($104,000.00) INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized to enter into and take those steps necessary to implement an appropriate professional services agreement with Strand Associates, Inc. for design services for Oregon Street and Bradley Street Culvert Replacements in the amount of one hundred four thousand five hundred dollars ($104,000.00) Acct. Scope of Services Proposed services can be described as follows for each of the two culvert locations. Design Services Prepare sediment sampling plan in accordance with NR 347 and submit to Wisconsin Department of Natural Resources (WDNR) for approval. Collect sediment and parent material samples in accordance with NR 347 at up to three locations and submit to City's selected laboratory for analysis. Summarize results and provide to City and WDNR. 4. Evaluate the potential for discharge of fill materials into the Waters of the United States, in accordance with the provisions of the Clean Water Act and Chapter TRANS 207, and prepare a general permit application. Preparation of an individual Section 404 permit application for submittal to the United States Army Corp of Engineers may be provided through an amendment to this Proposal. Identify wetland impacts in conjunction with WDNR in accordance with TRANS 207. Prepare and submit a Water Resources Application in accordance with TRANS 207 for project permits to City and WDNR for review and approval. Obtain existing utility maps for known utilities within the project area and obtain input from the utility facility owners to establish features of the project that may affect utility facilities. Attend up to two utility meetings with City and utility representatives. Attend up to three design meetings with City. 10. Perform hydrologic calculations and modeling to estimate peak 100-year design storm flows for Gallops/Merritts Creek at the potential culvert location. Develop an existing condition hydraulic HEC-RAS model of Gallops/Merritts Creek in the area of the potential culvert. 12. Develop a proposed conditions hydraulic model of Gallops/Merritts Creek to reflect proposed culvert improvements. 13. Prepare a structure survey report/hydraulic report and submit to City for review, including copies of design calculations. 14. Prepare structural design calculations for approximately 65-foot long two -cell or three -cell cast -in -place concrete box culvert with openings for existing storm sewer connections in accordance with American Association of State Highway and Transportation Officials and Wisconsin Department of Transportation (WisDOT) standards. 15. Prepare preliminary box culvert structural drawings and erosion control drawings in accordance with WisDOT standards for review by City. 16. Prepare an opinion of probable construction cost (OPCC). 17. Prepare final box culvert and roadway drawings. 18. Prepare special provisions to accompany City -prepared Contract Documents. 19. Prepare addendum and answer questions during bidding. Service Elements Not Included The following services are not included in this Proposal. If such services are required, they shall be provided as noted. 1. Additional Site Visits and/or Meetings: Additional City -required site visits or meetings will be provided through an amendment to this Proposal or through a separate proposal with City. 2. Archaeological or Botanical Investi ag tions: Strand will assist City in engaging the services of an archaeologist or botanist, if required, to perform the field investigations necessary for agency review through a separate proposal with City. 3. Bidding- and Construction -Related Services: Bidding- and construction -related services shall be provided by the City. 4. Geotechnical Engineering: Geotechnical engineering information will be provided through City and City's geotechnical consultant. 5. Land and Easement Surveys/Procurement: Any services of this type including, but not limited to, a record search, field work, preparation of legal descriptions, and/or assistance to City for securing land rights necessary for siting sanitary sewer, tanks, and appurtenances will be provided through a separate proposal with City. 6. Preparation for and/or Appearance in Litigation on Behalf of City_: This type of Service by Strand will be provided through a separate proposal with City. Services Furnished During Readvertisement for Bids, if Ordered by Ci1y: If a Contract is not awarded pursuant to the original bids, any services of this type will be provided through a separate proposal with City. Services Related to Buried Wastes and Contamination: Should buried solid, liquid, or potentially hazardous wastes or subsurface or soil contamination be uncovered at the site, follow-up investigations may be required to identify the nature and extent of such wastes or subsurface soil or groundwater contamination and to determine appropriate methods for managing of such wastes or contamination and for follow-up monitoring. Investigation, design, or construction -related services related to buried solid, liquid, or potentially hazardous wastes or soil or groundwater contamination will be provided through a separate proposal with City. Compensation City shall compensate Consultant for Services on an hourly rate