PURPOSE: APPROVE CLOSURE OF OHIO STREET FROM WEST 17TH
AVENUE TO WEST 20TH AVENUE
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AUTHORIZING A VARIANCE
TO SECTION 25-23 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO STREETS
TO REMAIN OPEN TO TRAFFIC DURING THE COURSE OF EXCAVATION WORK.
WHEREAS, the City of Oshkosh Municipal Code Section 25-23 requires a
passageway of not less than ten(10)feet in the travelled portion of the street to remain open
on various streets within the City of Oshkosh, including Ohio Street; and
WHEREAS, the City has previously entered into a Contract with Vinton
Construction, Inc. for the rehabilitation of manholes on Ohio Street, from West 17th Avenue
to West 20th Avenue; and
WHEREAS, Vinton Construction, Inc. has requested the full closure of Ohio Street,
from West 17th Avenue to West 20th Avenue to accommodate this construction; and
WHEREAS, it is necessary therefore to grant a variance from the terms of section 25-
23 for this purpose; and
WHEREAS, the anticipated time to complete the work is two (2) weeks to be
completed on or before November 16, 2020.
NOW, THEREFORE the Common Council of the City of Oshkosh do ordain as
follows:
SECTION 1. Vinton Construction, Inc. is hereby granted a variance from the
provisions of Section 25-23 of the City of Oshkosh Municipal Code to close Ohio Street from
West 17th Avenue to West 20t11 Avenue for the rehabilitation of manholes subject to the
following conditions:

A. Vinton Construction, Inc. shall provide all necessary and required signage
for the closure of the street and detour of traffic.
B. Vinton Construction, Inc. shall maintain access to the homeowners'
driveways during the duration of the work.
C. Vinton Construction, Inc. shall complete the work on or before November 16,
2020; with the actual closure of Ohio Street being limited to two (2)
consecutive weeks, unless extended by approval of the Director of Public
Works due to weather or other extraordinary conditions.
D. Vinton Construction, Inc. shall at least seven (7) days prior to the anticipated
closure provide notice to the Department of Public Works and install
advance warning signs for motorists.
E. Vinton Construction, Inc. shall work with the Department of Public Works to
minimize the effects of the street closure upon emergency services and the
public.
F. The Director of Public Works is hereby authorized to approve such closure,
approve such closure with conditions or take such other action as may be
necessary and appropriate in consultation with the Police and Fire Chiefs of
the City of Oshkosh to protect the health, safety and welfare of the citizens.
SECTION 2. This ordinance shall be in full force and effect from and after its
passage, publication and placement of the appropriate temporary signage indicating the
closure.
SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted
ordinance #20-431 A GENERAL ORDINANCE OF THE CITY OF OSHKOSH TO
APPROVE CLOSURE OF OHIO STREET FROM WEST 1711 AVENUE TO WEST 20TH
AVENUE on October 27, 2020. The ordinance allows the temporary closure of Ohio Street
from West 171' Avenue to West 20th Avenue, for purpose of rehabilitation of manholes
which is expected to occur on or before November 16, 2020 and last for a period of no more
than 2 weeks. The ordinance makes the contractor responsible for advance notice of the
closure to motorists and for installation of all signage and detour signage during the
closure.

RE: Approve Closure of Ohio Street from West 1711, Avenue to West 201h Avenue
BACKGROUND
Contract 20-11, Sanitary Manhole Rehabilitation / Inflow/Infiltration Reduction Project, was
awarded to Vinton Construction, Inc. (Vinton) at the September 8, 2020 Common Council
meeting. Part of this Contract includes the rehabilitation of manholes on Ohio Street, from West
171h Avenue to West 201h Avenue. Vinton has requested to close all lanes of traffic for a period of
two (2) weeks to complete this work, starting on Monday, November 2nd. Their request is
attached.
A local detour route will be posted for the duration of the work on Ohio Street using West 20th
Avenue, Delaware Street, and West 171h Avenue. However, we recognize that local, non-
commercial traffic will identify and use different routes around the construction area. The
Contractor is required to maintain access to homeowners' driveways for the duration of the
work. Advanced warning signs will be placed seven (7) days prior to the closure to warn drivers.
ANALYSIS
Section 25-23 of the Municipal Code of the City of Oshkosh requires Ohio Street to remain open
during excavation. Vinton cited worker and general public safety as the basis for the closure
request. Based on the locations of the manholes, rehabilitation under traffic may be very difficult.
Vinton will post the warning signs starting Monday, October 261h, in anticipation of the Council
approval of the road closure. If the road closure is not approved, the signs will be removed.
Based on the time of the year, staff is recommending waiving the rules and requests that the
Council adopts this ordinance on the first reading.
FISCAL IMPACT
There are no fiscal impacts to this ordinance.

RECOMMENDATIONS
I recommend approval of the request to close Ohio Street from West 17th Avenue to West 20'h
Avenue.
I also recommend waiving the rules and adopting this ordinance on the first reading.

RE: Request to Close Ohio Street
Dan,
Vinton Construction is submitting a formal request to close Ohio Street from 17th Ave to 20tn
Ave for a 2-week duration if approved by the Common Council for the above referenced
project. This request is based on public and crew safety as the narrow roadway width will limit
the safe passage of through traffic while the manhole rehabilitations are taking place.
The work on Ohio will start on 11/2. The required 7-day advance notice of closure signs will be
posted on Monday 10/26 in anticipation of approval. If approval is not granted, the signs will be
removed.
Please let me know if you need any additional information to get this request on the council
agenda.
