REUSE AT 544 W. 17th AVENUE

The applicant is requesting Conditional Use Permit approval for an adaptive reuse at 544 W.
17th Avenue.
Applicable Ordinance Provisions:
Adaptive Reuses are permitted only through a conditional use permit in the Neighborhood
Mixed Use District (NMU) as regulated in Section 30-51 (C) of the Zoning Ordinance. Criteria
used for Conditional Use Permits are located in Section 30-382 of the Zoning Ordinance.
Property Location and Background Information:
The subject site is located on the north side of W. 17th Avenue, east of Ohio Street. The subject
parcel is about 0.17 acres (7,500 sq. ft.) in size and is developed with an existing 1,474 sq. ft. auto
service garage and associated parking area. The site is surrounded predominantly by a mixture
of single-family residential and commercial land uses.

ANALYSIS
The applicant is requesting approval for an adaptive reuse of the site to convert the western
portion of the existing auto service building to cider production and retail floor area. The
eastern portion of the building will continue to be used as a private garage/workshop utilized
by the property owner.

According to the applicant, the only exterior change to the site will be the addition of an 8’ X 15’
walk-in cooler to be constructed on the rear of the building for storage of hard cider products.
Interior modifications will include installation of multiple sinks and a new gas water heater.
The building currently has a bathroom that customers will have access to and a hand rail will be
installed. A 4’ X 8’ wall sign will also be installed on the street-facing façade.

The applicant notes that their product will primarily be delivered directly to customers via
personal vehicle. Deliveries of supplies to the site are expected at a maximum of 1-2 times per
week by small delivery truck. Sales will also be conducted within the building. It is not
expected that more than two customers will be at the cidery at a time. Expected operation
hours are weekdays 4 PM – 9 PM and weekends 12PM – 9 PM. The two owner/operators will
be the only employees. The existing parking area has 4 stalls which will be sufficient for
employee and customer parking.

A virtual neighborhood meeting was held on December 10, 2020. The neighbors voiced support
for the proposed use of the site.
Staff is in support of the Conditional Use Permit (CUP) for the adaptive reuse as the proposed
cidery use will not have a detrimental impact on the surrounding area and is compatible with
surrounding land uses.
RECOMMENDATION/CONDITIONS
In its review and recommendation to the Common Council on an application for a Conditional
Use Permit, staff recommends the Plan Commission make the following findings based on the
criteria established by Chapter 30-382 (F)(3):

(1) Is in harmony with the Comprehensive Plan.
(2) Would not result in a substantial or undue adverse impact on nearby property, the
character of the neighborhood, environmental factors, traffic factors, parking, public
improvements, public property or rights-of-way, or other matters affecting the public
health, safety, or general welfare.
(3) Maintains the desired consistency of land uses, land use intensities, and land use
impacts as related to the environs of the subject property.
(4) The conditional use is located in an area that will be adequately served by, and will not
impose an undue burden on, any of the improvements, facilities, utilities or services
provided by public or private agencies serving the subject property.
(5) The potential public benefits outweigh any potential adverse impacts of the proposed
conditional use, after taking into consideration the applicant’s proposal and any
requirements recommended by the applicant to ameliorate such impacts.
Staff recommends approval of the proposed Conditional Use Permit for an adaptive reuse at
544 W. 17th Avenue as proposed with the findings listed above.