basis plus expenses a not -to -exceed fee of $104,000 in accordance with the hourly rate table below. Services are scheduled for completion on April 30, 2021. Standard of Care The Standard of Care for all Services performed or furnished by Consultant under this Proposal will be the care and skill ordinarily used by members of Strand's profession practicing under similar circumstances at the same time and in the same locality. Strand makes no warranties, express or implied, under this Proposal or otherwise, in connection with Strand's Services. Assist Consultant by placing at Consultant's disposal all available information pertinent to this project including record drawings, existing right-of-way plat and drawings, horizontal and vertical control survey data, traffic projections, title searches, section quarter section location and descriptions, previous drawings and specifications, and any other data relative to the scope of this project. 2. Guarantee access to and make all provisions for Strand to enter upon public and private lands as required for Strand to perform Services under this Proposal. 3. Examine all reports, sketches, estimates, special provisions, drawings, and other documents presented by Strand and render, in writing, decisions pertaining thereto within a reasonable time so as not to delay Strand's performance. 4. Provide all legal services as may be required for the development of this project. Retain the services of an analytical lab to test the sediment and parent material. Retain the services of a soils consultant to provide any necessary geotechnical evaluation and material testing. Provide all surveying services. Retain the services of an archaeological and historical consultant to provide any necessary screening and investigation. Provide easement acquisition services, including appraisals if required. 10. Provide bidding- and construction -related services. 11. Pay all permit and plan review fees payable to regulatory agencies. 12. Conduct topographic survey of the project area within the existing road right-of-way and acquire cross sections of the creek. 13. Conduct cross section survey of Gallops/Merritts Creek at approximately 15 locations from 150 feet upstream to 300 feet downstream of each structure. Opinion of Probable Cost Any opinions of probable cost prepared by Strand are supplied for City's general guidance only. Strand has no control over competitive bidding or market conditions and cannot guarantee the accuracy of such opinions as compared to contract bids or actual costs to City. (Strand) ($104,000) BACKGROUND The Winnebago County Highway Department inspects all bridges within the City of Oshkosh on a bi-annual basis in accordance with Wisconsin Department of Transportation (WDOT) requirements. Those reports are submitted to the WDOT upon completion. An inspection completed in late 2019 indicated the deterioration of the structure exceeded typical repair methods and the structure needed to be considered for replacement in the near future. The report also indicated there is significant cracking and ninety percent (90%) of the surface is patched, cracked, or delaminated. Delamination is the separation of the steel reinforcement from the concrete structure. This stretch of Oregon Street is included in the 2021 Capital Improvements Program (CIP) as we continue to extend the sanitary interceptor to the south. This bridge will be replaced in conjunction with the interceptor project. In the late summer/early fall of 2018, it was determined that the Bradley Street culvert crossing of Gallups/Merritts Creek was beginning to fail. The Streets Division did some temporary stabilization of the bottom of the culverts and the side -slopes of the street. This fix is only a temporary fix as Bradley Street is proposed in the 2022 CIP to have a new asphalt street constructed. In conjunction with the 2022 asphalt street project, the culverts are scheduled to be replaced. These culverts are being grouped together because they are similar in nature and on the same section of Gallups/Merritss Creek. The scope of services includes: developing and executing a sediment sampling plan; identifying the state and federal permits required and completing permit applications; performing hydrologic calculations and modeling to determine culvert design parameters; preparing necessary design plans and specifications; and assisting during the bidding process. ANALYSIS Engineering Division staff carefully reviewed the scope of services and worked with Strand to determine which tasks the City may be able to self -perform. Once the final scope of services was determined, Engineering Division staff reviewed the proposed cost, and found that it is in line with the level of effort necessary to complete the project. Strand was chosen to perform these services because of their experience in providing similar services to the City. FISCAL IMPACT The proposed fee is not to exceed $104,000. Funding for these services is included in the Storm Water section of previous years' CIP within projects that have come in under budget. Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature, including engineering services, may be procured without the use of formal, sealed quotes.
