HomeMy WebLinkAboutItem IV PLAN COMMISSION STAFF REPORT OCTOBER 6,2020 ITEM IV: SUBDIVISION VARIANCE REQUESTS FOR PROPERTY LOCATED AT 615 MOUNT VERNON STREET GENERAL INFORMATION Applicant: Dawn Krebs Owner: Karen Wendland Action(s) Requested: The applicant is applying for two variances from the subdivision regulations. The first, to allow the creation of a lot with a width of 57.01 feet at the right-of-way line whereas Section 30- 443(H)(6) requires a minimum width of 60 feet at the building setback line for newly-created parcels. The second request is to allow creation of a lot with an area of 6,851 square feet whereas Section 30-41 (G) requires a minimum lot area of 7,200 square feet in the Two Flat Residential-10 (TR-10) Zoning District. Applicable Ordinance Provisions: Land division criteria and variance procedures are found in Article XIII: Subdivisions, City of Oshkosh Zoning Ordinance. Lot density, intensity and bulk regulations for the Two Flat Residential-10 (TR-10)Zoning District are found in Section 30-41(G). Property Location and Background Information: The subject site located at 615 Mount Vernon Street is a conforming sized lot, 60.00 feet wide, 120.00 feet deep and 7,200 square feet in area, meeting the TR-10 District's minimum lot size standards. Currently, the lot contains a three-family structure, a legal nonconforming use in the TR-10 District. In addition to the dwelling, the site contains a gravel off-street parking area and shed. The owner of the property to the south, 609 Mount Vernon Street(applicant for this request) approached the owner of 615 Mount Vernon Street to purchase the south three feet of the 615 property. This would enable construction of a wider driveway and rectify a fence encroachment on the 615 property. The transfer of land would occur via Certified Survey Map (CSM). A draft copy of the CSM is included in this staff report. Two Flat Residential-10 with Planned West Two Family Development Overlay (TR-10) Comprehensive Plan Land Use Recommendation Use Category 10 &20 Year Land Use Recommendation Light Density Residential ANALYSIS The purpose of these variance requests is to widen the width of an existing nonconforming-sized lot from 45 feet to 48 feet. The consequence of this is a conforming-sized lot will become nonconforming in width and area(60.00 feet to 57.01 feet wide, 7,200 square feet to 6,851 square feet in area). The applicant states in her narrative,her existing driveway is extremely narrow, 7.8 feet wide tight between the house and an existing fence. The width of the driveway does not meet the minimum eight-foot width the Zoning Ordinance requires. The addition of three feet will allow the owner of 609 Mount Vernon Street to widen the driveway to 10.3 feet wide and reconstruct the fence on the new lot line. The proposed lot line will be located in close proximity of an existing shed on 618 Mount Vernon Street which will be in the required three foot setback. The Owner of 615 Mount Vernon Street stated the shed is in disrepair and will be razed as indicated on the draft CSM. The proposed variance will not have a direct impact on the three-family use. Staff is of the opinion that the reduction of 615 Mount Vernon Street's width and area will not adversely affect the neighborhood and in fact eliminate two nonconforming situations at 609 Mount Vernon Street. Based on this, staff is supportive of the two variance requests. RECOMMENDATION/CONDITIONS Staff recommends approval of the Subdivision Regulations variance to allow the creation of a 57.01 foot wide lot where 60.00 is required and a 6,851 square foot sized lot where 7,200 square foot is required as proposed.
