AUGUST 12, 2020 20-352 RESOLUTION (CARRIED__6-0___LOST_______LAID OVER_______WITHDRAWN_______) PURPOSE: APPROVE SPECIFIC IMPLEMENTATION PLAN AMENDMENT FOR TEMPORARY CONSTRUCTION SIGNAGE AT 1650-1660 OSHKOSH AVENUE INITIATED BY: LAKESHORE DEVELOPMENT OF OSHKOSH LLC PLAN COMMISSION RECOMMENDATION: Approved w/ conditions WHEREAS, the applicant would like to amend the previously approved Specific Implementation Plan for an office and retail building at 1650-1660 Oshkosh Avenue; and WHEREAS, the Plan Commission finds that the planned development amendment for temporary construction signage at 1650-1660 Oshkosh Avenue is consistent with the criteria established in Section 30-387(C)(6) of the Oshkosh Zoning Ordinance; and NOW THEREFORE BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh that the amendment to the specific implementation plan for temporary construction signage at 1650-1660 Oshkosh Avenue, per the attached, is hereby approved with the following conditions: 1. Construction fencing/signage may not be placed within the public right- of-way. 2. Temporary fencing/signage may only be displayed while the site is under construction. Westfield Street and is located within the Corporate Business Park District (CBP). On January 28, 2019, the Common Council approved a Specific Implementation Plan (SIP) for an office and retail development at the subject site. The surrounding area consists predominately of commercial uses as well as Mary Jewell Park to the east and Lakeshore Park and Oshkosh Corporation Global Headquarters to the north. The 2040 Comprehensive Plan recommends Interstate Commercial land use for the subject property. ANALYSIS The petitioner requests an amendment to the Specific Implementation Plan approval to allow for temporary construction signage. There will be no other changes to the previously approved SIP. Temporary construction fencing is being proposed along both the Oshkosh Avenue and N. Westfield Street frontages. The proposed fencing will be 6' tall chain link and include a 5' 3" tall mesh banner on the exterior which will include graphics pertaining to the development. A Base Standard Modification (BSM) will be required as code does not allow signs to be attached to fences. Staff does not have concerns with the BSM as the signage will only be displayed during construction. The Department of Public Works reviewed the placement of the fencing/signage and noted that the fencing may not be located within the public right-of-way. RECOMMENDATION The Plan Commission recommended approval of the Specific Implementation Plan amendment with findings and conditions at its August 4, 2020 meeting. Landscaping No changes have been made to the approved landscaping totals for the site. Storm Water Management No changes to the storm water management plan are being proposed. Building Facades No changes to building facades are included with this request. ITEM-SIPAmendment—I650-I660 Oshkosh Ave. 2 FINDINGS/RECOMMENDATION/CONDITIONS In its review and recommendation to the Common Council on an application for a Planned Development district, staff recommends the Plan Commission make the following findings based on the criteria established by Chapter 30-387 (C)(6): (a) The proposed Planned Development project is consistent with the overall purpose and intent of this Chapter. (b) The proposed Planned Development project design does not detract from areas of natural beauty surrounding the site. (c) The proposed architecture and character of the proposed Planned Development project is compatible with adjacent/nearby development. (d) The proposed Planned Development project will positively contribute to and not detract from the physical appearance and functional arrangement of development in the area. Staff recommends approval of the Specific Implementation Plan amendment as proposed with the findings listed above and following conditions: (1) Construction fencing/signage may not be placed within the public right-of-way. (2) Temporary fencing/signage may only be displayed while the site is under construction. The Plan Commission approved of the Specific Implementation Plan amendment as proposed with findings and conditions noted. The following is the Plan Commission's discussion on this item. Site Inspections Report: Mr.Hinz and Ms. Propp reported visiting the site. Staff report accepted as part of the record. The fence screening/banner is 63" high 8oz mesh material. It would be mounted to the temporary fencing around the perimeter of the property. The screening/banner will give the site a nice clean appearance. It will also provide safety and reduce visibility of the construction site.
