copy will be provided. Key Milestones and Project Schedule The success of any project is based on identifying all critical pathway items and establishing a schedule for completion. Based on our similar project experience, below is a list of key milestones that should be included. Please note, to meet the proposed schedule, several of the milestones will need to overlap. We have included an estimated timeframe in weeks to complete each item. City staff will be integral in developing the final project schedule. AECOM will provide monthly updates to the schedule once established. We anticipate a total of 16 weeks to complete the Riverwalk construction. This estimate is based on past experience. Once a Contractor is selected and a Construction Schedule is developed, it will be discussed with City staff to confirm the actual construction length. Adjustments to the scope of work will be proposed for City consideration in an effort to stay within the above referenced budgets. As you are aware, the world is experiencing a pandemic as it relates to the coronavirus COVID-19 (“Coronavirus”). This health emergency has the potential of impacting multiple facets of the project including, without limitation, labor, personnel, manufacturing, equipment, materials, transportation, and related supply chains, all of which have the potential to adversely impact the critical path of the project schedule. These potential, unusual, and unavoidable delays are outside of the control of AECOM and cannot be anticipated or determined in advance. AECOM will exercise reasonable care to mitigate the potential impact of the Coronavirus to the extent within AECOM’s reasonable control. AECOM will notify the City promptly in the event AECOM becomes aware of any potential impact to the work caused by the Coronavirus. Key Project Staff AECOM proposes a highly experienced team, who has been involved on other successful Oshkosh Riverwalk projects, to complete this project on schedule and within budget. This team has extensive experience in design, permitting, and construction management, specific to Oshkosh Riverwalk projects. AECOM has completed bidding documents for all the previous Riverwalk projects for the City of Oshkosh. These previous documents will be utilized to quickly and efficiently prepare the Pioneer Riverwalk Project Documents. We anticipate that the EJCDC format of the bidding document will again be utilized. This approach will also include updating the 30% design drawings previously prepared by AECOM into 100% bidding document drawings. Each individual AECOM staff name is classified with an associated hourly rate. Our team organization is tailored to provide services effectively and at a lower cost. We utilize senior staff to provide guidance and review of all work products, with a majority of the production work completed by lower cost junior staff. In addition, senior staff either self-preforms or provides a high level of supervision to junior staff during critical phases of the project. This approach has been successfully utilized on all of City of Oshkosh projects. AECOM will only charge for actual incurred costs. If the project is completed outside of the assumptions, AECOM may request to reduce or increase the budget accordingly. As with all of our agreements with the City of Oshkosh, AECOM will not charge for over-time related to completing this project. All billing unit rates will be at straight time per the 2021 approved Fee Schedule. Terms and Conditions Services described in this agreement will be performed on a time-and-expense/unit-cost basis. The 2021 Approved Fee Schedule and 2009 Negotiated Terms and Conditions of Service and the unit prices and terms for various elements of service we expect will be utilized in providing the services outlined in this agreement. Habitat for Humanity, Greater Oshkosh Healthy Neighborhoods and the City will be working together to support another neighborhood in redevelopment and revitalization efforts. Neighborhood outreach has started and projects should occur in June 2021. The proposed acquisition/demolition project at 548 Otter Ave. is located in the River East neighborhood. South Shore Redevelopment Area: 43 E 7th Ave/Rec Lanes/706 S. Main Street – Demolition is complete. The RFP has been distributed with limited environmental information available. Proposers may want to do additional testing or the environmental conditions may limit the interest in the RFP. Staff will be using a rolling deadline for applicants until the RDA selects a project proposal(s). The first deadline is April 16, 2021 for the May RDA meeting. Pioneer Marina/Island Area – Mr. Art Dumke continues to work with City staff and other possible developers to explore development options and funding scenarios. The City drafted a TIF Plan for possible redevelopment and the City Council approved the TIF Plan on September 24, 2019. The site also qualifies for New Market Tax Credits and was included in an Opportunity Zone. Another pier was installed in the marina in 2020. Miles Kimball Building (Northwest corner of S. Main/9th Ave) - A new developer is interested in constructing twenty eight (28) residential units in the former Miles Kimball building. A TIF application was submitted and the TIF Plan and Development Agreement are going through the review and approval process. The City Council approved the TIF Plan on March 9, 2021. 9th Avenue extension to CN Railroad – The 9th Ave. extension and utility undergrounding was put in the CIP - Favorable Economic Conditions category in 2022-2023. Pioneer Drive Riverwalk – Based on the review of applications with the WisDNR, there is little chance that a grant application will be successful. The City is exploring alternative methods of financing the project. The City has retained the engineer for the final design and bidding for the project. City staff will be presenting a funding plan to the Council in the near future. Boatworks Property – The Option was granted to Morgan Partners through December 31, 2020, and so has expired. Staff is working with Morgan Partners to help move the redevelopment of the site and the Morgan site forward. S. Main between 7th and 8th – Mr. Andy Dumke reports he is still trying to develop the Sawdust Lofts. He may apply for another round of LIHTC. Marion & Pearl Redevelopment Area Merge Update – Construction continues on the Parcel H site, the location of The Brio Building, a mixed-use Food Coop/residential building. Underground investigations continue on Parcel J along the Fox River and the developer has started building planning and design for that site called “Mackson Corner” Morgan Crossing – Phase 2 – Alexander and Bishop has proposed another multi-family building on the vacant parcel to the east of the existing Morgan Crossing building. Due to issues with the ATC line along the property, the site plan is being modified. The revised redevelopment and a proposed TIF have not been scheduled for review/action at this time. Sawyer Street/Oshkosh Avenue Multi-modal Trail – WisDOT awarded the City $253,000 for extending the trail east from Punhoqua through Rainbow Memorial Park to the Sawyer Street/Oshkosh Avenue intersection in 2021. Staff is working on the design and environmental documents for WisDOT approval this winter. Bidding is planned for the spring of 2021 with construction to be completed in 2021. Jefferson Street Redevelopment Staff has provided information on the site to additional developers interested in affordable housing projects.
