HomeMy WebLinkAbout08. 20-432 OCTOBER 27, 2020 20-432 ORDINANCE FIRST READING (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE CLOSURE OF BOWEN STREET FROM EAST MELVIN AVENUE TO EAST NEW YORK AVENUE INITIATED BY: DEPARTMENT OF PUBLIC WORKS A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AUTHORIZING A VARIANCE TO SECTION 25-23 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO STREETS TO REMAIN OPEN TO TRAFFIC DURING THE COURSE OF EXCAVATION WORK. WHEREAS, the City of Oshkosh Municipal Code Section 25-23 requires a passageway of not less than ten(10)feet in the travelled portion of the street to remain open on various streets within the City of Oshkosh, including Bowen Street; and WHEREAS, the City has previously entered into a Contract with Vinton Construction, Inc. for the rehabilitation of manholes on Ohio Street, from West 1711 Avenue to West 20t"Avenue; and WHEREAS, the Common Council approved at their March 28, 2017 meeting the creation of Section 20-13 of the Municipal Code of the City of Oshkosh pertaining to the replacement of lead water services; and WHEREAS, the Section 20-13 requires that if either the public or the private side of a lead water service lateral is replace, the other half of the service lateral must be replaced within 180 days; and WHEREAS, the property owners at 1040 Bowen Street and 1102 Bowen Street have replaced the private side of their lead water service laterals and Water Distribution Division staff will complete the replacements of the public portion of the lead service lateral; and OCTOBER 27, 2020 20-432 ORDINANCE FIRST READING CONT'D WHEREAS, Water Distribution Division has requested the closure of Bowen Street, in front of the subject properties in order to complete these water service replacements; and WHEREAS, it is necessary therefore to grant a variance from the terms of section 25- 23 for this purpose; and WHEREAS, it is anticipated that each replacement will take one to two (1— 2) days to complete, and that work for all locations will be completed within three (3) days; and NOW, THEREFORE the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. The Water Distribution Division is hereby granted a variance from the provisions of Section 25-23 of the City of Oshkosh Municipal Code to close Bowen Street from East Melvin Avenue to East New York Avenue to complete the construction and replacement of the public portion of the lead service lateral subject to the following conditions: A. Water Distribution Division shall provide all necessary and required signage for the closure of the street and detour of traffic. B. Water Distribution Division shall complete the work within three (3) days; with the actual closure of Bowen Street being limited to two (2) consecutive weeks, unless extended by approval of the Director of Public Works due to weather or other extraordinary conditions. C. Water Distribution Division shall at least seven (7) days prior to the anticipated closure provide notice to the Department of Public Works and install advance warning signs for motorists. D. Water Distribution Division shall work with the Department of Public Works to minimize the effects of the street closure upon emergency services and the public. E. The Director of Public Works is hereby authorized to approve such closure, approve such closure with conditions or take such other action as may be necessary and appropriate in consultation with the Police and Fire Chiefs of the City of Oshkosh to protect the health, safety and welfare of the citizens. OCTOBER 27, 2020 20-432 ORDINANCE FIRST READING CONT'D SECTION 2. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate temporary signage indicating the closure. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #20-432 A GENERAL ORDINANCE OF THE CITY OF OSHKOSH TO APPROVE CLOSURE OF BOWEN STREET FROM EAST MELVIN AVENUE TO EAST NEW YORK AVENUE on October 27, 2020. The ordinance allows the closure of Bowen Street from East Melvin Avenue to East New York Avenue, for purpose of replacing the public portion of the lead service laterals. It is anticipated that this work be completed by the end of November 2020. The ordinance makes the Water Distribution Division responsible for advance notice of the closure to motorists and for installation of all signage and detour signage during the closure. Gohde, Assistant Director of Public Works -- y DATE: October 22, 2020 RE: Approve Closure of Bowen Street from East Melvin Avenue to East New York Avenue BACKGROUND At their March 28, 2017 meeting, the Common Council approved the creation of Section 20-13 of the Municipal Code of the City of Oshkosh pertaining to the replacement of lead water services. Section 20-13 of the Municipal Code of the City of Oshkosh requires that if either the public or the private side of a lead water service lateral is replaced, the other half of the service lateral must be replaced within 180 days. The property owners at 1040 Bowen Street and 1102 Bowen Street have replaced the private side of their lead water service laterals. In an effort to reduce costs to the rate payers of the Water Utility, Water Distribution staff will complete the replacement of the public portion of the lead service lateral. Section 25-23 of the Municipal Code of the City of Oshkosh requires Bowen Street to remain open during excavation. It is anticipated that it will take three (3) days to complete the work at all of the locations. It is anticipated each replacement will take one to two (1 — 2) days to complete. The street will be temporarily patched upon completion of the lateral replacement. The permanent pavement patch will be completed at a later date, while open to traffic. The Water Distribution Division requests permission to close Bowen Street in front of the subject properties in order to complete these water service replacements, while maintaining a safe and secure working environment for the construction crew, operators, and the general public. This is not uncommon, given the equipment and work zone required for completion of this work and the location of the water main in relation to the properties. 1.\Engineering\Tracy Taylor\Memos to Mayor & Common Council\2020\Water Dist Closure-Rowen St Page 1 of 2 Memo 1022-20.doa Detour routes will be posted for the duration of the work utilizing approved truck routes. We recognize that local, non-commercial traffic will identify and use different routes around the construction area. Access to properties will be maintained for the duration of the work or individual properties will be notified if driveway access will be restricted. Advanced warning signs will be placed seven (7) days prior to the closure to warn drivers. ANALYSIS Based on the excavation limits needed for the repair due to the water main being located on the far side of Bowen Street from the properties, staff determined Bowen Street needs to be closed to traffic in order to maintain the safety of our workers and the general traveling public. The time frame will be limited as much as possible to minimize the impact to the traveling public. Additionally, worker safety and driver safety will be compromised during this work, if done under traffic. Based on the timeframe requested by the Water Distribution Division, staff is recommending waiving the rules and requests the Council adopts this ordinance on the first reading. FISCAL IMPACT There are no fiscal impacts to this ordinance. RECOMMENDATIONS I recommend approval of the request to close Bowen Street.
