WHEREAS, the City and SmithGroup previously entered into an agreement in
which SmithGroup for Phase 1 initial development of Lakeshore Park where they would
provide the City with architectural and civil engineering, landscape architecture,
ecological, site and building structural engineering, mechanical/electrical/plumbing
engineering and permitting services; and
WHEREAS, during this initial design phase further discussions were had with the
Advisory Parks Board concerning existing site conditions and building occupant
capacities for the building; and
WHEREAS, through these discussions necessary changes in the design work were
identified and will require additional design services from SmithGroup which will
increase the estimated project total.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed to enter into and take
those steps necessary to implement an appropriate amended professional services
agreement with SmithGroup for additional architectural and civil engineering, landscape
architecture, ecological, site and building structural engineering,
mechanical/electrical/plumbing engineering and permitting services in the amount of
one hundred seven thousand seven hundred ten dollars. ($107,710.00).

RE: Approve Amendment to Professional Services Agreement with SmithGroup for
Phase 1 Initial Development of Lakeshore Park ($107,710)
BACKGROUND
At their September 22, 2020 meeting, the Common Council approved the proposal from
SmithGroup for Phase 1 initial development of Lakeshore Park with focus on the four-season
building, public plaza and parking areas. The services included architectural and civil
engineering, landscape architecture, ecological, site and building structural engineering,
mechanical/electrical/plumbing engineering and permitting services. During this initial design
phase of the building, discussion has taken place with the Advisory Parks Board on existing site
conditions as well as occupant capacities for the assembly room and building. Through these
discussions, the estimated total project cost has increased which will lead to additional design
work for SmithGroup.
ANALYSIS
Much of the discussion with the Advisory Parks Board has focused on the desired building
capacity and assembly room capacity that the building should be designed to accommodate.
Through public input during the Lakeshore Park Master Plan process, a four-season building
with a multipurpose assembly room to accommodate 120-150 was identified and included in
the master plan. As the initial design process was underway and the existing site conditions
were analyzed, the decision was made to decrease the size of the assembly room to
accommodate 100 people in an effort to reduce project costs. At the February 8, 2021 Advisory
Park Board meeting, Board members expressed concern for the reduced capacity of the assembly
room and building since this building will be available for both public and private events. The
Board was concerned about constructing a building that would not accommodate the long-term
needs of the community and they requested cost estimates to increase the assembly room
capacity back up to the 120-150 capacity as was identified during the master plan process.
SmithGroup provided cost estimates for assembly room capacities of 75, 100, 125 and 150 people
which the Advisory Parks Board reviewed at their March 8, 2021 meeting. Based on those cost
estimates, staff recommended to the Board that the building be designed for an assembly room
capacity of 125 with the resulting building capacity being 150 people. This recommendation
was based on a design that would be consistent with the master plan as well as a cost estimate
that the City Manager, Finance Director and Parks Director believe can be achieved.
FISCAL IMPACT
Staff has reviewed the amendment and agrees with the additional work necessary. The amount
of this amendment is $107,710. This will result in a total agreement amount of $271,710 and will
be charged to A/N#: 0325-0610-6401-62001 – Contractual Services. The Common Council
approved $2,000,000 in the 2020 Parks Department CIP for the initial development of phase 1 of
Lakeshore Park. These funds are proceeds from the sale of a portion of the former Lakeshore
Golf Course. A funding plan for the construction of this initial phase 1 development is planned
for an upcoming Common Council meeting.
RECOMMENDATION
Section 12-16 of the Municipal Code provides that subject to approval of the City Manager, the
City may enter into professional service agreements without following a competitive bidding or
quotation process. I have reviewed the amendment and, in accordance with Section 12-16 of the
Code, I am hereby recommending that the Common Council approve this amendment.
