NEW BUSINESS
1) E-SCOOTER REGULATION AND PILOT STUDY – A person is interested in starting a
dockless E-Scooter program in the City. We have researched the options of where E-Scooters
are and are not allowed in the City based on current ordinances and statutes. We have also
looked into what other cities have or have not allowed. See summary below:
In July 2019, the State passed a law legalizing the use of electronic scooters on
roadways, sidewalks, bicycle lanes and bicycle ways.
An electric scooter under the State statue is defined as a device that weight less than
100 pounds, has handlebars and an electric motor, and is powered solely by the
electric motor and human power with a maximum speed of no more than 20 mph.
Under the State law, a City may regulate the rental and operation of electric scooters,
but must do it in the same way that it regulates bicycles with the following
exceptions:
A city may restrict or prohibit:
The operation of scooters on roads in excess of 25 miles per hour
The operation of scooters on sidewalks and bicycle ways
The short term commercial rental of scooters to the general public
A city may also establish requirements and/or limitations for the parking of scooters
on roadways, sidewalks, bicycle lanes and bicycle ways.
Milwaukee and Madison are the only cities that we know of that have adopted an
ordinance regulating commercial rental of e-scooters. Both cities prohibit
commercial rental unless conducted as part of a pilot program. Madison has not

completed a pilot program. Milwaukee did conduct a pilot study in 2019 and
recommended a 2020 pilot study which never happened due to the pandemic. As a
result any future scooter use in Milwaukee is on hold.
Whether or not Oshkosh restricts the commercial rental of e-scooters, State law will still allow
citizens to privately purchase e-scooters and use within the City. As a result, TPAB should also
consider whether the City wants to restrict the use of e-scooters on sidewalks or on roads in
excess of 25 mph. Staff is recommending both these restrictions.
STAFF STATEMENTS
2) W. 9TH AVE. STREET RECONSTRUCTION LAYOUT – Council approved one lane in
each direction, bike lanes, sidewalks and parking on both sides of the street.
3) CROSSWALK AT HAZEL & PARKVIEW – We received a request from Bella Vista for a
painted crosswalk at the intersection of Hazel and Parkview. The crosswalk would connect to
the new trail on the West side of Menomonee Park. This is an intersection, therefore a
crosswalk technically already exists. To improve connectivity to the trail and accommodate the
heavier pedestrian usage, we will be adding a curb cut and painting the crosswalk.
