HomeMy WebLinkAbout14. 20-476 DECEMBER 8, 2020 20-476 RESOLUTION (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE LABOR CONTRACTS WITH OSHKOSH PROFESSIONAL POLICE OFFICERS ASSOCIATION (OPPA), OSHKOSH POLICE SUPERVISORS ASSOCIATION (OPSA) & AMERICAN FEDERATION OF STATE, COUNTY, & MUNICIPAL EMPLOYEES (AFSCME) LOCAL 796 TRANSIT FOR YEARS 2021, 2022 & 2023 INITIATED BY: ADMINISTRATIVE SERVICES DEPARTMENT WHEREAS, the City of Oshkosh and the: OPPA; OPSA; and AFSCME Local 796 Transit previously negotiated a Working Conditions Agreement for calendar years 2018- 2020; and WHEREAS, the parties reached a tentative agreement for certain changes to the labor contract for years 2021, 2022 & 2023; and WHEREAS, the OPPA; OPSA; and AFSCME Local 796 Transit have ratified these changes and it is appropriate for the Common Council to approve this agreement. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached changes to the current labor contracts for the Oshkosh Professional Police Officers Association(OPPA);Oshkosh Police Supervisors Association (OPSA); and American Federation of State, County, and Municipal Employees (AFSCME) Local 796 Transit are approved and the proper City officials are authorized and directed to enter into an appropriate agreement for these purposes, the execution copy being deemed approved by their respective signatures, and said City officials are further authorized and directed to take those steps necessary to implement the terms and conditions of the labor contract. r,A� City f- O Oshkosh TO: Honorable Mayor and Members of the Common Council DATE: December 8, 2020 FROM: John Fitzpatrick, Assistant City Manager / Director of Administrative Services RE: Labor Agreement Approvals for 2021-2023 for the Oshkosh Professional Police Officers Association (OPPA), the Oshkosh Police Supervisors Association (OPSA) and American Federation of State, County, and Municipal Employees (AFSCME) Local 796 Transit The City has reached tentative agreements with the Oshkosh Professional Police Officers Association (OPPA); the Oshkosh Police Supervisors Association (OPSA); and the American Federation of State, County, and Municipal Employees (AFSCME) Local 796 Transit. These agreements have been approved by the respective membership of each group for the contract years of 2021, 2022 & 2023. A brief synopsis of agreement elements include: 1) The following across the board wage increases for each respective group: a. OPPA: 2.5% in 2020, 1.75% in 2021, and 3% in 2022. b. OPSA: 2.5% in 2020, 1.75% in 2021, and 3% in 2022. c. AFSCME: 2.0% in 2020, 1.5% in 2021, and 2.5% in 2022. 2) Added a lateral entry program for Police recruitment 3) Maintained/eliminated health insurance caps 4) Eliminated holiday time rollover for Transit 5) Updated grievance processes, investigatory processes, sick leave process, compensatory time processes, clothing allowance and contract language updates. Included in this packet are each of the conceptual tentative agreements as well as the total fiscal impacts of any items associated with the agreements. Lateral Transfer Add: Schedule A Add Section after Movement on the Pay Schedule Lateral Transfer Pay Employees hired after 1/1/2021 who have previous certified sworn law enforcement experience shall, upon successful completion of their probationary period, be eligible to progress to the pay step which coincides with one-half of their recognized experience. Additionally, such employees shall be eligible far vacation accruals in the same manner. TA 3. Sick Leave Modify: ARTICLE VI. A. Sick Leave Paragraph 7--Add sentence at end of paragraph Once this option is exercised, it shall be irrevocable unless otherwise directed by the Director or Administrative Services (or designee) TA 4. Compensatory Time Modify: ARTICLE IV- Compensatory Time Delete Paragraph 2 Replace with: All compensatory time will be recorded and may be taken as time off or as pay received after the pay period in which it was earned, subject to the approval of the department head or management designee(s). Employees will receive pay each pay period for any time accumulated in excess of one hundred sixty (160) hours. Officers shall not be allowed to carry over more than eighty (80) hours from year to year. The formula for computing the hourly rate shall be: bi-weekly rate + educational divided by 77.2 hours. TA 5• Insurance Benefits: Modify: ARTICLE VIII: A. Insurance Medical Benefits Plan. Keep 2020 cap for next 3 years 6. Wages: Effective at the beginning of each year's pay period that includes the date January 1. a. 2021: 2.5% b. 2022: 1.75% C. 2023: 3% TA 7. Term: Three years. 1 o`ZS`2o 8. Future items requested that will be worked on outside the CBA process a. Update Directive 144 to reflect that Officers will not be allowed to change their approved vacation selection from the Saturday prior to Memorial Day through Labor Day. All other provisions will remain the same. b. Develop a new directive to codify that Officers will be allowed to request "comp time switches" up to 60 days in advance c. Ask the Tech Committee to research the use of texting software technology for call in procedures d. Holiday -Leave: Modify: ARTICLE V, Holiday Leave, delete sub -section B, in sub -section A, delete: "-Supervisors Appointed Prior to Jan. 1 2008" 3. Clothing Allowance, Uniforms ARTICLE XXXI, SECTION A, SENTENCE 2 Add: Winter outwear, hats, gloves, boots, rain jackets, and rain pants to list of approved TA 2. Surveillance, Add language: Investigations involving any employee shall be called to the employee's attention as soon as practicably possible after notice of the alleged offense has been brought to the attention of the department concerned. Audio and/or video can be heard/viewed when an incident(s) (public complaint, accident, passenger incident, driver (Union) need of documentation) occurs, in accordance with potential legal considerations. TA 5. Pay Policy — Article XII, Section F. Holiday Pay: Delete Sentence 2 replace with: Any surplus in the number of hours available for holiday leave (both established and floating holiday) will be paid on the last paycheck of the calendar year 6. Wages: Effective at the beginning of each year's pay period that includes the date TA January 1. a. 2021: 2% b. 2022: 1.5% C. 2023: 2.5% Term: Three years. TA 7. The City and employee shall each contribute 50% of the actuarially required contribution to WRS as determined by the Employee Trust Funds (ETF).
