HomeMy WebLinkAbout06. 20-415 OCTOBER 13, 2020 20-415 RESOLUTION (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: GRANT ELECTRIC EASEMENT AT 201 CEAPE AVENUE INITIATED BY: CITY OF OSHKOSH PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the City hereby grants an electric easement at 201 Ceape Avenue, per the attached, and the proper City officials are authorized and directed to execute any and all documents necessary for purposes of same. TO: Honorable Mayor and Members of the Common Council FROM: Mark Lyons, Planning Service Manager DATE: October S, 2020 RE: Grant Electric Easement at 201 Ceape Avenue (Plan Commission Recommends Approval) BACKGROUND/ANALYSIS The subject site is a 4.34 acre lot located on the south side of Ceape Avenue, east of the Oshkosh Convention Center. The property contains the Convention Center/Riverside Park parking lot and a portion of Riverside Park. In 2014 the Convention Center/Riverside Park parking lot was reconstructed. At that time, WPS was allowed to update or reroute their existing underground electric lines. The Common Council approved the granting of three easements for these updates, however the agreement was not completed between the City and WPS. This request adds a fourth easement for an existing underground electric line. The City Attorney's Office has updated the original easement agreement which includes the new easement. The proposed easement is located on the east side of the property leading from one of the previously approved easements (Easement Number 2) and heads east to the east property line. The easement is proposed to be 12 feet wide by approximately 73.50 feet long. The easement will allow WPS to maintain or replace its facilities and is subject to conditions and restrictions listed in the easement agreement. The Transportation Department has reviewed this request and does not have concerns with the easement affecting the function of the parking lot. The City Attorney's office has prepared an updated draft of the necessary easement documents and will work with the Department of Public Works and WPS to have the agreement signed. The signed easement agreement will be recorded at the Winnebago County Register of Deeds upon approval by the Common Council which is scheduled for October 13th. RECOMMENDATION The Plan Commission recommended approval for granting of the electric easement at its October 6, 2020 meeting. GENERAL INFORMATION Applicant/Owner: City of Oshkosh Actions Requested: The City of Oshkosh is requesting the granting of a public utility easement to Wisconsin Public Service Corporation (WPS) for underground electrical facilities at the Oshkosh Convention Center parking lot, 201 Ceape Avenue. Staff report accepted as part of the record. Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. The easement will allow WPS to maintain or replace its facilities and is subject to conditions and restrictions listed in the easement agreement. Ms. Propp opened technical questions to staff. There were no technical questions on this item. Ms. Propp asked if there were any public comments. There were no public comments on this item. Mr. Ford arrived at 4:10pm. Ms. Propp closed public comments. Motion by Hinz to adopt the findings and recommendation as stated in the staff report.
