HomeMy WebLinkAbout02. 20-451 NOVEMBER 24, 2020 20-451 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: ACCEPT STORM DRAINAGE EASEMENTS AT THE SOUTH 4200 BLOCK OF STATE HIGHWAY 91 INITIATED BY: CITY OF OSHKOSH PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the City hereby accepts two storm drainage easements at the South 4200 Block of State Highway 91, per the attached, and the proper City officials are authorized and directed to execute any and all documents necessary for purposes of same. TO: Honorable Mayor and Members of the Common Council FROM: Mark Lyons Planning Service Manager DATE: November 19, 2020 RE: Accept Storm Drainage Easements at the South 4200 Block of State Highway 91 (Plan Commission Recommends Approval) BACKGROUND / ANALYSIS The subject site is a 15.37 acre undeveloped lot located between State Highways 91 and 44 approximately 1/4 mile west of S. Oakwood Road. The subject property is the site of the proposed Swiderski multi -family development. The proposed development consists of 14 apartment buildings totally 172 units and associated amenities. The City is requesting the easements to allow for eventual installation and maintenance of drainage structures. The structures will connect to site drainage from the Swiderski development to the ditch line on State Highway 91 once public sidewalk is constructed. The need for the easements was determined during review of the site's grading and drainage plan for the Swiderski development. The two easements are located at the northwest and northeast corners of the property and will be sized 20 feet wide by 20 feet deep and 400 square feet in area. The locations of the easements take into account the proposed right-of-way dedication. The easements are included on the draft Certified Survey Map (CSM) that will also be used to dedicate additional right-of-way along State Highway 91. The CSM also describes conditions and restrictions for use of the easement which has been reviewed by the Department of Public Works. RECOMMENDATION The Plan Commission recommended approval of the acceptance of the proposed storm drainage easements at its November 17, 2020 meeting. The Common Council is scheduled to approve the easements at its November 241hmeeting. After which, the CSM will be recorded at the Winnebago County Register of Deeds. Easement Details 20' x 20' Drainage Easement Detail "A" Scale: 1" = 20' 20' x 20' Drainage Easement Detail "B" Scale: 1" = 20' 20' x 20' Drainage Easement Defined An unobstructed easement for the installation and maintenance of future drainage structures. The purposed of said drainage structure is to connect site drainage from Lot 1 of this Certified Survey Map to existing ditch line once proposed City sidewalk is installed. This easement shall have no permanent obstructions (fences, trees, shrubs, or other obstacles) that interfere with the install and maintenance of said proposed systems. Said Easement is defined as 20' x 20' Drainage Easement which affects Lot 1 of this Certified Survey Map for the benefit of the City of Oshkosh. This easement is subject to all existing easements, and restrictions of record. Grantor: S.C. The Plan Commission approved of the acceptance of the proposed storm drainage easements as requested. The following is the Plan Commission's discussion on this item. Site Inspections Report: Mr. Hinz reported visiting the site. Staff report accepted as part of the record. Mr. Nau presented the item and reviewed the site and surrounding area. The City is requesting the easements to allow for eventual installation and maintenance of drainage structures.
